AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF PALM DESERT,
CALIFORNIA, ESTABLISHING A 90 DAY MORATORIUM — GRADING PERMITS
WHEREAS, an emergency exists which requires the City to act to preserve the
public peace, health, and safety pursuant to Government Code Section 36937(b) in that:
a) Under the present ordinance,
which potentially constitutes an immediate
event of flood conditions; and
houses are being built up to 6' above grade
threat to the surrounding properties in the
WHEREAS, the City Council of the City of Palm Desert is investigating an
alternative method of draining run-off waters from properties; and
WHEREAS, the present time is typically the storm season in the Coachella Valley
and in the past, storms have caused tremendous hardship and damage to properties due to
heavy run-off waters.
NOW, THEREFORE, the City Council of the City of Palm Desert, pursuant to
Section 36937(b) of the Goverment Code, does hereby ORDAIN as follows:
SECTION 1. That a 90-day moratorium is hereby established this 22 day of
December, 1983, with respect to the issuance of grading permits for property south of
Highway I I I within the City limits where such property has a greater than 2% grade.
SECTION 2. That this ordinance shall become effective immediately upon adoption
by a 4/5 vote of the City Council pursuant to Section 36934 of the Government Code.
SECTION 3. That the City Clerk shall certify to the passage and adoption of this
ordinance and shall cause the same to be published once in the Desert Post, a newspaper
within the City of Palm Desert.
PASSED, APPROVED, and ADOPTED by the City Council of the City of Palm
Desert, California, on this 22nd day of December, 1983, by the following vote, to wit:
AYES: Jackson, Kelly, Puluqi, Wilson & Snyder
