AN ORDINANCE OF THE CITY COUNCIL OF THE CITY COUNCIL OF
THE CITY OF PALM DESERT, CALIFORNIA, ESTABLISHING
MINIMUM STANDARDS FOR THE ABOVE GROUND STORAGE OF
FLAMMABLE / COMBUSTIBLE LIQUIDS AND GASES.
The City Council of the City of Palm Desert, California DOES HEREBY
ORDAIN as follows:
SECTION 1. That Section 15.16.040 and Section 15.16.050 in the Palo
Desert Municipal Code be deleted in their entirety.
SECTION 2. That Section 15.16.040 be replaced as follows:
Section 15.16.040 - Above Ground Storage of Flammable /
Combustible Liamids or Gases.
No person shall install, keep, maintain, or
fill any above -ground tank for the purpose of
storing flammable / combustible liquids or
gases, nor shall the filling of the tank be
permitted without approval by the Fire Marshal
using Exhibit A or B Installation Standards
and a valid storage permit from the city.
This ordinance does not apply to emergency
back-up generators utilizing fuel tank systems
of 500 gallons or less. All flammable /
combustible liquids or gases storage tanks
shall be installed in locations approved by
the Fire Marshal, the Director of Building and
Safety, and the County Health Department.
Flammable / combustible liquids or gases may
be stored in aboveground tanks at
governmental facilities, commercial / retail,
fleet operations, emergency power plants and
agricultural operations. All locations must
be approved by the Fire Marshal, provided that
said flammable / combustible liquids or gases
are to be used only as motor fuel operations
and only so long as said liquids / gases are
stored in approved, above -ground tanks limited
to 2,000 gallon liquid capacity, and there is
no threat of fire which ■ay endanger life,
safety, or threaten nearby improvement At
no time shall they be installed in R1, R2, or
R3 zones. They ■ay be approved for PR zones
when use is for common maintenance facilities.
All above -ground tanks shall meet the
requirements of the current adopted editions
of the Uniform Fire Code, NFPA, National
Electrical Code, City Fire Marshal, and shall
also meet or exceed the California State Fire
Marshal's Office regulations as they pertain
to such installation(s). An annual inspection
/ permit fee of $199.90 must be paid to
maintain, fill, or operate tank system.
SECTION 3. That Section 15.16.945 be added to Palm Desert Municipal
Code to read as follows:
Section 15.16.045 - Non -Conforming Storaae Containers.
Should any istem be in violation or non-
compliance, a stop use order will be given and

a citation issued as a misdemeanor or
infraction depending on severity of offense.
A new citation may be issued each day that
violation continues. Tanks taken out of
service for less than one year will be
rendered safe by gas -freeing as approved by
the Fire Marshal. Tanks that are to be
abandoned, that is, to be taken out of service
for more than a year, shall be rendered safe
by gas -freeing and removed.
SECTION 4. CITY CLERK'S CERTIFICATION. The City Clerk of the City of
Palm Desert, California, is hereby directed to cause this Ordinance to be
published once within fifteen (15) days of adoption in the Palo Desert Post,
a newspaper published and circulated within the City of Palm Desert,
California, and the same shall be in full force and effect thirty (30) days
after adoption.

INSTALLATION STANDARDS
FOR BULK, ABOVE GROUND FLAMMABLE/COMBUSTIBLE LIQUIDS
City permit and Fire Department approval must be obtained prior to
any flammable/combustible liquid or gas being put into tank.
Filling of tanks prior to permit and approval of Fire Department
will be cause for denial of application. UFC 4.108
PLANS (Minimum 2 sets)
Plans shall be submitted with each permit application. The plans
shall include the method of storage and dispensing, quantities and
types of liquids to be stored, distances from tanks and dispensers
--to property lines and buildings, vehicle access, fare appliances,
collision barriers, design and construction of Anks and tank
supports, seismic design of tank supports, second,::-y containment
tank venting and vapor -recovery provisions, emergency controls,
shutoffs and any additional information required by the chief.
Approved application, permit and licenses must be kept at tank
property location.
GENERAL INSTALLATION
Tanks shall be installed in accordance with Article 79, Division
V, and shall be installed in a special enclosure constructed in
accordance with Section 79.902(c) or a listed and approved tank
enclosure or material providing fire protection of not less than
2 hours. The following additional criteria shall apply:
* Quantity of tank(s) is limited to 2000 gallons per approved
installation. UFC Authority Having Jurisdiction
* An approved super hydrant (6"X4"X2-1/2"X2-1/2") with a minimum
of 1000 G.P.K. must be provided from 50 to 150 feet of tank
installation as measured along approved vehicular access
roads. UFC Authority Having Jurisdiction
* At least one 40 BC fire extinguisher shall be mounted between
20' and 50' from tank.
* An approved fire access road (minimum 24 foot width with no
parking) must provide access to storage tank site. Road must
be hard surface, all weather design and meet turn radius
requirements. UFC 79-403
* Fuels shall not be dispensed by gravity.

