AN ORDINANCE OF THE CITY COUNCIL OF THE CITY
OF PALM DESERT, CALIFORNIA, APPROVING AN
AMENDMENT TO SECTION 25.37 OF THE ZONING
ORDINANCE. CASE NO.ZOA 89-1
THE CITY COUNCIL OF THE CITY OF PALM DESERT DOES
ORDAIN AS FOLLOWS:
Section 1. The City Council has heretofore
certified that the Final Environmental Impact Report
for the Ahmanson Commercial Development Plan (the
"Final EIR") analyzes all potential environmental
impacts of the proposed Amendment to Section 25.37 of
the Zoning Ordinance, Case No. ZOA 89-1 (the
"Amendment") and was completed pursuant to the
provisions of the California Environmental Quality Act
and guidelines promulgated with respect thereto and
that the City Council has reviewed and considered the
contents of the Final EIR prior to deciding whether to
approve such proposed Amendment.
section 2. The City Council has heretofore
adopted a mitigation monitoring program with respect
to the mitigation measures described in the Final EIR
which have been adopted or made a condition of the
approval of the proposed Amendment.
Section 3. The Planning Commission of the City of
Palm Desert has reported to the City Council that the
proposed Amendment is in conformance with the General
Plan of the City of Plan Desert, and is consistent
with the objectives of the Municipal Code of the City
of Pals Desert, and has recommended approval of the
Amendment.
section A. Pursuant to notice duly given, the
City Council has held a full and fair public hearing
pursuant to law on the proposed t and the City
Council has received testimony concerning the Zone
Change and the City Council has duly considered such
testimony. All objections were heard and passed upon
by the City Council and are hereby overruled by the
City Council. The City Council hereby finds that the
Amendment is consistent with the objectives of Title
25 of the Municipal Code of the City of Palm Desert.

Section 5. The proposed Amendment ZOA 89-1 as set forth in
Exhibit A, a copy of which has been presented to the City Council
and which is on file in the office of the City Clerk, is hereby
approved and Section 25.37.020 of the Zoning Ordinance is amended
as set forth in said Exhibit A.
Section 6. The City Clerk shall certify to the passage of
this Ordinance and shall cause this Ordinance to be published and
posted as required by law.
PASSED, APPROVED, AND ADOPTED by the Palm Desert City Council
this 7th day of December, 1989, by the following vote, to wit:
AYES: BENSON, KELLY, SNYDER, WILSON, CRITES
