HomeMy WebLinkAboutORD 225ORDINANCE NO. 225 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF PALM DESERT, CALIFORNIA, APPROVING AN AMENDMENT TO THE ZONING ORDINANCE TEXT, RELATIVE TO DIREC- TIONAL SIGNS FOR COMMERCIAL BUILDINGS WITH COURTYARD OR PLAZA TENANTS. CASE NO. ZOA 02-80 WHEREAS, the City Council of the City of Palm Desert, California, did on the 26th day of June, 1980, hold a duly noticed Public Hearing to consider an amendment of Municipal Code Title 25, Chapter 68 (Zoning Ordinance), containing sign regulations (Sign Ordinance), relative to directional signs for commercial buildings with courtyard or plaza tenants. WHEREAS, the Planning Commission, by Resolution No. 605 has recommended approval; and, WHEREAS, said amendment has complied with the requirements of the "City of Palm Desert Environmental Quality Procedure Resolution No. 78-32", in that the subject project has not been found to present an adverse impact on the environ- ment and a Negative Declaration has been prepared; and, WHEREAS, at said Public Hearing, upon hearing and considering all testi- mony and arguments, if any, of all persons desiring to be heard, said City Council did find the following facts and reasons to exist to approve a Zoning Ordinance Text Amendment: 1. That the Zoning Ordinance Amendment is consistent with the objectives of the Zoning Ordinance. 2. That the Zoning Ordinance Amendment is consistent with the adopted General Plan. 3. That the Zoning Ordinance Amendment would better serve the public health, safety, and general welfare, than the current regulations. 4. That the Zoning Ordinance Amendment is necessary to clearly define the signage entitlement for the situation it addresses. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Palm Desert, as follows: 1. That the above recitations are true and correct and conti- tute the considerations of the Council in this case; 2. That it does hereby approve a Zoning Ordinance Text Amend- ment, as provided in the attached exhibit, labeled Exhibit "A", to amend Municipal Code Title 25, Chapter 68, by adding a new section relative to directional signs for commercial building with courtyard or plaza tenants. 3. The City Clerk is directed to publish this ordinance once in the Palm Desert Post, a newspaper of general circula- tion, published and circulated in the City of Palm Desert, and shall certify to the passage and adoption of this ordinance, and the same shall be in full force and effect thirty (30) days after its adoption. ERK City of Palm Desert, Ca �fornia ORDINANCE NO. 225 Page Two EXH-IBIT A 25.68.335 Directional Siqns for Courtyard or Plaza Businesses where commercial buildings or complexes are designed to contain tenant spaces oriented to an interior courtyard or plaza and where the principal business identification sign is located on that courtyard or plaza frontage, the commercial building or complex may be permitted a pedestrian directional sign(s), which groups the names -of businesses and/or principal services to be found in the courtyard or plaza, located at major pedestrian entrances to the plaza or courtyard, as follows: a. Permitted signs shall not encroach into the public right-of-way. b. Permitted signs may be allowed up to a maximum of 12 sq. ft. of sign area for the identification of each individual tenant sgace. This area may be utilized by individual sign panels grouped together or by one panel containing the aggregrate area of all courtyard or plaza tenants. In addition to the sign area permitted for individual tenants, a permitted sign may be allowed up to a maximum of two sq. ft. of sign area for purposes of directing pedestrians to the courtyard or plaza, by means of graphic symbols and/or lettering. c. Permitted signs may either be wall mounted or freestanding, if properly integrated into the architectural and landscape design of the building. d. Permitted signs shall have a maximum height of seven ft. above the pedestrian walkway, whether wall mounted or freestanding. e. Permitted signs including supports shall have a maximum width of four feet whether wall mounted or freestanding.
