AN ORDINANCE OF THE CITY COUNCIL OF THE
CITY OF PALM DESERT, CALIFORNIA,
AMENDING ORDINANCE NO. 107,, THE PALM
DESERT ZONING MAP BY CHANGING THE ZONE
FROM PR-5 N S.P. (PLANNED RESIDENTIAL,
FIVE DU/AC, NATURAL OVERLAY, SCENIC
PRESERVATION) TO O.P. (OFFICE
PROFESSIONAL) ON 8.62 ACRES LOCATED ON
THE NORTH SIDE OF HIGHWAY 111 AT THE
EAST CITY LIMIT.
CASE NO. C/Z 89-9
WHEREAS, the City Council of the City of Palm Desert, California,
did on the 24th day of August, 1989, hold a duly noticed public hearing
to consider an appeal by BERNARD DEBONNE, of a decision by the Planning
Commission denying a negative declaration of environmental impact and
change of zone from PR-5 N S.P. to O. P . , for a professional office
project on an 8.62 acre site on the north side of Highway 111 at the
east city limit; and
WHEREAS, said application has complied with the requirements of
the "City of Palm Desert Procedures to Implement the California
Environmental Quality Act, Resolution No. 80-89", in that the Director
of Community Development has determined that the project will not have
a significant impact on the environment and a Negative Declaration has
been prepared; and ,
WHEREAS, at said public hearing, upon hearing and considering all
testimony and arguments of all persons desiring to be heard, said City
Council did find the following facts to exist to justify their actions:
1. The proposed office use is compatible with other existing and
approved uses in the area.
2. The proposed use will be compatible - with high traffic volumes
on Highway 111.
3. The proposed zoning is consistent with the General Plan as
amended.
The City Council of the City of Palm Desert, California, DOES
HEREBY ORDAIN, as follows: _
SECTION 1: That a Negative Declaration of Environmental Impact
is hereby certified as shown on the attached Exhibit "A".
SECTION 2: That a portion of Ordinance No. 107 referencing
Section 25,46.1 of the Zoning Ordinance, the Zoning Map (Chapter 35.46
of the Palm Desert Municipal Code) is hereby amended to read as shown
on the attached Exhibit "B."
SECTION 3: The City Clerk of the City of Palm Desert,
California, is hereby directed to publish this ordinance in the Palm
Desert Post, a newspaper of general circulation, published and

circulated in the City of Palm Desert, California, and shall be in full
force and effect thirty (30) days after its adoption.
PASSED, APPROVED and ADOPTED by the Palm Desert City Council this
llth day of July, 1996, by the following vote, to wit:

PROJECT DESCRIPTION/LOCATION: A mixed use office/restaurant project
consisting of 114,800 square feet of offices and an 11,000 square foot
restaurant on an 11.3 acre site located on the north side of Highway
111 at the east city limit.
The Director of the.Department of Community Development, City of Palm
Desert, California, has found that the described project will not have
a significant effect on the environment. A copy of the Initial Study
has been attached to document the reasons in support of this finding.
Mitigation measures, if any, included in the project to avoid
potentially significant effects, may also be found attached.
