HomeMy WebLinkAboutORD 226ORDINANCE NO. 226 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF PALM DESERT, CALIFORNIA, APPROVING AN AMENDMENT TO THE ZONING ORDINANCE TEXT, RELATIVE TO OPEN HOUSE DIRECTIONAL SIGNS. CASE NO. ZOA 03-80 WHEREAS, the City Council of the City of Palm Desert, California, did on the 26th day of June, 1980, hold a duly noticed Public Hearing, to consider an amendment of the Zoning Ordinance relative to open house directional signs; and, WHEREAS, the Planning Commission, by Resolution No. 606 has recommended approval; and, WHEREAS, said amendment has complied with the requirements of the "City of Palm Desert Environmental Quality Procedure Resolution No. 78-32", in that the subject project has not been found to present an adverse impact on the environment and a Negative Declaration has been prepared; and, WHEREAS, at said Public Hearing, upon hearing and considering all testi- mony and arguments, if any, of all persons desiring to be heard, said City Council did find the following facts and reasons to exist to approve a Zoning Ordinance Text Amendment: 1. That the Zoning Ordinance Amendment is consistent with the objectives of the Zoning Ordinance. 2. That the Zoning Ordinance Amendment is consistent with the adopted General Plan. 3. That the Zoning Ordinance Amendment would better serve the public health, safety, and general welfare, than the current regulations. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Palm Desert, as follows: 1. That the above recitations are true and correct and constitute the considerations of the Council in this case. 2. That it does hereby approve a Zoning Ordinance Text Amendment, as provided in the attached exhibit, labeled Exhibit "A", to amend Municipal Code Section 25.68.150, specifying regulations for Real Estate Open House Signs, and other matters relating thereto. - 3. The City Clerk is directed to publish this ordinance once in the Palm Desert Post, a newspaper of general circulation., published and circulated in the City of Palm Desert, and shall certify to the passage and adop- tion of this ordinance, and the same shall be in full force and effect thirty (30) days after its adoption. During the period under which real estate is offered for sale or lease and while a salesperson is physically present on the premises, a sign indicating open house shall be permitted. The sign shall not exceed three square feet in area; and, if located on a pole, no part of the sign or pole area shall exceed four feet above ground level. Off -site directional signs may be permitted for an open house, subject to the following provisions: A. Each sign shall not exceed three square feet; B. No flags or banners shall be used; C. To be located on private property onl:y,,unless, prior written approval for unique circumstances is obtained.from the Director of Environmental Services. D. Limited to two signs unless prior written approval for unique circumstances is obtained from the Director of Environmental Services.
