AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF PALM DESERT,
CALIFORNIA, AMENDING SECTION 26.36.010 OF THE MUNICIPAL CODE
RELATIVE TO FEES FOR SUBDIVISION PROCESSING.
WHEREAS, it is the intention of the City Council to require such fees
as necessary to cover expense to the city involved in the processing of subdivi-
sions; and
WHEREAS, the City Council desires to specifically encompass the review
and inspection of on -site improvements located on privately -owned property
within the subdivision fee schedule; and
WHEREAS, the existing language of Section 26.36.010 of the Municipal
Code does not specifically address fees for the review and inspection of on -site
improvements located on property other than public rights -of -way.
NOW, THEREFORE, the City Council of the City of Palm Desert finds that
all of the recitations are true and correct and does constitute the findings and
consideration of the City Council in this case.
FURTHER:
(1) Section 26.36.010 of the Code of the City of Palm Desert, Califor-
nia, is hereby amended to read as follows:
"26.36.010 Fees generally. Fees shall be required as specified in
this chapter.
The fees are intended to cover expense to the city involved in process-
ing a subdivision from checking the tentative map through acceptance of the
public improvements, including inspection services. Soils and materials testing
are specifically excluded from services encompassed within the subdivision fee
schedule.
On -site improvements within private property or public rights -of -way,
as well as off -site improvements within the public rights -of -way immediately
adjacent to the subdivision boundary shall be considered as included within the
fee schedule. However, review of plans and inspections required of extensive
off -site improvements shall be paid as a separate and additional fee. Such fee
shall be in accordance with the schedule set forth in the appropriate council
resolution."
(2) The City Clerk is hereby directed to publish this ordinance in
the Desert Post, a newspaper of general circulation, published
and circulated in the city of Palm Desert, California, and shall
be in full force and effect thirty (30) days after its adoption.
PASSED, APPROVED, and ADOPTED on this 24th day of October IF 1985,
by the City Council of the City of Palm Desert, California, by the following
vote, to wit:
