HomeMy WebLinkAboutORD 399ORDINANCE NO. 399 A ORDINANCE OF THE CITY OF PALM DESERT AMENDING ORDINANCE NO. 107, THE PALM DESERT ZONING MAP BY CHANGING A ZONE FROM R-2 (7) S.P. AND R-2 (7) TO OFFICE PROFESSIONAL FOR FIVE LOTS LOCATED AT THE SOUTHEAST CORNER OF FRED WARING DRIVE AND MONTEREY AVENUE. CASE NO. C/Z 84-13 WHEREAS, the City Council of the City of Palm Desert, California, did on the 29th day of November, 1984, hold a duly noticed public hearing to consider a request by MONTEREY PARTNERSHIP for approval of a change of zone from R-2 (7) S.P. and R-2 (7) to office professional and a negative declar- ation of environmental impact for 5 lots located at the southeast corner of Fred Waring Drive and Monterey Avenue. WHEREAS, said application has complied with the requirements of the "City of Palm Desert Procedures to Implement the California Environmental Quality Act", the project will not have a significant impact on the environment and a negative declaration has been prepared. WHEREAS, at said public hearing, upon hearing and considering all test- imony and arguments of all interested persons desiring to be heard, said comm- ission did find the following facts to exist to justify their actions: 1. Due to increasing severe traffic impacts in the area, development of the property under the current residential designation would be contrary to the health and general welfare of the citizens of Palm Desert. 2. The proposed office professional use is consistent with goals and objectives of the Palm Desert General Plan Zoning Ordinance and COD Specific Plan. The City Council of the City of Palm Desert, California, DOES HEREBY ORDAIN, as follows: SECTION 1: That a portion of Ordinance No. 107 referencing Section 25.46.1 of the zoning ordinance, the zoning map (Chapter 35.46 of the Palm Desert Municipal Code) is hereby amended to read as shown on the attached exhibit "A" and that negative declaration of environmental impact as it pertains thereto is approved. SECTION 2: The City Clerk of the City of Palm Desert, California, is hereby directed to publish this ordinance in the Desert Post, a newspaper of general circulation, published and circulated in the City of Palm Desert, California and shall be in full force and effect thirty (30) days after its adoption. PASSED, APPROVED and ADOPTED at a regular meeting of the Palm Desert City Council, held on this 29th day of November, 1984, by the following vote, to wit: AYES: BENSON, JACKSON, KELLY, WILSON & SNYDER NOES: NONE ABSENT: NONE ABSTAIN: NONE WA TER H.
