HomeMy WebLinkAboutORD 392/V DATED: ftN E INANCE OF THE CITY COUNCIL OF THE CITY DESERT, CALIFORNIA, CREATING A PARKING AND BUSINESS IMPROVEMENT AREA PURSUANT TO THE PARKING AND BUSINESS IMPROVEMENT AREA LAW OF 1979. ORDINANCE NO. 392 WHEREAS, the City Council fo the City of Palm Desert, California, has heretofore declared its intention by Resolution No. 84-107, adopted July 26, 1984, to create a parking and business improvement area; and WHEREAS, the City Council did establish the date of August 23, 1984, at the hour of 7:00 p.m. at the Council Chamber in the City of Palm Desert, as the time and place where interested parties might appear and protest formation of said area, and said hearing was duly and properly noticed and held. NOW, THEREFORE, the City Council of the City of Palm Desert, California, does hereby ordain as follows: SECTION 1: That the City Council does hereby order the formation of a Parking and Business Improvement area pursuant to Chapter 4, Part 6, Section 36500 et. seq. of the California Streets and Highways Code, within the City of Palm Desert, which boundaries shall generally be described as: All business establishments occupying premises on El Paseo including all establishments using an E1 Paseo address located East of State Highway 74 and West of Portola Avenue. SECTION 2: That the businesses in the area established by this ordinance shall be subject to any amendments to this part. SECTION 3: That the proposed charges as specified in Table I below shall be levied on each business in the area except the business license classification of real estate associates and professionals (doctors, lawyers, dentists, chiropractors, architects, CPA's, Physical Therapists, Engineers, and General Professional) which shall be excluded from any charges. The proposed charges shall be based upon annual gross receipts except for building contractors and banking institutions which shall pay a flat fee of $100 (One Hundred dollars) per year. The proposed charges shall be collected in the sarne manner as business license fees and shall be payable at the same time. Charges to businesses not licensed by the City shall be due and payable January 1st of each year. SECTION 5: That the proceeds from all charges established by this ordinance shall be used for the general promotion of business activities in the area. SECTION 6: That the Council hereby finds that all the business lying within the Business Improvement Area will be benefited by the expenditures of the funds raised by the assessments or charges proposed to be levied. ORDINANCE NO. 392 SECTION 7: That there is hereby established an E1 Paseo Business Improvement Area Advisory Board which shall consist of seven members appointed by the City Council members of which shall be appointed to three year terms. Provided, however, that initially two members shall be appointed to a one year term, two members to a two year term and three members to a three year term. All shall begin July 1st of each year. Appointments to the board shall be limited to area members. In making appointments to such advisory board, the Council shall first seek recommendations from area members. The duties and responsibilities of the Advisory Board shall consist of creating a yearly area business promotion program and updating and changing such program as necessary; recommending a yearly budget of expenditures and yearly area charges. SECTION 8: That the City Council may, pursuant to this ordinance, change the categories of businesses charged or amount of charges provided it first holds a public hearing to consider protests.
