HomeMy WebLinkAboutORD 418ORDINANCE NO. 418 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF PALM DESERT, CALIFORNIA, AMENDING CHAPTER 3.28, SECTION 3.28.040 PERTAINING TO EXEMPTIONS RELATING TO THE TRANSIENT OCCUPANCY TAX. The City Council of the City of Palm Desert, California, DOES HERERBY ORDAIN as follows: SECTION 1: That Section 3.28.040 be amended to read as follows: SECTION 3.28.040 EXEMPTIONS. A. No tax shall be imposed upon: 1. Any person as to whom or any occunancv ;is to which it is beyond the power of the City to impose the tax provided in this chapter; 2. Any federal or state officer or employee when on official business; 3. Any officer or employee of a foreign government who is exempt by reason of express provision of federal law or international treaty. B. None of the above stated exemptions will be granted except upon a claim therefore made at the time rent is collected and under penalty of purjury upon a form prescribed by the tax administrator. C. Persons renting single family dwellings, condominiums, apartments, or similar units on a monthly term, regardless of the number of days contained in the month, shall be exempted from the provisions of this chapter. SECTION 2: The City Clerk shall certify to the passage and adoption of this ordinance and shall cause the same to be published once in the Palm Desert Post, a newspaper of general circulation printed, published and circulated in the City of Palm Desert and the same be in full force and effect thirty (30) days after its adoption.
