HomeMy WebLinkAboutORD 468ORDINANCE NO. 468 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF PALM DESERT, CALIFORNIA APPROVING A ZONING ORDINANCE AMENDMENT AMENDING SECTION 25.56.302 TO CHAPTER 25 OF THE PALM DESERT MUNICIPAL CODE. CASE NO: ZOA 86-4 WHEREAS, the City Council of the City of Palm Desert, California, did on the 14th day of August, 1986 hold a duly noticed public hearing to consider zoning ordinance amendment 86-4. WHEREAS, said amendment would define the term "convenience store" and requires a conditional use permit in all commercial zones for said use. WHEREAS, after reviewing the staff report and accepting all public testimony from those wishing to speak, said council made the following findings. 1. There was a necessary need for the provisions setforth in the proposed amendment. 2. The ordinance as written resolves the concern raised by the previous similar ordinance on May 20, 1986. NOW, THEREFORE, BE IT ORDAINED by the City Council of the City of Palm Desert, California, as follows: 1. That the above recitations are true and correct and constitute the findings of the council in this case. 2. That the city council does hereby approve ZOA 86-4, as provided in the attached exhibit labeled Exhibit "A". PASSED, APPROVED and ADOPTED at a regular meeting of the Palm Desert City Council, held on this 28th day of August, 1986, by the following vote, to wit: AYES: SNYDER, WILSON & KELLY NOES: NONE ABSENT: BENSON & JACKSON ABSTAIN: NONE L RICHOD S. GILLIGAN, City Cler4, City of Palm Desert, Callfornt a /dig ORDINANCE No. 468 EXHIBIT "A" Section 25.56.302 is added to read: In all commercial zones a conditional use permit must be obtained for convenience stores, liquor stores and establishments with on -site consumption of alcoholic beverages. A convenience store is defined as a "grocery store used for the retail sale of food, food products, dairy products and alcoholic beverages for consumption off the premises". IF 2
