M AN ORD I NANCE OF THE C 11 Y COUNC I L OF THE C I TY OF PALM DESERT, CALIFORNIA, APPROVING A NEGATIVE DECLARATION OF ENVIRONMENTAL IMPACT AND CHANGE OF ZONE FROM R-2 S.P. TO O.P. FOR FIVE LOTS ON THE NORTH SIDE OF FRED WARING DRIVE BETWEEN ADONIS DRIVE AND ACACIA DRIVE. CASE Nos CZ 87-3 WHEREAS, the City Council of the City of Palm Desert, California, did on the 25th day of June 1987 hold a duly noticed public hearing to consider a request by RAY -AL ENTNERPRISES INC. for approval of a negative declaration of environmental impact and change of zone from R-2 S.P. to O.P. for five lots on the north side of Fred Waring Drive between Adonis Drive and Acacia Drive; and WHEREAS, said application has complied with the requirements of the "City of Pains Desert Procedures for Implementation of the California Environmental Quality Act, Resolution No. 80-89", in that the director of community development has determined that the project will not have a significant impact on the environment and a negative declaration has been prepared; and WHEREAS, at said public hearing, upon hearing and considering sit testimony and arguments, if any, of all interested persons desiring to be heard, said city council did find the following facts to exist to justify the granting of said change of zone: I. The proposed office professional zone is more appropriate than the existing residential designation considering noise and other impacts associated with the high level of traffic on Fred Waring Drive. 2. The proposed O.P. zone is consistent with the Palms Village Specific Plan and will promote the health, safety and general welfare in the area. NOW, THEREFORE, BE IT ORDAINED by the City Council of the City of Palm Desert, California, as follows: 1. That the above recitations are true and correct and constitute the findings of the council in this case. 2. That CZ 87-3 Exhibit A and negative declaration of environmental impact, Exhibit 8, is hereby approved. 3. The City Clerk of the City of Palm Desert, California, is hereby directed to publish this ordinance in the Palm Desert Post, a newspaper of general circulation, published and circulated in the City of Palm Desert, California, and shall be in full force and effect thirty (30) days after its adoption. NEGATIVE DECLARATION CASE NDS CZ 87-3 AND PP 87-14 APPLICANT/PROJECT SPONSORS RAY -AL ENTERPRISES INC. 73-170 Ramon Road Thousand Palms, CA PROJECT DESCRIPTION/LOCATIONS Change of zone from R-Z to Office Professional and a precise plan for a one story 17,105 square foot office complex on the north side of Fred Waring Drive West of Monterey Avenue between Acacia Drive and Adonis Drive. The Director of the Department of Community Development, City of Palm Desert, California, has found that the described project will not have a significant: effect on the environment. A copy of the initial study has been attached to document the reasons in support of this finding.
