AN ORDINANCE OF THE CITY COUNCIL OF THE CITY
OF PALM DESERT, CALIFORNIA, ESTABLISHING
CHAPTER 26.34 OF THE SUBDIVISION ORDINANCE
RELATING TO PARCEL MAP WAIVERS, A CLASS 5
CEQA CATEGORICAL EXEMPTION.
WHEREAS, the City Council of the City of Palm Desert, California, did on the
27th day of January, 1983, review the proposed amendment as shown in the attached
Exhibit A;
WHEREAS, said amendment is designed to bring the Subdivision Ordinance into
conformance with state law;
WHEREAS, the director of environmental services has determined that the
amendment is a Class 5 CEQA categorical exemption; and,
WHEREAS, said revision would be -In the furtherance of the public health, safety
and welfare.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Palm
Desert, California, as follows:
1. That the above recitations are true and correct and constitute the
considerations of the Council in this case.
2. That it does hereby approve a Subdivision Ordinance Text Amendment, as
provided in the attached Exhibit, labeled Exhibit "A" to amend Municipal
Code.
3. The City Clerk is directed to publish this Ordinance once in the Palm Desert
Post, a newspaper of general circulation, published and circulated in the
City of Palm Desert, and certify to the passage of adoption of this
Ordinance, and the same shall be in full force and effect thirty (30) days
after its adoption.
PASSED, APPROVED and ADOPTED at a regular meeting of the Palm Desert City
Council, held on the loth day of February, 1983, by the following vote, to wit:

Section 26.17.010 Purpose. The purpose of this chapter is to provide procedures
for the waiver of the requirement to prepare a parcel map (Chapter 26.32) in cases where
the planning commission determines that the minor property line adjustment -complies
with the state map act and local ordinances. This waiver may apply to lot line adjustment
consolidation of 4 parcels or less as determined by the director of public works. .
Section 26.17.020 Application requirements. An application for parcel map waiver
shall befiled with the department of environmental services and shall include such data
and information as may be perscribed by the director of environmental services and
director of public works.
Section 26.17.030 Planning commission action. The planning commission shall
consider the application for a waiver of a parcel map requirement within forty-five days
after the filing of the application. The planning commission shall grant a waiver, provided
that it finds that the proposed adjustment and the resulting parcels comply with
applicable requirements as to area, improvement and design, floodwater drainage control,
appropriate improved public roads, sanitary disposal facilities, water supply availability,
environmental protection, and other requirements of this title.
If a waiver is granted, a certificate of compliance shall be filed with the c^unty 1'XYA
recorder, which certificate shall describe the real properties involved, name the owners h
thereof, and state that a waiver for a lot line adjustment has been granted by action of
the planning commission, giving the date thereof.
