HomeMy WebLinkAboutORD 228ORDINANCE NO. 228 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF PALM DESERT, CALIFORNIA, AMENDING CHAPTER 5 OF THE CODE OF THE CITY OF PAIII DESERT, RELATING TO CHARITABLE SOLICITA- TIONS. The City Council of the City of Palm Desert, California, DOES HEREBY ORDAIN as follows: SECTION 1: That Sub -subparagraph 13, of Sub- paragraph A, of Section 5.80.030 of the Code of the City of Palm Desert, be and the same is hereby amended to read as follows: "SECTION 5.80.030. APPLICATION FOR CHARITABLE SOLICITATIONS PERMIT. A. (13) A statement indicating the percentage of such money or property to be collected that will be devoted to charitable purposes." SECTION 2: That Sub -subparagraph 16, of Sub- paragraph A, of Section, 5.80.030 of the Code of the City of Palm Desert, be and the same is hereby amended by adding Sub -subparagraph 16 to read as follows: "A. (16) A statement that the applicant will advise persons solicited of the existence of the applica- tion required under this section, and will make the application available for immediate review upon request." SECTION 3: That Subparagraph G, of Section 5.80.070 of the Code of the City of Palm Desert, be and the same is hereby amended to read as follows: "SECTION 5.80.070. STANDARDS TO BE APPLIED IN GRANTING OR DENYING PERMITS. G. The total amount of funds or property to be devoted to charitable purposes shall be reasonable. In the'.' event that less than 75% of the gross amount collected is to be devoted to charitable purposes, special facts shall be included in the application showing that such lesser percentage is reasonable in the particular case." ORDINANCE NO. 228 Page Two SECTION 4: That Subparagraph H, of Section 5.80.070 of the Code of the City of Palm Desert, be and the same is hereby amended to read as follows: "H. That if the applicant has collected or intends to collect funds or property in other cities or derives revenue from other sources, the applicant's total overhead and administrative costs are not excessive. In the event such costs are in excess of 25% of the gross amount collected, there shall be contained in the applica- tion special facts which show that such higher costs are reasonable in the particular case." The City Clerk is directed to publish this ordinance once in the Palm Desert Post, a newspaper of general circulation, published and circulated in the City of Palm Desert, and shall certify to the passage and adoption of this ordinance, and the same shall be in full force and effect thirty (30) days after its adoption.
