HomeMy WebLinkAboutORD 254ORDINANCE NO. 254 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF PALM DESERT, CALIFORNIA, ADDING TO SECTION 5.04.160 OF THE CODE OF THE CITY OF PALM DESERT, PERTAINING TO REVOCATION OF LICENSE CERTIFICATES. The City Council of the City of Palm Desert, California, DOES HEREBY ORDAIN as follows: Section 1: That Section 5.04.160 of the Code of the City of Palm Desert, California, be and the same is hereby amended to read as follows: "5.04.160. Error in Terms Voids License - Revocation or Suspension o License The payment of any license fee required by this title, its acceptance by the City, and the issuance of such license to any person shall not entitle the holder thereof to carry on any business called for by the license, unless he has complied with all requirements of this title, or to carry on any business at any location contrary to the City's building and zoning regulations. The City Council may revoke or suspend the business license tax certificate of any person or firm holding the same in the City, upon receiving satisfactory evidence that the licensee thereof has violated any provision of other laws relating to such business of the City, County, State:` and Federal government, or is conducting a business other than that for which he has been licensed. Whenever a license has been revoked under this chapter, no other application for a license shall be considered for a period of one year from the date of revocation unless permission for shorter period is granted by City Council. No license shall be revoked or suspended until a hearing thereon shall have been had by the City Council, notice of which hearing shall have been given in writing and served at least ten days prior to the date of such hearing upon the licensee or licensee's manager or agent. The notice shall state the grounds of the complaint against the holder and time and place of the hearing. i ORDINANCE NO. 254 Page two Section 2: The City Clerk shall certify to the passage and adoption of this ordinance and shall cause the same to be published once in the Palm Desert Post, a newspaper of general circulation, printed, published and circulated within the City of Palm Desert, and the same shall be in force and effect thirty,(30) days after its adoption.