* All vessels shall be electrically bonded. UFC 79.801d

* A. Electrical installations shall be permanent hard wired
and will be vapor protected in accordance with current
adopted national electrical code. UFC 79.1005
B. All electrical connections must be inspected by fire/city
inspectors.
* A. Installation must be maintained leak and drip free. Any
leakage or contamination of soils will result in "Stop
Dispensing Order" and notification to Riverside County
Environmental Health for proper cleanup.

B. Accidental spillage may not flow into any drain, sewer
or toward any building. UFC 79.405
* Dispensing operation must be in accordance with A.Q.M.D. and
Riverside County Environmental Health.
* All combustibles, including but not limited to, buildings,
lumber piles and dead vegetation shall not be within 30 feet
of storage tanks. UFC 79.1003
* No tank will be installed within any building. NFPA 2-4.1
* A minimum 15 feet will be maintained between property lines
and tank installation.
* A minimum of 15 feet will be maintained between all
combustibles and tank installation. UFC 79.406
* Immediate dispensing area will be level to prevent accidental
rollaway of vehicle being fueled.
* Steel tank shall be manufactured in accordance with U.L. 142.
* Steel tank shall have six-inch emergency vent as required by
NFPA 30.
* Steel tank openings shall be only to the top of appliance.
* Steel tanks shall have continuous welds on all sides, inside
as well as outside.
* Steel tank shall be pressure tested at 5 pounds P.S.I. for 24
hours.
* Tanks shall be tested in accordance with U.L. standard 1709
and shown to have a two hour f ire wall as mandated by the
Uniform Fire Code, Sec. 79.902(c)

* Vaults shall have capability of physical monitoring b. :ween
primary and secondary containment.
* Tank shall be approved for Phase II Balance Recovery,
(California Air Resources Board Executive Order G-70-116).
* Tank appliance will have U.L. listed seven gallon overfill
reservoir.
* Vaults shall be placed on six inch thick reinforced concrete
pad. Steel or rebar or wire mesh will be placed within when
poured.
* Vaults shall have exterior protective epoxy coatings.
* Earthquake restraints shall be installed.
* Guard posts or other means shall be provided to protect the
area where tanks are installed. The design shall be in
accordance with Section 80.301(w).
* Each tank and each special enclosure shall be surrounded by
a clear space of not less than 3 feet to allow for maintenance
and inspection.
* Tank shall have warning signs. Flammable, name of product,
no smoking or open flame. UFC 79.407
* Warning signs and identification signs shall be installed to
clearly identify hazards. The design shall be in accordance
with Sections 79.108, 79.109, 79.902(h) and 79.806(c).
Conspicuous signs prohibiting simultaneous tank filling and
fuel dispensing shall be posted.
* Tanks shall be provided with automatic fuel shut-off devices
capable of stopping the delivery of fuel at 90 percent tank
capacity.
* Tanks shall be vented to prevent vacuum or pressure. -
UFC 79.509
* A. Tank installations shall be protected against tampering
or trespassers by fencing or approved security measures.

B. Emergency pump master switch shall be switched off during
non business hours.

INSTALLATION OF DISPENSING SYSTEMS
Dispensing systems shall be installed in accordance with Article
79, Divisions VII and IX except as follows:
* Motor fuels shall be transferred from tanks by means of fixed
pumps so designed and equipped to allow control of the flow
and to prevent leakage or accidental discharge.
* Tank and tank enclosure openings shall be through the top
only. Approved antisiphon devices shall be installed at each
connection of piping to a tank when such piping extends below
the level of the top of such tank.
* Dispensing devices are allowed to be installed on top of
- special enclosures.
E24ERGENCY SHUT-OFF
* A clearly labeled manually operated pump master switch shall
be provided in an approved location, within 50 feet of, but
not nearer than 20 feet to, any dispenser. Where such master
switch is not visible from all dispensers, the location
thereof shall be indicated by approved signs.
* The master switch or all individual pump circuit switches
shall be set in the "off" position before closing the service
station for business at any time.
* All electric wiring connected to dispensers and pressure
delivery system pumps shall be enclosed in rigid galvanized
conduit with threaded connections. Seals shall be provided
at the dispenser and at pits in pressure delivery systems and
all equipment in such pits shall be nonsparking or vapor -
proof .
NAINTEKANCE
Tanks, special enclosures and dispensing systems shall be
maintained in proper condition. Any damage shall be repaired
immediately with materials having equal or greater strength and
fire resistance. Applicant must have annual maintenance service
contract or provide manufacturer's certification of safety
inspection every two years. These documents must be on file at
tank property location.
REMOVAL OR NON USE TANKS
* Tanks which are to be taken out of service temporarily, that
is, for one year or less, but which are intended to be
returned to service shall be rendered safe by gas -freeing or
by following the procedure outlines below:

A. All flammable or combustible liquids shall be removed
that can be pumped -)ut with the service pump.
B. The tank shall be flooded with water which contains a
rust inhibitor.
C. The fill line and pump suction shall be capped and
secured against tampering.
D. The vent line shall be left open.
* Tanks which are to be abandoned, that is, to be taken out of
service for more than one year, shall be removed.
* Permittee is obligated by law to notify County Fire and Health
Departments of any spill. Californ;a Title 22, Proposition
65. UPC 79.507
* Any permit issued under this code may _.e suspended or revoked
when it is determined by the Fire Marshal that any law, code,
or condition of permit has been violated. UPC 4.107
* IN ALL CASES THE PERMITTEE ASSUMES TOTAL LIABILITY OF STORAGE
TANKS.

