HomeMy WebLinkAboutORD 641ORDINANCE NO. 641 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF PALM DESERT, CALIFORNIA, CERTIFYING AN ENVIRONMENTAL IMPACT REPORT AND A CHANGE OF ZONE. CASE NO. C/Z 90-14 THE CITY COUNCIL OF THE CITY OF PALM DESERT HEREBY FINDS, DETERMINES, ORDAINS AND ORDERS AS FOLLOWS: Section 1: The city council hereby certified that the Final Environmental Impact Report for the Pacific Golf Resort Precise Plan, (the "Final EIR") analyzes all potential environmental impacts of proposed change of zone and was completed pursuant to the provisions of the California Environmental Quality Act and guidelines promulgated with respect thereto and that the city council has reviewed and considered the contents of the Final EIR prior to deciding whether to approve such proposed change of zone. With respect to the potentially significant environmental impacts identified in the Final EIR, the city council finds that changes or alterations have been incorporated into the project, or required, which avoid or substantially lessen these impacts. All mitigation measures recommended by the EIR as conditions of project approval are hereby adopted and m:de conditions of project approval. Section 2: The city council hereby adopts a mitigation monitoring program for the changes to the project which have been adopted or made a condition of project approval in Section 1 of this resolution. The director of community development shall ensure that all mitigation measures adopted in Section 1 of this resolution shall be fully implemented and completed. In addition, approval of subsequent development proposals pursuant to this approved project shall include, as a condition of project approval, all applicable mitigation measures required by Section 1 of this resolution. Section 3. The Planning Commission of the City of Palm Desert has reported to the city council and to the agency that proposed zone changes are in conformance with the General Plan of the City of Palm Desert, and has recommended approval of C/Z 90-14. Section 4. Pursuant to notice duly given, the city council has held a full and fair public hearing pursuant to law on proposed zone changes and the city council has received testimony concerning such zone change. All objections were heard and passed upon by the city council and are hereby overruled by the city council. Section 5. Proposed Change of Zone C/Z 90-14 Exhibit A, a copy of which has been presented to the city council and which is on file in the office of the city clerk, is hereby approved.
