HomeMy WebLinkAboutORD 510ORDINANCE NO. 510 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF PALM DESERT, CALIFORNIA, AMENDING CHAPTER 1.04 OF THE CODE OF THE CITY OF PALM DESERT RELATING TO THE RIGHT OF THE CITY TO BRING LEGAL ACTION. THE CITY COUNCIL OF THE CITY OF PALM DESERT, CALIFORNIA, DOES HEREBY ORDAIN AS FOLLOWS: Section 1: That Section 1.04.090 be and the same is hereby added to Chapter 1.04 of the Code of the City of Palm Desert to read as follows: "1.04.090. Right of City to Bring Legal Action. In addition to the remedies setforth in this code, the City Council is authorized to bring a legal action in a court of competent jurisdiction for the recovery of any monies expended by it in order to force the provisions of this code. In the event that legal action is brought by the City against any individual, corporation, association or entity, reasonable attorney's fees and costs shall constitute a debt owing by the individual, corporation, association or entity to the City. After the action is brought and the service of the summons and complaint has been made upon the individual, corporation, association or entity and a judgment has been obtained by the City, the City may enforce the judgment by executon and sale in accordance with the procedures set forth by law for the enforcement of judgments. The judgments shall bear interest at the rate of ten percent (10%) per year and shall include reasonable attorney's fees and costs of suit. The remedy as set forth in this section shall be non- exclusive and the City may pursue any or all of the remedies as contained in this code for the enforcement of this code." Section 2: The City Clerk shall certify to the passage and adoption of this ordinance and shall cause the same to be published once in the Palm Desert Post, a newspaper of general circulation printed, published and circulated within the City of Palm Desert and the same shall be in full force and effect 30 days after its adoption.
