ORDINANCE NO. 242
AN ORDINANCE OF THE CITY COUNCIL OF THE CITY
OF PALM DESERT, CALIFORNIA, ESTABLISHING AND
DESIGNATING CHAPTER 18 OF THE PALM DESERT
MUNICIPAL CODE AS THE "PALM DESERT MECHANICAL
CODE" WITH CERTAIN ADDITIONS, DELETIONS, AND
AMENDMENTS, THE RULES, REGULATIONS, PROVISIONS,
AND CONDITIONS SET FORTH IN THAT CERTAIN CODE
ENTITLED, "UNIFORM MECHANICAL CODE, 1979 EDITION",
INCLUDING THE APPENDICES THEREIN CONTAINED,
PROMULGATED AND PUBLISHED BY THE.INTERNATIONAL
CONFERENCE OF BUILDING OFFICIALS.
The City Council of the City of Palm Desert, California DOES HEREBY
ORDAIN as follows:
SECTION 1. That Chapter 18 be and the same is hereby added to the
Palm Desert Municipal Code to read as follows:
"Chapter 18: MECHANICAL CODE.
"Section 18.04.010 - Adoption of Mechanical Code.
"Subject to the particular additions hereinafter set forth in
this Ordinance, the rules, regulations, provisions and conditions set
forth in that certain code entitled, 'Uniform Mechanical Code, 1979 Edition',
including the Appendix and�Standards therein contained, promulgated and
published by the International Conference of Building Officials, three full
- printed copies of which, printed as a code in book form, were by the City
Council ordered filed and which have been actually filed in the Office of
the City Clerk and which as so on.file are hereby referred to and by this
reference expressly incorporated herein and made a part hereof as fully and
for all intents and purposes as though set forth herein at length, shall be
and the same are hereby established and adopted as the rules, regulations,
provisions and conditions to be observed and followed in the erection,
installation, alteration, repair, relocation, replacement, addition to,
use or maintenance of any heating, ventilating, comfort cooling, refrigera-
tion systeri, incinerators or other miscellaneous heat producing appliances
in the City of Palm Desert, California, and subject to said additions
hereinafter set forth, said Code with its Appendix and Standards containing
such rules,. regulations, standards, provisions and conditions are hereby
established and adopted and the same shall be designated, known, and referred
to as the 'Mechanical Code' of and for the City.
"Section 18.04.020 - Mechanical Code - Additions - Sec. 106.
"Section 106 is hereby added to said Mechanical Code to read as
follows:
'Sec. 106. Roof Installations and Access to Equipment.
All heating, ventilating, comfort cooling, or
refrigeration systems or other miscellaneous mechanical
systems shall be installed in accordance with this Code
and in addition shall comply with the following require-
ments:
(a)
If said unit is installed on the roof, a platform
shall be provided and the design of the platform
shall be substantially sound and constructed in
a workmanlike manner corresponding with Mechanical
Drawing 1980-1 and 2 on file and available in the
Building Department.
"Section 18.04.030
- Mechanical Code - Additions— Sec. 204.
"Section 204
is hereby added to Chapter 2 of Part I of said
Mechanical
Code to read as follows:
'Sec. 204.
Business License Required.
(a)

Before any person, firm, partnership or corpora-
tion shall carry on or engage in the business of
hearing and/or air conditioning work, he or it
shall first procure a business license and pay
to the department having jurisdiction the annual
license fee imposed on such business.
(1) No business license shall be issued to
any person unless such person possesses a
valid C-20, C-38 and C-4 State Contractor's
License of the State of California.
(2) Whenever a business license has been issued
to any person, firm, partnership, or corporation,
which applied for such license by or through a
bona -fide member or authorized agent thereof,
pursuant to the provisions of subdivision (1)
hereof, such member or authorized agent, or
some other member or authorized agent or
employee possessing such valid. C-20, C-38
and C-4 State Contractor's License of the
State of California, shall at all times be

In actual charge and control of all
heating and air conditioning done or to be
done by such person, firm, partnership, or
corporation.
"Section 18.04.030 - Mechanical Code - Additions - Sec. 205.
"Section 205 is hereby added to Chapter 2 of Part I of said
Mechanical Code to read as follows:
'Sec. 205. To Whom Permits May be Issued.
(a) No permit shall be issued to any person to do
or cause to be done any heating or air conditioning
installations, refrigeration installations and
boiler installations, as regulated by this Code,
except to a person holding a valid unexpired and
unrevoked City Business License as required by
Section 204 of this Code, except when and as
otherwise hereinafter provided in this section.
(b) Any permit required by this Code may be issued to
any person to doinstaliations as regulated by this
Code in a single family dwelling, used exclusively
for living purposes, including the usual accessory
buildings and quarters in.connection with such
buildings, in the event that such person is a
bona -fide owner of any such dwelling and accessory
buildings and quarters and that the same are occupied
by or designed to be occupied by said owner, and
that said owner shall personally purchase all material
and shall personally perform all labor in connection
therewith.'
"Section 18.04.040 - Mechanical Code - Additions - Sec. 302(b) 11.
"Paragraph 11 is hereby added to subsection (b) of Section 302
of said Mechanical Code to read as follows:
'11. Plans and Specifications. When a plan is required
and the Building Official so requests, a plan checking
fee shall be paid to the Building Department at the f

time of submitting plans and specifications for`
checking. Said plan checking fee shall be equal to, '

one-half of the mechanical fee as set forth in
Resolution #80-142.
Any person desiring a permit required by this code
shall at the time of filing an application therefor,
pay a fee as required by Resolution #80-142, adopted
by the City Council of Palm Desert, California, on
December 4, 1980, and upon review by the City Council,
may be changed by resolution of said body.'
SECTION 2. PRESERVATION OF HEALTH, WELFARE AND SAFETY. That this
City Council does hereby find that the adoption of this Code with the
additions, amendments and changes thereto, are necessary for the preser-
vation of health, welfare and safety, and is in accordance with Section
17958.7 of the Health & Safety Code of the State of California, and that
a copy of this Ordinance shall be forwarded by the City Clerk to the
Director of Housing and Community Development of the State of California.
SECTION 3. That Ordinance No. 179 and all amendments thereto and
all ordinances or parts of ordinances in conflict with this ordinance
be and the same are hereby repealed.
SECTION 4. CITY CLERK'S CERTIFICATION. The City Clerk of the
City of Palm Desert, California, is hereby directed to cause this
Ordinance to be published once within fifteen (15) days of adoption
in the Palm Desert Post,.a newspaper published and circulated within
the City of Palm Desert, California, and the same shall be in full
force and effect thirty (30) days after adoption.

FLASHING- Of ROOFTOP EQUIPMENT
ITEM I
ROOFTOP EQUIPMENT — shall be any type of air conditioner, cooler, heat pump,
or mechanical equipment which is installed upon the top of the finished roof. This
equipment shall be mounted on curbs, platforms or legs (support posts).
1•A LEGS (SUPPORT POSTS) — shall be of sufficient size and strength to ode-
. quately support the equipment and shall be spaced for enough apart to provide
adequate space for workmen to install flashings and perform other necessary
work.
Height of the legs (support posts) shall depend upon the width of the equipment.
Height shall be 12 inches minimum for any piece of equipment up to 24 inches
wide. Height shall be determined by chart, below:

' NOTE:
When two or more pieces of equipment are installed side by side — less than 36 inches
apart — they shall be considered as one piece of equipment and the height of the
