HomeMy WebLinkAboutORD 247ORDINANCE 247 AN ORDINANCE OF THE CITY OF PALM DESERT, CALIFORNIA, ESTABLISHING AND DESIGNATING CHAPTER 17 OF THE PALM DESERT MUNICIPAL CODE AS THE "PALM DESERT PLUMBING CODE" WITH CERTAIN ADDITIONS, DELETIONS, AND AMENDMENTS, THE RULES, REGULATIONS, PROVISIONS, AND CONDITIONS SET FORTH IN THAT CERTAIN CODE ENTITLED, "UNIFORM PLUMBING CODE, 1979 EDITION", INCLUDING THE APPENDICES THEREIN CONTAINED, PROMULGATED AND PUBLISHED BY THE INTERNATIONAL ASSOCIATION OF PLUMBING AND MECHANICAL OFFICIALS. The City Council of the City of Palm Desert, California, DOES HEREBY ORDAIN as follows: SECTION 1. AMENDMENT. That Chapter 17 of the Palm Desert Municipal Code be and the same is hereby established to read as follows: i E UJ UJ �- z Cr cS 0 W F- } Q m 0 "CHAPTER 17. PLUMBING CODE. Section 17.01.010 - Adoption of Uniform Plumbing Code. Subject to the particular additions and amendments hereinafter set forth in this Ordinance, the rules, regulations, provisions and conditions set forth in that certain Code entitled, 'Uniform Plumbing Code, 1979 Edition', including the Appendices and Installation Standards therein contained, promulgated and published by the International Association of Plumbing and Mechanical Officials, three full printed copies of which, printed as a Code in book form, were by the City Council ordered filed and which have been actually filed in the office of the City Clerk, and which as so on file are hereby referred to and by this reference expressly incorporated herein and made a part hereof as fully and for all intents and purposes as though set forth herein at length, shall be and the same are hereby established and adopted as the rules, regulations, provisions and conditions to be observed and followed in the construction, erection, installation, alterations, repair, changing, removal, demolitions, condemnation, maintenance and use of plumbing, water distribution system, house drainage, house sewers, sanitary sewers, cesspools, septic tanks, gas piping, gas water heaters, gas and water vents, swimming pool piping and related subjects, items and matters, within said City, and for all matters and subjects referred to and covered by said Code; and subject to said additions and amendments hereinafter set forth, said Code with its said Appendices containing said rules, regulations, provisions and conditions is hereby established and adopted; and the same shall be Ordinance 247 Page 2 designated, known and referred to as the 'Plumbing Code' of and for the said City of Palm Desert, California. That the City Council does hereby find that the following provisions, additions and amendments thereto are necessary for the proper administration of this Code by the Building and Safety Department of the City of Palm Desert. SECTION 2. DELETIONS. That those sections and provisions of the Palm Desert Municipal Code, Ordinance 181, not formerly contained in the Uniform Plumbing Code are hereby deleted having been expressly incorporated into --, and made a part of the existing current model Code by the process of adoption by reference of the 1979 Uniform Plumbing Code. Section 17.01.040 - Deleted, Section 17.01.050 - Deleted. Section 17.01.060 - Deleted. Section 17.01.080 - Deleted. Section 17.01.090 - Deleted. Section 17.01.110 - Deleted. Section 17.01.120 - Deleted. Section 17.01.130 - Deleted. SECTION 3. ADDITIONS and AMENDMENTS. That the following section numbers are hereby redesignated in sequence as additions and amendments to Chapter 17 of the Palm Desert Municipal Code as follows: Section 17.01.020 - Plumbing Code: Addition: Sec. 1.0. Sec. 1.0. Provisions. This Code provides the minimum standards for the protection of the public health and safety; the qualifications of persons engaged in the trade of plumbing; requiring 4 permit and inspection for the installations, altera- tion or repair of plumbing and drainage systems and the inspection thereof; providing penalties for violations of said Code and repealing conflicting ordinanc ,, If afly - �:01 section, subsection, sentence, clause, phrase lir portion of this Code is for any reason held to be invalid or unconstitu- tional by the decision of any court or competent jurisdiction, such decision shall not effect the validity o the remaining portions of this Code. a �l Ordinance 247 AN Page 3 ' Section 17.01.030 - Plumbing Code: Addition: Sec. 1.3. Sec. 1.3 is hereby added to said Plumbing Code to read as follows: Sec. 1.3. Valid Plumber's License and Business License. a. It shall be unlawful for any person, firm, or partnership or corporation to carry on or engage in the business of contract plumbing unless such person has had issued to him a valid State Contractor's Plumbing License. Before any person, firm, partnership, or corporation shall carry on, or engage in the business of plumbing, he or it shall first procure a business license from the City and pay to the department having jurisdiction the'annual license fee imposed on such business. b. No business license shall be issued to any person unless such person possesses a valid and current C-36 State Con- tractor's License of the State of California, issued to him pursuant to and in accordance with the laws of the State of California; provided, however, that a business license may be issued to any person, firm, partnership or corporation who makes application for such license by or through a bona fide member or authorized agent thereof, who possesses such valid C-36 State Contractor's License of the State of California. c. Whenever a business license has been issued to any person, firm, partnership or corporation who applies for such license by or through a bona fide member or authorized agent -or employee possessing such valid C-36 State Contractor's License of the State of California, said licensee shall at all times be in actual.charge and control of all plumbing done or to be done by such person, firm, partnership or corporation. Section 17.01.040 - Plumbing Code: Addition: Sec. 1.6. Sec. 1.6 is hereby added to said Plumbing Code to read as follows: Ordinance 247 Page 4 Sec. 1.6. Cost of Permit and Schedule of Fees. Each applicant shall pay for each