AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF
PALM DESERT, CALIFORNIA, APPROVING A NEGATIVE
DECLARATION OF ENVIRONMENTAL IMPACT AND CHANGE OF
ZONE FROM R-1 TO OP AT THE SOUTHEAST CORNER OF
FRED WARING DRIVE AND FAIRHAVEN DRIVE.
CASE NO: CZ 86-9 AND PP 86-48
WHEREAS, the City Council of the City of Palm Desert, California, did on
the llth day of December, 1986 hold a duly noticed public hearing to consider a
request by MR. GERALD CHAZAN for approval of a negative declaration of environ-
mental impact and change of zone from R-I to OP at the southeast corner of Fred
Waring Drive and Fairhaven Drive.
WHEREAS, said application has complied with the requirements of the "City
of Palm Desert Procedures for Implementation of the California Environmental
Quality Act, Resolution No. 80-8911, in that the director of community
development has determined that the project will not have a significant impact
on the environment and a negative declaration has been prepared.
WHEREAS, at said public hearing, upon hearing and considering all
testimony and arguments, if any, of all interested persons desiring to be
heard, said city council did find the following facts to exist to justify their
actions:
FINDINGS FOR APPROVAL OF CHANGE OF ZONE:
1. The proposed Office Professional zone is consistent with the Palm
Desert General Plan and the Palma Village Specific Plan.
2. The Office Professional zone is more appropriate at this location
and better protects the public health, safety and welfare than the
existing R-1 designation.
NOW, THEREFORE, BE 1T ORDAINED by the City Council of the City of Palm
Desert, California, as follows:
1. That the above recitations are true and correct and constitute the
findings of the council in this case.
2. A negative declaration of environmental impact is hereby approved.
3. CZ 86-9 Exhibit "A" is hereby approved.
4. The City Clerk of the City of Palm Desert, California, is hereby
directed to publish this ordinance in the Palm Desert Post, a
newspaper of general circulation, published and circulated in the
City of Palm Desert, California, and shall be in full force and
effect thirty (30) days after its adoption.
ORDINANCE NO. 490
PASSED, APPROVED and ADOPTED at a regular meeting of the Palm Desert
City Council, held on this 8th day of January, 1987 by the following vote, to
wit:
