HomeMy WebLinkAboutORD 572ORDIW4CE NO. 572 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF PALM DESERT, CALIFORNIA, APPROVING A NEGATIVE DECLARATION OF ENVIRONMENTAL IMPACT AND AN AMENDMWr TO THE ZONING MAP REDESIGNATING EIGHT ACRES AT THE NORTHEAST CORNER OF COUNTRY CLUB DRIVE AND PORTOLA AVENUE FROM LOW DENSITY RESIDENTIAL TO OFFICE PROFESSIONAL. CASE NO. C/Z 89-2 WHEREAS, the City Council of the City of Palm Desert, California, did on the 13th day of April, 1989, hold a duly noticed public hearing to consider approval of a Negative Declaration of Environmental Impact and amendment to the Zoning Map redesignating eight acres at the northeast corner of Country Club Drive and Portola Avenue from PR-5 to Office Professional; and WHEREAS, said application has complied with the requirements of the "City of Palm Desert Procedures to Implement the California Environmental Quality Act, Resolution No. 80-89", in that the director of cc m wdty development has determined that the project, will not have an adverse impact on the environment and a Negative Declaration of Environmental Impact has been prepared; and WHEREAS, at said public hearing, upon hearing and considering all testimony and arguments, if any, of all persons desiring to be heard, said city council did find the following facts and reasons to justify their approval: 1. The high levels of traffic generated noise impacting the subject corner exceeds the General Plan Noise Element standards for Low Density Residential. 2. The fragment ownership patterns reduces site planning flexibility necessary for mitigation of noise impacts. 3. The proposed office uses will be compatible with the high traffic and noise environments and will serve as a buffer for interior residential uses. 4. The professional office designation will allow for the development of major medical services now unavailable within Palm Desert. 5. The proposed designation is consistent with the General Plan as amended and will promote uses which will be compatible with the other existing and proposed uses in the vicinity. NOW, 'THEREFORE, BE IT ORDAINED by the City Council of the City of Palm Desert, California, as follows: 1. That the above recitations are true and correct and constitute the findings of the council in this case. 2. That a Negative Declaration of Environmental Impact, Exhibit "A" and C/Z 89-2, Exhibit "B"; are hereby approved. ORDIM,JCE ND. 572 0 3. The City Clerk of the City of Palm Desert, California, is hereby directed to publish this ordinance in the Palm Desert Post, a newspaper of general circulation, published and circulated in the City of Palm Desert, California, and shall be in full force and effect thirty (30) days after its adoption. Amendment to General Plan Circulation Element creating an internal circulation system for the southwest quarter of Section 4 T5S R6E. 2. Amendment to General Plan Land Use Map redesignating the northeast corner of Country Club Drive and Portola Avenue from low density residential to office professional. 3. A change of zone totaling eight acres at the northeast corner of Country Club Drive and Portola Avenue from PR-5 to O.P. 4. A precise plan of design for a 46,000 square foot office complex on four acres at the northeast corner of Country Club Drive and Portola Avenue. 5. A Negative Declaration of Environmental Impact as it pertains to the above cases. The Director of the Department of C mTu city Development, City of Palm Desert, California, has found that the described project will not have a significant effect on the environment. A copy of the Initial Study has been attached to document the reasons in support of this finding.
