HomeMy WebLinkAboutORD 535ORDINANCE NO. 535 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF PALM DESERT, CALIFORNIA, AMENDING CHAPTER 1.08.010 OF THE PALM DESERT MUNICIPAL CODE RELATING TO MISDEMEANOR CITATIONS. THE CITY COUNCIL OF THE CITY OF PALM DESERT, CALIFORNIA, DOES HEREBY ORDAIN AS FOLLOWS: Section 1: That Penal Code Section 836.5 provides that a public officer or employee, when authorized by ordinance, may arrest a person without a warrant whenever he has reasonable cause to believe the person to be arrested has committed a misdemeanor in his presence, which Is a violation of a statute or ordinance which the officer or employee has the duty to enforce; and Section 2: That Palm Desert Municipal Code Section 1.08.010 provides for the authority of the City Manager or his designated representative, as set forth, to Issue misdemeanor citations for violations of City codes and those uniform codes adopted by the City. Section 3: That Section 1.08.010 of the Palm Desert Municipal Code Is hereby amended to read as follows: 1.08.010. Authority of City Manager. "The City Manager and/or his designated representative acting as the Director of Code Compliance, Zoning and License Officer, Director of Building and Safety, Building Inspector, and Construction Inspector, shall have the power to Issue misdemeanor or infraction citations with respect to any violation of any section of the Municipal Code except those specific codes administered solely by the fire department, health ORDINANCE NO.-535• department and police department. The City llla.nage.r and/or his designated representative acting as the Fire Marshal and/or Fire Inspector shall have the power to issue misdemeanor or infraction citations with respect - to any violation of any, section of the Uniform Fire Code adopted by the City of Palm Desert Munici.pal. 110dEl. However, the City Manager and/or his d .signat:ed representative shall have the power to issue citations, for non-moving traffic violations.'' Section 4: The City Clerk shall certify to the {:gar><._„aye and adoption of this ordinance and shall 1 cause the sam�� to be published once in the Palm Desert Post, a newspaper of general circulation printed, published and circulated within the City of Palm Desert, and the same shall be in full force and effect thirty (30) days after its adoption.
