AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF
PALM DESERT, CALIFORNIA, ADOPTING BY REFERENCE
WITH CERTAIN ADDITIONS, DELETIONS, AND AMEND-
MENTS, THE RULES, REGULATIONS, PROVISIONS AND
CONDITIONS SET FORTH IN THOSE CERTAIN CODES
ENTITLED, "UNIFORM BUILDING CODE, 1982 EDITION."
"UNIFORM BUILDING CODE STANDARDS, 1982 EDITION,"
INCLUDING ALL APPENDICE CHAPTERS, WITH THE
EXCEPTION OF APPENDICE CHAPTER 1;12;53;70,
THEREIN CONTAINED AS PROMULGATED AND PUBLISHED
BY THE INTERNATIONAL CONFERENCE OF BUILDING
OFFICIALS.
The City Council of the City of Palm Desert, California, DOES
HEREBY ORDAIN as follows:
SECTION 1. AMENDMENT. That Section 15.04.010 of the Code of
the City of Palm Desert, California, be and the same is hereby amended
to read as follows:
"Section 15.04.010 - Adoption of Uniform Building Code.
That the rules, regulations, provisions and conditions set
forth in those certain codes entitled 'Uniform Building Code, 1983
Edition,' and the 'Uniform Building Code Standards, 1982 Edition,'
including all Appendice Chapters with the exception of Appendice Chapter
1;12;53;70, subject to the particular additions, amendments and deletions
as contained herein, promulgated and published by the International
Conference of Building Officials, three (3) full printed copies of which,
printed as a Code in book form, together with additions, amendments and
deletions, were by the City Council ordered filed, and have actually
been filed in the office of the City Clerk, and as so on file are hereby
established and adopted as the rules, regulations, provisions and
conditions to be observed and followed for the erection, construction,
enlargement, alterations, repair, moving, removal, conversion, demolition,
occupancy, equipment, use, area and maintenance of buildings, structures,
and/or improvements, is hereby established and adopted, and the same shall
be designated, known and referred to as the Municipal Building Code for
the City of Palm Desert, California."
SECTION 2. ADDITION. That Section 15.04.140 be and the same is
hereby added to the Code of the City of Palm Desert, California, to read
as follows:
"Section 15.04.140 - Fence and/or Retaining Walls.
Division 3 of the Uniform Building Code relating to fences
and/or retaining walls less thatn six (6) feet and more than two (2) feet
in height and the footings, steel, post holes, materials, and general
construction requirements of the above definitions shall utilize Building
Department Standards on file for all minimum requirements or approved
equal. All fencing shall be designed to withstand all horizontal forces
as outlined in Chapter 23 of the Uniform Building Code, 1982 Edition."

SECTION 3. ADDITION. That Section 15.04.150 and Section 15.04.160
is hereby added to the Code of the City of Palm Desert, California, to read
as follows:
"Section 15.04.150 - Horizontal Blocking.
Section 2517 (g) 7 is amended by adding thereto the sentence as
follows:
'Stabilizing horizontal blocking shall be installed in three (3)
stud openings from all corners in two (2) stud openings from all window and
openings in all type V construction."
"Section 15.04.160 - Building Address Requirements.
Section 513 is amended to read as follows:
Approved numbers or addresses shall be provided on all new buildings
in such a position as to be plainly visible and legible from the street or
road fronting the property. Such numbers or addresses shall have a minimum
character height of five (5) inches for all residential buildings and a
minimum seven (7) inches in height for commercial buildings. Such numbers and
addresses shall be installed on a contrasting background."
SECTION 4. DELETION. That Section 301 (b) #2 thru #11 is hereby
deleted in its entirety.
SECTION 5. REPEAL OF ORDINANCES. That Ordinance No. 238 and all
amendments thereto, and all other ordinances, or parts of ordinances in
conflict therewith, be and the same are hereby repealed.
SECTION 6. EXPRESS FINDINGS. In accordance with the requirements
of Section 17922, 17958.5 and 17958.7 of the Health and Safety Code, the
City Council of Palm Desert, California makes the following findings:
A. That the use of asphalt floors as carport or garage
surface material is prohibited because the material
deteriorates and becomes unstable due to extreme
surface temperatures, common of lower desert areas.
Burn -out. rutting and cracking of surfaces creates
maintenance problems not common in other areas.
It is the express findings of this Council that
short-term installations with high maintenance and
replacements costc are not in the best Jnterest or
welfare of the general public. Therefore, Section
1105 is hereby amended to read as follows: In
areas where motor vehicles are stored or operated,
floor surfaces shall be of approved non-combustionable
materials. Asphaltic paving materials are not allowed
for use in these occupancies.
B. That all other modifications of the Uniform Building
Code are administrative and nonsubstantive.

SECTION 7. CERTIFICATION. The City Clerk of the City of Palm
Desert, California, is hereby directed to cause this Ordinance to be published
once within fifteen (15) days of adoption in the Palm Desert Post, a newspaper
published and circulated within the City of Palm Desert, California,
and the same shall be in full force and effect thirty (30) days after adoption.
PASSED APPROVED, and ADOPTED this loth day of January , 1985,
by the City Council of the City of Palm Desert, California, by the following
vote:
AYES: BENSON, JACKSON, KELLY AND WILSON
NOES: NONE
