AN ORDINANCE OF THE CITY OF PALM DESERT, CALIFORNIA, ESTABLISHING
AND DESIGNATING CHAPTER 17 OF THE PALM DESERT MUNICIPAL CODE AS THE
"PALM DESERT PLUMBING CODE" WITH CERTAIN ADDITIONS, DELETIONS, AND
AMENDMENTS, THE RULES, REGULATIONS, PROVISIONS, AND CONDITIONS SET
FORTH IN THAT CERTAIN CODE ENTITLED, "UNIFORM PLUMBING CODE, 1982
EDITION", INCLUDING THE APPENDICES THEREIN CONTAINED, PROMULGATED
AND PUBLISHED BY THE INTERNATIONAL ASSOCIATION OF PLUMBING AND
MECHANICAL OFFICIALS.
The City Council of the City of Palm Desert, California, DOES HEREBY
ORDAIN as follows:
SECTION 1. AMENDMENT. That Chapter 17 of the Palm Desert Municipal
Code be and the same is hereby established to read as follows:
"CHAPTER 17. Plumbing Code.
Section 17.01.010 - Adoption of Uniform Plumbing Code.
Subject to the particular additions and amendments hereinafter
set forth in this Ordinance, the rules, regulations, provisions and
conditions set forth in that certain Code entitled, "Uniform Plumbing
Code, 1982 Edition", including the Appendices and Installation Stan-
dards therein contained, promulgated and published by the International
Association of Plumbing and Mechanical Officials, three full printed
copies of which, printed as a Code in book form, were by the City
Council ordered filed and which have been actually filed in the office
of the City Clerk, and which as so on file are hereby referred to and
by this reference expressly incorporated herein and made a part hereof
as fully and for all intents and purposes as though set forth herein
at length, shall be and the same are hereby established and adopted
as the rules, regulations, provisions and conditions to be observed
and followed in the construction, erection, installation, alterations,
repair, changing, removal, demolitions, condemnation, maintenance and
use of plumbing, water distribution system, house drainage; house sewers,
sanitary sewers, cesspools, septic tanks, gas piping, gas water heaters,
gas and water vents, swimming pool piping and related subjects, items
and matters, within said City, and for all matters and subjects referred
to and covered by said Code, and subject to said additions and amendments
hereinafter set forth, said Code with its said Appendices containing
said rules, regulations, provisions and conditions is hereby established
and adopted; and the same shall be designated known and referred to as

the 'Plumbing Code' of and for the said City of Palm Desert, California.
That the City Council does hereby find that the following provisions, ad-
ditions and amendments thereto are necessary for the proper administration
of this Code by the Building and Safety Department of the City of Palm Desert.
SECTION 2. ADDITIONS AND AMENDMENTS. That the following section numbers are
hereby redesignated in sequence as additions and amendments to Chapter 17 of the
Palm Desert Municipal Code as follows:
Section 17.01.020 - Plumbing Code: Addition:
Sec. 1.0.
Sec. 1.0. Provisions. This Code provides the minimum standards for
the protection of the public health and safety; the qualifications of
persons engaged in the trade of plumbing; requiring a permit and inspection
for the installations, alteration or repair of plumbing and drainage systems
and the inspection thereof; providing penalties for violations of said Code
and repealing conflicting ordinances. If any section, subsection, sentence,
clause, phrase or portion of this Code is for any reason held to be invalid
or unconstitutional by the decision of any court or competent jurisdiction,
such decision shall not effect the validity of the remaining portions of
this code.
Section 17.01.030 - Plumbing Code: Addition:
Sec. 1.3.
Sec. 1.3 is hereby amended to said Plumbing Code to read as follows:
Sec. 1.3. Valid Plumber's License and Business License.
A. No permits for plumbing installation shall be issued to any
person, firm or corporation to cause to be done any plumbing
work regulated by this Code unless the person, firm or corp-
oration possesses a current and valid unexpired C-36 State
Contractor's License (plumbing contractor), as well as a
current Palm Desert Business License.
Exception: A permit may be issued to the owner of a resi-
dential single family dwelling in which the applicant re-
sides or intends to reside, provided, however, a qualifying
examination to determine the applicants' knowledge of plumb-
ing systems may be required if deemed necessary by the Build-
ing Official.
Exception: A permit may be issued to a licensed general
Contractor for plumbing work, as determined by the Building
Official providing:
A. The general contractor is applying for a concurrent
building permit at the same location and is supplying
two or more related trades; and
B. The general contractor has a current valid City Business
License and State Contractors B-2 License.
B. Each applicant shall pay for each permit issued at the time of
issuance a fee in accordance with the current schedule. -at the
rate provided for.

