HomeMy WebLinkAboutORD 7130 ORDINANCE 713 AN ORDINANCE OF THE CITY OF PALM DESERT, CALIFORNIA, TO PROVIDE A STANDARD FORMAT TO SECURE SUB -STANDARD BUILDINGS DUE TO HEALTH AND LIFE SAFETY VIOLATIONS. The City Council of the City of Palm Desert DOES HEREBY AMEND Section 21.04.010, Uniform Code for the Abatement of Dangerous Buildings, Title 21 of the Palm Desert Municipal Code to read as follows: SECTION 21.04.010. ADOPTION OF THE UNIFORM CODE FOR THE ABATEMENT OF DANGEROUS BUILDINGS. The rules, regulations, provisions and conditions set forth in that certain code, entitled the Uniform Code for the Abatement of Dangerous Buildings, 1991 Edition, therein contained, promulgated and published by the International Conference of Building Officials, one (1) full printed copy of which, printed as a code in book form, whereby the city council ordered filed, and which have been actually filed in the office of the city clerk, and which as so on file, are referred to, and by this reference expressly incorporated as Title 21 of the Palm Desert Municipal Code, and for all intents and purposes as though setforth at length, shall be and the same are established and adopted as the rules, regulations, provisions and conditions to be observed and followed for the protection of the public health, safety and general welfare of the occupant and the public governing the reasonable procedures for the classification and abatement of dangerous buildings, whereby buildings or structures which from any cause endanger the life, limb, health, morals, property, safety or welfare of the general public or their occupants, is established and adopted, and the same shall be designated, known and referred to as the Uniform Code for the Abatement of Dangerous Buildings of and for the City of Palm Desert, California. The City Council of the City of Palm Desert, California, DOES HEREBY ADD the following to Title 20 of the Palm Desert Municipal Code: SECTION 21.04.030. UNIFORM HOUSING CODE, 1991 EDITION, ABATEMENT OF SUB -STANDARD DWELLINGS. The rules, regulations, provisions and conditions set forth in that certain code, entitled the Uniform Housing Code, 1991 Edition, therein contained, promulgated and published by the International Conference of Building Officials one (1) full printed copy of which, printed as a code in book Ordinance No. Page 2 713 form, whereby the city council ordered filed, and which have been actually filed in the office of the city clerk, and which as so on file, are referred to, and by this reference expressly incorporated as Title 21 of the Palm Desert Municipal Code, and for all intents and purposes as though setforth at length, shall be and the same are established and adopted as the rules, regulations, provisions and conditions to be observed and followed for the protection of the public health, safety and general welfare of the occupant and the public governing the reasonable procedures for the classification and abatement of sub -standard dwellings, whereby dwellings which from any cause endanger to the life, limb, health, morals, property, safety or welfare of the general public or their occupants, is established and adopted and the same shall be designated, known and referred to as the Uniform Housing Code of and for the City of Palm Desert, California. SECTION 21.04.040. STANDARD FOR SECURING ABANDONED OR VACANT BUILDINGS. Upon the determination of the building official, if the structure has become a sub -standard abandoned or vacant structure, the building official shall require the following actions be taken by the owner of the property or authorized agent to insure securement of the property: 1. All openings of the structure shall be secured with 3/4" plywood, minimum 4" lap on exterior. One (1) piece of plywood only unless the opening requires larger than one (1) 4x8 sheet. 2. 3/8" minimum carriage bolts on exterior. Washer size 1/4" larger than bolt size. Washer and double nuts shall be on inside. 3. 1/4" screened openings shall be installed in all plywood barriers. Openings shall be minimum 5"x8". 4. Discontinue all utilities, gas, water, electric. Lock -off meter base or disconnect line. 5. Seal cap all waste lines serving fixtures within the structure. 6. Complete removal of furniture and carpeting. 7. Complete clean-up of all outside areas and debris. Ordinance No. Page 3 713 8. A security company must be employed by the owner of record or the owner's authorized agents to perform an onsite inspection a minimum of twice weekly to assure security of the vacant building. 9. The security company will immediately notify the owners or the owner's agent of any unsecured openings, trespassing or breakings. 10. Request must be made to the building department to make an onsite inspection of the above mentioned items. 11. The securing of the sub -standard structure shall be approved for six (6) month with a six (6) month extension. 12. Provide no trespassing signs as per Palm Desert Municipal Code, Section 21.04.050. 13. Building Department Drawing No. 93-1 is hereby attached to this ordinance and made part of the standards for securing. SECTION 21.04.050. TRESPASSING PROHIBITED. It shall be unlawful for other than the owner, authorized agent of the owner, city, police or fire official to trespass on property that is secured. The property shall be posted with a "Trespassing Prohibited" sign. SECTION 21.04.060. ENFORCEMENT. It shall be the duty of the building official, or his designated deputize inspectors or employees, to enforce all standard formats to secure sub -standard buildings and to insure that all life, health and safety regulations shall be in conformance along with building code standards. SECTION 21.04.070. VIOLATIONS. Any person violating any provision of this ordinance shall be deemed guilty of an infraction or misdemeanor as hereinafter specified. Such person shall be deemed guilty of a separate offence for each and every day or portion thereof during which any violation of any of the provisions of this ordinance is committed, continued or permitted. Ordinance No. 713 Page 4 Any person convicted of a violation of this ordinance shall be: (1) Guilty of an infraction offence and punished by a fine not exceeding $100.00 for a first violation; (2) Guilty of an infraction offense and punished by a fine not exceeding $200.00 for a second violation on the same site. The third, and any additional violation on the same site, shall be punishable by a fine not exceeding $1000.00 or six (6) months in jail, or both. Not withstanding the above, a first offence may be charged and prosecuted as a misdemeanor. Payment of any penalty herein shall not relieve any person from the responsibility for correcting the violation. Openings shall be minimum 5" X 811 . * Plywood minimum 4" lap on exterior (one piece of ply- wood only unless the opening requires larger than one 4 X 8 sheet). * 2 x 4 minimum 8" lap interior walls. Use one 2 X 4 if opening less than 30" high. on only is * Protruding windowsill, if flush, lap same as sides. * 3/8" minimum carriage bolts. Exterior washer size 1/4" larger than bolt size. Washer and double nuts on inside. All windows and doors shall be secured. All openings except the front door shall be secured per the above drawing or similar as conditions permit with one (1) piece of plywood only, unless the opening requires larger than a 4' X 8' sheet. All plywood shall be 5/8" except the security door which shall be 3/4". Remove all removable glazed sections where glass is intact and place inside the house. Openings 30" high or less may be secured with only one (1) 2 X 4 and two (2) bolts. All bolts securing the 2 X 4's must be tightened carefully to be snug but not crush the interior finishes. The purpose of the double nuts is to tighten them against one another as tight as possible. If the dwelling has decorative items adjacent to the opening, such as surface applied shutters, etc. that are easily -removed, carefully remove them and place them inside the house.