permit issued at the time of issuance a fee in accordance with the applicable schedule and at the rate provided by resolution of the City Council. Section 17.01.050 - Plumbing Code: Addition: Sec. 1.9. Seca 1.9 is hereby added to said Plumbing Code to read as follows: Sec. 1.9. Hot and cold water shall be provided in all dwelling units, commercial store and office facilities, as well as industrial facilities. Sec. 1.12. All dwelling units shall be provided with an approved garbage disposal connected to the waste and drain system of said dwelling. Exception: Garbage disposal(s), gas systems for cooking facilities, and kitchen sink installations are hereby prohibited in guest houses. Section 17.01.060 - Plumbing Code: Amendments: Sec. 306. Sec. 306 of said Plumbing Code is hereby amended to read as follows: Sec. 306. Plans Required. The Administrative Authority may require the submission of plans, specifications, drawings, schematics and/or other information as he may deem necessary prior to commencement of, and at any time during the progress of any work regulated by.this Code. The issuance of a permit upon plans and specifications shall not prevent the Adminis- trative Authority from thereafter requiring the correction of errors in said plans and specifications or from preventing construction operations being carried on thereunder when in violation of this Code or of any other per ent of-dinance. or from revoking any certificate of approvil" when issued in error. Any plumbing system which requires,180 fixture units for DWV shall be presented for plan check as a complete engineered plumbing system. R-1 Occupancy as specif,ie& in the Uniform ' 11. Ordinance 247 Page 5 Building Code latest edition, 3-units or over, shall be provided with a schematic diagram for the plumbing system to be presented to the Administrative Authority or his Assistant, no later than the first called inspection under permit. When a plan is required and the Administrative Authority so requests, a plan checking fee shall be paid to the Building Department at the time of submitting plans and specifications for checking. Said plan checking fee shall be equal to one-half of the plumbing fee, as set forth in current fee resolutions approved by the City Council. Section 17.01.070 - Plumbing Code: Amendment: Sec. 1008 b . Section 1008(b) of said Plumbing Code is hereby amended to read as follows: Sec. 1008(b). Installation. Water service pipes or any underground water pipes shall be installed 12 inches below grade and shall not be run or laid in the same trench with non-metallic building sewer or drainage piping, except as provided in this section. The water service pipe may be placed in the same trench with such building drain and building sewer provided both of the following conditions are met: (1) The bottom of the water service pipe, at all points, shall be at least 12 inches above the top of the sewer line. (2) The water service pipe shall be placed on a solid shelf excavated at one side of the common trench. SECTION 4. VIOLATIONS. Whenever brought to the attention of the Administrative Authority that any unsanitary conditions exist or that any construction work.regulated by this Code is dangerous, unsafe, unsanitary, a nuisance or menace to life, health or property or otherwise in violation of this Code, and after such investigation as described by this authority that such information is a fact, any person, firm or corporation using or maintaining any such condition or responsible for the use or maintenance thereof, shall be ordered to repair, alter, change, remove or demolish same Ordinance 247 Page 6 as he may consider necessary for the proper protection of life, health or property and in the case of any gas appliance or gas system, may order any person, firm or corporation supplying gas to such piping or appliance to discontinue supplying service thereto until such piping or appliance is made safe to life, health, or property. Every such order shall be in writing, addressed to the owner, agent and/or person responsible for the premises in which such condition exists and shall specify the date or time for compliance with such order. Refusal, failure or neglect to comply with any such notice or order shall be considered a violation of this Code and the owner, agent and/or persons responsible for the premises shall be deemed guilty of a misdemeanor. When any plumbing system is maintained in violation of this Code and in violation of any notice issued pursuant to the provisions of this section or where a nuisance exists in any building or on a lot on which a building is situated, the Administrative Authority shall institute any appropriate action or proceeding in any court of competent jurisdiction to prevent, restrain, correct, or abate the violation of nuisance. Any person, firm or corporation violating any of the provisions, regu- lations, requirements, additions and/or amendments of this Code shall be deemed guilty of a misdemeanor and the penalty for such a misdemeanor shall be as set forth in Ordinance No. 231 of the Palm Desert Municipal Code. SECTION 5. PRESERVATION OF HEALTH, WELFARE AND SAFETY. That this City Council does hereby find that the adoption of this Code with the addi- tions, amendments and changes thereto, are necessary for the preservation of health, welfare and safety, and is in accordance with Section 17958.7 of the Health & Safety Code of the State of California, and that a copy of this Ordinance shall be forwarded by the City Clerk to the Director of Housing and Community Development of the State of California. SECTION 6. REPEAL OF ORDINANCES. That Ordinance No. 181 and all amendments thereto, and all ordinances or parts of ordinances in conflict with this Ordinance are hereby repealed. SECTION 7. CITY CLERK'S CERTIFICATION. The City Clerk of the City of Palm Desert, California, is hereby directed to, cause this Ordinance to be published once within fifteen (15) days of adopt' n;win the Palm `Ordinance 247 Page 7 Desert Post, a new paper published and circulated within the City of Palm Desert Ca1if rni a, and the same shall be in full force and effect thirty (30 ) days after adoption.