C. Any person who shall commence any work for which a permit is
required by this Code, without first having obtained a permit
or telephoned notice so to do shall pay double the permit fee
fixed by this Section for such work, provided, however, that
this provision shall not apply to emergency work when it shall
be proved to the satisfaction of the Administrative Authority
that such work was urgently necessary and that it was not prac-
tical to obtain a permit therefore before the commencement of
the work. In all such cases, a permit must be obtained as
soon as it is practical to do so, and if there be an unreason-
able delay in obtaining such permit, a double fee as herein
provided for shall be charged.
Whenever any work for which a permit is required, under the
provisions of this Code, has been commenced and/or completed
without the authorization of such permit, the Administrative
Authority may deem it necessary to require a special invest-
igation prior to issuance of a permit. Therefore, the appli-
cant shall pay an investigation fee as outlined in the 'Schedule
of Fees'. The payment of the investigation fee shall not exempt
any person from payment of the permit fee and from compliance
with the provisions of this Code nor from any other penalty pre-
scribed.
Section 17.01.040 - Plumbing Code: Addition:
Sec. 1.6.
Sec. 1.6. is hereby added to said Plumbing Code to read as follows:
Sec. 1.6 Cost of Permit and Schedule of Fees. Each applicant
shall pay for each permit issued at the time of issuance a fee in
accordance with the applicable schedule and at the rate provided by
resolution of the City Council.
Section 17.01.050 - Plumbing Code: Addition:
Sec. 1.9.
Sec. 1.9 is hereby added to said Plumbing Code to read as follows:
Sec. 1.9. Hot and cold water shall be provided in all dwelling
units, commercial store and office facilities, as well as indus-
trial facilities.
Section 17.01.060 - Plumbing Code: Amendments:
Sec. 306.
Sec. 306 of said Plumbing Code is hereby amended to read as follows:
Sec. 306. Plans Required. The Administrative Authority may require
the submission of plans, specifications, drawings, schematics and/or
other information as he may deem necessary prior to commencement of,
and at any time during the progress of any work regulated by this Code.
The issuance of a permit upon plans and specifications shall not prevent
the Administrative Authority from thereafter requiring the correction of
errors in said plans and specifications or from preventing construction
operations being carried on thereunder when in violation of this Code or
of any other pertinent ordinance or from revoking any certificate of ap-
proval when issued in error.

Any plumbing system which required 180 fixture units for
DMV shall be presented for plan check as a complete engineered
plumbing system. All occupancies as specified in the Uniform
Building Code latest edition, shall be provided with a schematic
diagram for the plumbing system and gas line system to be pre-
sented to the Administrative Authority or his Assistant for re-
view and approval no later than the first called inspection under
permit.
When a plan is required and the Administrative Authority so
requests, a plan checking fee shall be paid to the Building Depart-
ment at the time of submitting plans and specifications for checking.
Said plan checking fee shall be equal to one-half of the plumbing
fee, as set forth in current fee resolutions approved by the City
Council.
SECTION 4. VIOLATIONS. Whenever brought to the attention of the Administrative
Authority that any unsanitary conditions exist or that any construction work regulated
by this Code is dangerous, unsafe, unsanitary, a nuisance or menace to life, health
or property or otherwise in violation of this code, and after such investigation
as described by this authority that such information is a fact, any person, firm
or corporation using or maintaining any such condition or responsible for the use
or maintenance thereof, shall be ordered to repair, alter, change, remove or demolish
same as he may consider necessary for the proper protection of life, health of prop-
erty and in the case of any gas appliance or gas system, may order any person, firm
or corporation supplying gas to such piping or appliance to discontinue supplying
service thereto until such piping or appliance is made safe to life, health, or
property.
Every such order shall be in writing, addressed to the owner, agent and/or
person responsible fcr the premises in wbich such condition exists and shall specify
the date or time for compliance with such crder.
Refusal, failure or neglect to comply with any such notice or order shall be
considered a violation of this Code and the owner, agent and/or persons responsible
for the premises shall be deemed guilty of a misdemeanor.
When any plumbing system is maintained in violation of this Code and in viola-
tion of any notice issued pursuant to the provisions of this section or where a nui-
sance exists in any building or on a lot on which a building is situated, the Admin-

istrative Authority shall institute any appropriate action or proceeding in any
court of competent jurisdiction to prevent, restrain, correct, or abate the
violation of nuisance.
Any person, firm or corporation violating any of the provisions, regula-
tions, requirements, additions and/or amendments of this Code shall be deemed
guilty of a misdemeanor and the penalty for such a misdemeanor shall be as set
forth in Ordinance No. 231 of the Palm Desert Municipal Code.
SECTION 5. PRESERVATION OF HEALTH, WELFARE AND SAFETY. That this City
Council does hereby find that the adoption of this Code with the additions,
amendments and changes thereto, are necessary for the preservation of health,
welfare and safety, and is in accordance with Section 17958.7 of the Health
& Safety Code of the State of California, and that a copy of this Ordinance
shall be forwarded by the City Clerk to the Director of Housing and Community
Development of the State of California.
SECTION 6. REPEAL OF ORDINANCES. That Ordinance No. 247 and all amend-
ments thereto, and all ordinances or parts of ordinances in conflict with this
Ordinance are hereby repealed.
SECTION 7. CITY CLERK'S CERTIFICATION. The City Clerk of the City of Palm
Desert, California, is hereby directed to cause this Ordinance to be published
once within fifteen (15) days of adoption in the Palm Desert Post, a newspaper
published and circulated within the City of Palm Desert, California, and the
same shall be in full force and effect thirty (30) days after adoption.
