HomeMy WebLinkAboutORD 7174- ORDINANCE NO. 717 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF PALM DESERT, CALIFORNIA, AMENDING PALM DESERT MUNICIPAL CODE SECTION 8.16.060 PERTAINING TO HAULING PERMIT - EXEMPTION, SPECIFICALLY ADDRESSING CONSTRUCTION DEBRIS COLLECTION WHEREAS, the State of California Assembly Bill 939, the California Waste Management Act of 1989, is a state mandated local program requiring cities to reduce landfilled solid waste by 25% and 50% by the years 1995 and 2000 respectively; and WHEREAS, the City of Palm Desert desires control of the City's waste stream to regulate and encourage recycling programs in order to meet the state mandated reduction goals; and WHEREAS, construction debris has been identified as material that is highly recyclable; and WHEREAS, construction debris collection remains the only non- exclusive service within the Palm Desert Municipal Code, except those individuals and for businesses hauling construction and green waste with their own employees and equipment; and WHEREAS, an exclusive franchise will provide certain operation control, recycling control and financial accountability; and WHEREAS, opportunities for individuals and permitted contractors to remove construction and agricultural debris with their own equipment and employees will still exist. NOW, THEREFORE, the City Council of the City of Palm Desert, California, DOES HEREBY ORDAIN as follows: Section 1. That Chapter 8.16.060 of the Palm Desert Municipal Code is amended to read as follows: "Section 8.16.060 - Hauling Permit - Exception No person or resident of the City shall remove, transport or convey any solid municipal waste upon or along any public street, alley or place within the City, unless he holds a contract with the City for the collection and disposal thereof and has a valid or existing permit from the County to haul solid municipal waste; except the provision of this section shall not apply to contractors or builders removing debris, rubbish, and trash from construction sites with their own equipment and employees, any person holding a valid City business license to engage in the nursery or gardening business or to any person removing shrubbery, grass, tree cuttings, ORDINANCE NO. 717 tree trimmings or other agricultural debris from any property owned or occupied by such person, or any person removing industrial wastes or any person removing large or oversized items of rubbish from their promises." Section 2. The City Clerk shall certify to the passage and adoption of this ordinance and shall cause the same to be published once in the Palm Desert Post, a newspaper of general circulation, printed, published, and circulated within the City of Palm Desert, and the same shall be in full force and effect 30 days after its adoption.
