HomeMy WebLinkAboutORD 542M ORDINANCE NO. 542 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF PALM DESERT, CALIFORNIA, AMENDING CHAPTER 8.24 OF THE PALM DESERT MUNICIPAL CODE PERTAINING TO LITTERING. The City Council of the City of Palm Desert, California, DOES HEREBY ORDAIN as follows: Section 1: That Chapter 8.24 of the Palm Desert Municipal Code Is amended to read as follows: 8.24.010 Littering in Private or Public Places. No person sha 1 1 throw, deposit or permit to be deposited, or to remain in or upon, any lot or premises, public street, public alley, or other public place, any type of refuse and waste material, except in authorized public or private receptacles provided for the general public in commercial districts. 8.24.020 Illegal Depositing of Litter in Receptacles. No person shall deposit any type of refuse and waste material in private receptacles or containers without prior written approval of the person in charge of the receptacles or containers. B.24.030 Placement of Litter in Receptacles. Persons placing litter in public receptacles or in authorized private receptacles shall do so in such a manner as to prevent it from being carried, or deposited by the elements upon a street, sidewalk, alley or other public place or upon private property. 8.24.040 Depositing Litter in Gutters. No person shall blow, hose, sweep onto or deposit in any gutter, street or other public place within the City the accumulation of litter from any public or private sidewalk or driveway or any building or lot. Persons owning, leasing, renting, occupying or having charge or possession of any property or place of business, shall keep the sidewalk and parkway in front of their premises free of litter. 8.24.050 Litter Thrown From Vehicles. No person, while a driver or passenger in a vehicle, shall throw or deposit litter upon any street or other public place within the City, or upon private property. 8.24.060 Littering In Parks. No person shall throw or depos it any type of refuse or waste, or 1 i tter in any park or other recreational area within the City except in public receptacles such that the litter will not be carried or deposited by the elements upon any part of the park or other recreational area or upon any street or other public place. Where public receptacles are not provided, all litter shall be carried from the park or other recreational area by the person responsible for its presence and properly disposed of elsewhere as provided in the chapter. ORDINANCE NO. 542 "8.24.070 Violation - Penalty. Any person violating this chapter is deemed quIIty of a misdemeanor, punishable by a fine of not more than $500, and imprisonment in the county jail for a period of not more than six (6) months. 118.24.080 SeverabIIity. Should any provision of this chapter be held invalid, such invalidity shall not affect other provisions which can be given effect without the invalid provision, and to this end, the provisions of chapter are declared severable." Section 2: Publication. The City Clerk shall certify to the passage and adoption of this ordinance and shall cause the same to be printed once in the Palm Desert Post, a newspaper of general circulation, printed, published and circulated in the City of Palm Desert, and this ordinance shall be in full force and effect thirty (30) days after its adoption.
