HomeMy WebLinkAboutORD 698ORDINANCE NO. 693 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF PALM DESERT, CALIFORNIA, AMENDING ITS CONFLICT OF INTEREST CODE. WHEREAS, the City has reviewed its Conflict of Interest Code pursuant to Government Code section 87306.5 and finds that some revisions of the Code's appendices are necessary. NOW, THEREFORE, the City Council of the City of Palm Desert, California, DOES ORDAIN as follows: SECTION 1. That Appendices "A" and "B" of the Conflict of Interest Code adopted by Section 2.56.010 of the Municipal Code be amended to read in the manner provided by Exhibits "1" and 112" attached hereto and incorporated herein by this reference. SECTION 2. The City Clerk shall certify as to the passage and adoption of this ordinance and shall cause the same to be published once in the Palm Desert Post, a newspaper of general circulation, printed, published, and circulated within the City of Palm Desert, and the same shall be in force and effect thirty (30) days after its adoption. Building Inspector I 1 Civil Consultant* 1 *Consultants shall be included in the list of designated employees and shall disclose pursuant to the broadest disclosure category in the code subject to the following limitation: The City Manager may determine in writing that a particular consultant, although a "designated position," is hired to perform a range of duties that is limited in scope and thus is not required to fully comply with the disclosure requirements described in this section. Such written determination shall include a description of the consultant's duties and, based upon MSRM9 -3- ORDINANCE NO. 698 4 that description, a statement of the extent of disclosure requirements. The City Manager's determination is a public record and shall be retained for public inspection in the same manner and location as this conflict of interest code. NOTE: The following elected and appointed positions are not designated within this Code because individuals occupying such positions must file disclosure statements annually with the Fair Political Practices Commission pursuant to Article 2 of Chapter 7 of Title 9 of the Government Code: 1. NSR29069 - 4 ORDINANCE NO. 699 EXHIBIT 112" APPENDIX "B" MASTER LIST OF DISCLOSURE CATEGORIES SPECIFICATION SHEET REPORTABLE INVESTMENTS, INTERESTS IN REAL PROPERTY, AND INCOME CONFLICT OF INTEREST CODE CITY OF PALM DESERT DEFINITION: "Unit" as used in this text means the particular department, board, commission, office or other entity using the disclosure category. Disclosure Category 1 All investments, business positions, sources of income, and interests in real property. r 2 All investments, business positions, and sources of income. ^� 3 Interests in real property. 4 Investments and business positions in, and income from, entities providing supplies, services, equipment or machinery of the type used by the designated employee's unit. 5 Investments and business positions in, and income from, entities which are book outlets, vendors or providers of business services. 6 Investments and business positions in, and income from, sources engaged in construction, building, or material supply. 7 Investments and business positions in, and income from, sources which supply or manufacture solar energy systems. 8 Investments and business positions in, and income from, entities or persons engaged in construction or development. 9 Investments and business positions in, and income from, sources engaged in the construction of public works projects.
