HomeMy WebLinkAboutORD 306Ll E ORDINANCE NO. 306 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF PALM DESERT, CALIFORNIA, AMENDING SECTION 5.04.260 OF THE CODE OF THE CITY OF PALM DESERT, CALIFORNIA, RELATING TO REFUNDS. The City Council of the City of Palm Desert, California, DOES HEREBY ORDAIN as follows: SECTION 1: That Section 5.04.260 of the Code of the City of Palm Desert, California, is hereby amended to read as follows: "5.04.260 Refunds. A. The tax administrator, with the approval of the city manager, may refund any license fee or penalty which he determines was erroneously collected, but no license fee shall be refunded if, prior to his application for a license, the applicant has engaged in the business for which the license is sought. B. Any person who has not used a license tax certificate that such person obtained from the city may, at any time within 30 days after the issuance of such certificate, request a refund of the amount of money paid for the business license tax fee. The tax administrator, upon receiving an affidavit of nonuser of the certificate, shall refund the amount of money paid for the certificate, less 25% of said amount, to be retained by the city for administrative costs. C. Any person who has obtained a license tax certificate may submit an affidavit of going out of business to the city council. The city council, upon receiving the affidavit, and for good and satisfactory cause shown, may order a prorated refund of the money paid for a license tax certificate obtained from the city, to any person who.has ceased business. Proration will be based upon the unused annual license term less 25% of refund, to be retained by the city for administrative costs. The affidavit shall, initially, be submitted to the tax administrator." SECTION 2: The City Clerk shall certify to the passage and adoption of this ordinance and shall cause the same to be published once in the Palm Desert Post, a newspaper -1- of general circulation printed, published and circulated in the City of Palm Desert and-t"he same shall be in full force and effect thirty (30) days after its adoption.
