ORDINANCE NO. 691
AN ORDINANCE OF THE CITY COUNCIL OF THE CITY
OF PALM DESERT, CALIFORNIA, AMENDING CHAPTER
9.24 PERTAINING TO NO:Sr';'ONTROL.
WHEREAS, The City Council of the City of Palm Lesert,
California, DOES HEREBY ORDAIN as follows:
Section 1: That Subsection (Q) be added to Section 9.24.020
to read as follows:
9.24.020(Q) Definition:
A. 9.24.020(Q) "Average Sound Level" means a sound level
typical of the sound levels at a certain place during a
given period of time; also, means an equivalent
continuous sound level.
Section 2: That Section 9.24.030 be amended in its entirety
to read as follows:
9.24.030 Sound Level Limits:
A. The following one -hour average sound level limits, unless
otherwise specifically indicated, shall apply as
indicated in the following table:

B. If the measured ambient noise level exceeds the
applicable limit as noted in table A, the allowable
average sound level shall be the ambient noise level.
The ambient noise level shall be measured when the
alleged noise violation source is not operating.

C. The sound level limit between two zoning districts shall
be measured at the higher allowable district.
Section 3: That Section 9.24.040 be amended to read as
follows:
9.24.040 GENERAL PROHIBITIONS:
A. In the absence of an objective measurement, by the use of
a sound level meter, additionally, it shall be unlawful
for any person to make, continue, or cause to be made or
continued, within the City, any disturbing, excessive or
offensive noise which causes discomfort or annoyance to
reasonable persons of normal sensitivity residing in the
area.
B. The characteristics and conditions which should be
considered in determining whether a violation of the
provisions of this section exists, include, but not
limited to, the following:
1. The level of noise;
2. Whether the nature of the noise is used or unused;
3. Whether the origin of the noise is natural or
unnatural;
4. The level of the background noise;
5. The proximity of the noise to sleeping facilities;
6. The nature and zoning of the areas within which the
noise emanates;
7. The density of the inhabitation of the area within
which the noise emanates;
8. The time of day or night the noise occurs;
9. The duration of the noise;
10. Whether the noise is recurrent, intermittent or
constant; and
11. Whether the noise is produced by a commercial or
non-commercial activity.
Section 4: Delete Section 9.24.045
Section 5:

Add Subparagraph J to Section 9.24.060 to read as
9.24.060(J) CARILLON CHIMES:
Carillon chimes between the hours of 8 a.m. to 7 p.m.

9.24.060(K) GOLF COURSES:
Golf course ground maintenance hours shall be from 5:30 a.m.
to 7:00 p.m., seven days a week, including government
holidays.
Section 6:
Add Section 9.24.065 to read as follows:
9.24.065 PARKING LOT SWEEPERS:
No person shall operate, or permit to be operated, a parking
lot sweeper between the hours of 10 p.m. to 7 a.m. in or
adjacent to any residential zone. Emergency work and/or
unusual conditions may cause parking lot cleaning to be
permitted with the consent of the City Manager.
Section 7: The City Clerk shall certify to the passage and
adoption of this ordinance and shall cause the same to be published
once in the Palm Desert Post, a newspaper of general circulation,
printed, published and circulated with the City of Palm Desert, and
same shall be in full force and effect 30 days after its adoption.
PASSED, APPROVED, and ADOPTED this 22nd day of October ,
1992, by the City Council of the City of Palm Desert, California by
the following vote, to wit:
