ORDINANCE NO. 399
AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF PALM
DESERT, CALIFORNIA, AMENDING SECTIONS 5.80.020, 5.80.
030, 5.80.090, 5.80.230, 5.80.240, AND ADDING NEW
INFORMATION ITEMS 15 AND 17 TO SECTIONS 5.80.030(A)
AND 5.80.230(A): PERTAINING TO CHARITABLE, RELIGIOUS
AND NONPROFIT SOLICITING.
The City Council of the City of Palm Desert, California, DOES
HEREBY ORDAIN as follows:
SECTION 1: That Section 5.80.020 of the Code is hereby amended
to read as follows:
-5.80.020 CHARITABLE AND NONPROFIT PERMIT - EXEMPTIONS.
No person as defined in Section 5.80.010 shall solicit contributions
for any charitable purpose within the City without first obtaining a permit as
required by this chapter; provided, however, that upon application and
determination by the Code Enforcement Supervisor that such organizations
fall into the categories set forth in this section, the permit requirements
shall not apply to:
A. Bonafide charitable, religious and nonprofit organizations
which have been in existance and have regularly maintained a place of worship
or headquarters in the Coachella Valley, County of Riverside for a period of
at least one (1) year;
B. Solicitation activities conducted on premises owned or
occupied by, or among the members of, a charitable, religious or nonprofit
organization;
C. Activities relating to the relief of a person, specified by
name at the time of the solicitation, where the solicitor represents in each
case that the entire amount collected, without any deduction for expenses
incurred during the activity, shall be turned over to the named beneficiary.
SECTION 2: That Sections 5.80.030(A) and 5.80.230(A) information
item numbers 2, 5 and 6 of the code are hereby amended to read as follows:
A. 2. If the applicant is not an individual, the names, home
addresses and telephone numbers of the applicants principal officers and
managers and a copy of the resolution, if any, authorizing such solicitations,
certified to be a true and correct copy of the original by the officer having
charge of the applicants records:

5. The names, home addresses and telephone numbers of the
person or persons by whom the receipt of such soliciation shall be disbursed;
6. The names, home addresses and telephone numbers, social
security numbers and driver's license numbers, if any, of the person or
persons who will be in direct charge of conducting the solicitation and all
promoters and paid fund raisers or professional solicitors connected or to
be connected with the proposed solicitation.
SECTION 3: That Section 5.80.090, second paragraph, is here-
by amended to read as follows:
The right to solicit may be for any number of consecutive or
nonconsecutive days not to exceed one (1) year from date of issuance of
the permit. If the permittee desires to renew the permit, the application
for renewal must be completed thirty (30) days prior to the expiration of
the permit in force. The Code Supervisor may renew the permit if he is
satisified that the requirements of this chapter are still being met and
there has been no violation of the Chapter, and all information contained on
the original application is basically the same.

SECTION 4: That Section 5.80.240(A), is hereby amended to read
(A) Upon receipt of such application, the code supervisor shall
forthwith issue the applicant a certificate of registration. The certificate
shall remain in force and effect for a period of one (1) year from date of
issuance of the certificate of registration. The certificate shall bear the
name and address of the person by whom the solication is to be made, the
number of the certificate, date issued, and a statement that the certificate
does not consitute an endorsement by the City or by any department or officer
or employee of the City for.the person conducting the solication.
SECTION 5: That information item number 17 is added to Section
5.80.030(A) of the code to read as follows:
17. The names, home addresses, telephone numbers, social
security number and drivers license number, if any, of all the solicitors
connected with or to be connected with the proposed solicitation.
SECTION 6: That information item number 15 is added to Section
5.80.230(A) of the code to read as follows:

15. The names, home addresses, telephone numbers, social
security numbers and drivers license number, if any, of all the solicitors
connected with the proposed solicitation.
SECTION 7: The City Clerk shall certify to the passage and
adoption of this ordinance and shall cause the same to be published once in
the Palm Desert Post, a newspaper of general circulation printed, published
and circulated in the City of Palm Desert and the same shall be in full force
and effect thirty (30) days after its adoption.