AND APPROVED MOTOR FUEL GASES

* Minimum distance to any building shall be 30 feet. Th_
distance shall be increased to 50 feet if container is placc
adjacent to or across from any building opening of less tha.;
one hour fire rating. Distance may be reduced back to 30 feet
if a non combustible fire wall or automatic suppression system
is provided and approved by the Fire Marshal.
* All combustibles, including but not limited to, buildings,
lumber piles and dead vegetation shall not be within 30 feet
of storage tanks. UFC 79.1003
* Minimum distance to any property line shall be 10 feet for
containers of 500 gallons or less liquid capacity. Containers
from 500 to 2000 gallons liquid capacity shall have a minimum
distance of 15 feet to any property line. These distances are
not applicable when the 30 foot building distance listed above
is more restrictive.
At no time shall installations be closer -than 25 feet to
another installation.
Immediate dispensing area will be level to prevent accidental
rollaway of vehicle being fueled.
The accidental flow of vapors shall not be towards any
building or ignition source within 100 feet.
No person shall smoke or operate any open flame Within 50 feet
of container unlesa- such actions are within a building
approved for such.
Supporting foundations shall be of non combustible material
and of a seismic safe design.
All tanks shall be manufactured to the specifications of a 250
P.S.I. rating, ASME standards, and UL listed.
Tank installation shall be so that the longitudinal axis
parallels the most significant important structure. _
Earthquake restraints shall be installed.
Guard posts or other means shall be provided to protect the
area where tanks are installed. The design shall be in
accordance with Section 80.301(w).
* Each tank and each special enclosure shall be surrounded by
a clear space of not less than 3 feet to allow for maintenance
and inspection.
* Tank shall have warning signs. Flammable, name of product,
no smoking or open flame. UFC 79.407

* Warning signs and identification signs shall be installed to
clearly identify hazards. The design shall be in accordance
with Sections 79.108, 79.109, 79.902(h) and 79.806(c).
Conspicuous signs prohibiting simultaneous tank filling and
fuel dispensing shall be posted.
* A. Tank installations shall be protected against tampering
or trespassers by fencing or approved security measures.

B. Fences installed around storage tanks of any capacity
must be approved by the County Fire Chief to ensure
adequate emergency vehicles access.
C. Emergency pump master switch shall be switched off during
non business hours.
EMERGENCY SHUT-OFF/CONTROLS
All lines of 1/2" or more used for unloading of liquefied petroleum
gases or other approved motor fuel gases from storage tanks shall
be equipped with either an interval valve with excess flow features
and a primary valve or an excess flow valve and a primary valve.
Each of the above systems shall be capable of being closed remotely
and with such control mechanisms, fitted with a fusible section
having a melting point of 200 degrees F. which will cause the valve
to close automatically in case of fire. All liquid lines of 1/2"
or more used for loading of LPG into bulk storage tanks shall be
equipped with a back check valve and a primary valve. Remote
control mechanisms for closing primary valves shall be clearly
marked in 4" letters on a contrasting background, EMERGENCY SHUT-
OFF. Condensed -type letters or extended -type letters shall be used
in this sign. These valves are commonly known as excess flow
devices, and transfer point quick disconnect or breakaway.
* A clearly labeled manually operated pump master switch shall
be provided in an approved location, within 50 feet of, but
not nearer than 20 feet to, any dispenser. Where such master
switch is not visible from all dispensers, the location_
thereof shall be indicated by approved signs.
* The master switch or all individual pump circuit switches
shall be set in the "off" position before closing the service
station for business at any time.
* All electric wiring connected to dispensers and pressure
delivery system pumps shall be enclosed in rigid galvanized
conduit with threaded connections. Seals shall be provided
at the dispenser and at pits in pressure delivery systems and
all equipment in such pits shall be nonsparking or vapor -
proof.

MAINTENANCE
* Tank system and all attachments shall be maintained in y;;od
operable condition as per industry, suppliers, and codes
standards. Any installation deemed unsafe shall be issued a
stop use order. A letter must be provided at each annual
inspection from your product supplier stating that
installation is safe according to their standards.
* All flexible hoses/lines shall be replaced when worn or at
least every five years.
TRAINING CERTIFICATION AND LICENSING
* All operators of such equipment shall attend a formal training
program and shall have in their possession a valid
certificate/license approved by the Fire Marshal.
REKOVAL, NON USE
* Whenever the use of liquefied petroleum gas equipment has been
discontinued, it shall be abandoned in an approved manner
within a period of 30 days.
* The following alternative abandonment procedures are
satisfactory:
1. Removal of all liquefied petroleum equipment.
2. Burn off of contents of container.
3. Venting contents of container to atmosphere when
discharge of gas can be held to a safe point of
discharge.
4. All service openings shall be capped c-- plugged after the
contents have been removed from the ;ntainer.
