HomeMy WebLinkAboutORD 362r, ORDINANCE NO. 362 AN URGENCY ORDINANCE OF THE CITY COUNCIL OF THE CITY OF PALM DESERT, CALIFORNIA, AMENDING URGENCY ORDINANCE NO. 356 BY ESTABLISHING EXCLUSIONS WHEREAS, Urgency Ordinance No. 356 was adopted to establish a moratorium on the issuance of grading permits for property south of Highway II I within the City limits where such property has a greater than 2% grade; and WHEREAS, certain properties in this area requiring no more than a 2 foot fill have proven to be no threat to life and property. NOW, THEREFORE, the City Council of the City of Palm Desert, California, does hereby ORDAIN as follows: SECTION 1. Certain properties shall be excluded from the provisions of the ninety -day moratorium (Ordinance No. 356), and grading permits may be issued for these properties when the grading of the property, per the approved grading plan, will require no more than two feet of fill at adjacent property lines. SECTION 2. This emergency ordinance is passed as an urgency measure in the interest of public health, safety, and welfare in that no danger exists in the circumstances stated in Section 1 above. SECTION 3. That this ordinance shall become effective immediately upon adoption by a 4/5 vote of the City Council pursuant to Section 36934 of the Government Code. SECTION 4. That the City Clerk shall certify to the passage and adoption of the ordinance and shall cause the same to be published once in the Desert Post, a newspaper within the City of Palm Desert. PASSED, APPROVED, and ADOPTED by the City Council of the City of Palm Desert, California, on this 26th day of January, 1984, by the following vote, to wit: AYES: Jackson, Kelly, Puluqi, Wilson & Snyder NOES: None ABSENT: None ABSTAIN: None ATTEST: SHEILA R.
