HomeMy WebLinkAboutORD 604AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF PALM DESERT, CALIFORNIA, APPROVING A ZONING ORDINANCE AMENDMENT TO SECTION 25.16.030 TO ALLOW OCK4 RCIAL PARKING LOTS AS A CONDITIONAL USE WITHIN THE R-1 ZONE WHEN ADJACENT TO GENERAL CCWERCIAL ZONES AND CONSISTENT WITH RECCt44E RATIONS OF A SPECIFIC PLAN. CASE NO. ZOA 90-1 WHEREAS, the City Council of the City of Palm Desert, California, did on the 12th day of April, 1990, hold a duly noticed public hearing to consider amendment of zoning ordinance amendment to Section 25.16.030 to allow commercial parking lots as a conditional use within the R-1 zone when adjacent to general commercial zones and consistent with recommendations of a specific plan; and WHEREAS, said amendment has complied with the requirements of the "City of Palm Desert Procedure for Implementation of the California Envirormental Quality Act, Resolution No. 80-89," in that the director of co mraity development has determined the amendment to be a class 5 categorical exemption. WHEREAS, at said public hearing, upon hearing and considering all testimony and arguments, if any, of all persons desiring to be heard, said city council did find the following facts and reasons to exist to approve the zoning ordinance text amendment: 1. The proposed amendment implements specific recommendations of the Palma Village and Commercial Core Area Specific Plan. 2. The proposed amendment will be consistent with the intent of the zoning ordinance and will not threaten the public health, safety or general welfare. NOW, THMEFORE, BE IT ORDAINED by the City Council of the City of Palm Desert, California, as follows: 1. That the above recitations are true and correct and constitute the findings of the commission in this case. 2. That it does hereby recommend approval of ZOA 90-1 as provided in the attached exhibit labeled Exhibit "A". 3. The City Clerk of the City of Palm Desert, California, is hereby directed to publish this ordinance in the Palm Desert Post, a newspaper of general circulation, published and circulated in the City of Palm Desert, California, and shall be in full force and effective thirty (30) days after its adoption. 01NI I I Z � • • • PASSED, APPROVED AMID ADOPTED at a regular meeting of the Palm Desert City Council, held cn this 26th day of April, 1990, by the following vote, to wit: AYES: BENSON, TELLY, SNYDER, WILSON, CRITES NOES: NONE ABSENT: NONE ATTEST: NONE ATTEST: / SHEILA R. Boardinghouses and rcominghouses; B. Churches, convents, monasteries and other religious institutions; C. Day nurseries and nursery schools; D. Fire stations; E. Private recreational facilities such as country clubs, tennis and swim clubs, golf courses, with incidental, limited acmiercial uses which are oatmonly associated and directly related to the primary use; F. Private schools and colleges, not including art, business, or trade schools or colleges; G. Public educational institutions; H. Public utility and public service facilities.
