HomeMy WebLinkAboutORD 744ORDINANCE NO. 744 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF PALM DESERT, CALIFORNIA, AMENDING CHAPTER 10.64 OF THE PALM DESERT MUNICIPAL CODE, RELATING TO PARADE PERMITS w NOW, THEREFORE, the City Council of the City of Palm Desert, California, DOES ORDAIN as follows: Section 1. Chapter 10.64 of the Palm Desert Municipal Code is hereby amended to read as follows: "Chapter 10.64 PARADE PERMITS sections: 10.64.010 Authority. 10.64.020 Parade -- Defined. 10.64.030 Permit -- Required. 10.64.040 Application -- Required. 10.64.050 Permit -- Issuance. 10.64.060 Terms. 10.64.070 Rejection -- Notice. 10.64.080 Appeal. 10.64.090 Officials to be Notified. 10.64.100 Interference With Parade -- Prohibited. 10.64.010 Authority. In accordance with Section 21101 of the California Vehicle Code, the issuance of permits for parades and local special events or celebrations, and the temporary closing of city streets or highways for such purpose is delegated to the City Manager, subject to the rules contained in this Chapter. 10.64.020 Parade -- Defined. 'Parade' means any parade, march, ceremony, show,. exhibition, pageant, or procession of any kind, or any other similar display, in or upon any street, park, or other public place in the City. 10.64.030 Permit -- Required. It is unlawful for any person to hold, manage, conduct, aid, participate in, form, start or carry on, any parade, or procession of any kind or cause or permit the same upon any public street, alley, park, or any other public grounds in the City unless there GPS208531 has first been obtained from the City Manager a permit to do so. Such permit shall be carried by the person in charge of heading or leading such activity. 10.64.040 Application -- Required. (a) Any person desiring to conduct or manage a parade shall, not less than fifteen (15) days before the date on which it is proposed to conduct such parade, file with the City Manager a verified application on a form furnished by the same, setting forth the following information: (1) The name of the person or organization wishing to conduct such parade; (2) If the parade is proposed to be conducted for, on behalf of, or by an organization, the name, address and telephone number of the headquarters of the organization, and the authorized and responsible head of such organization; (3) The name, address and telephone number of the person who is the Parade Chairman and will be responsible for its conduct; (4) The name, address and telephone number of the person or organization to whom the permit is desired to be issued; (5) The date when such parade is to be conducted; (6) The route to be traveled, the starting point and the termination point; (7) The approximate number of persons, animals and vehicles constituting such parade, the type of animals, and a general description of the vehicles; (8) The time when such parade will start and terminate. (9) Whether such parade will occupy all or a portion of the width of the streets proposed to be traveled; (10) The location by streets of any assembly area or areas for such parade; (11) The time at which units of the parade will begin to assemble at any such assembly area or areas; (12) A statement agreeing to hold the City free and harmless from any activities evolving from the parade in a form satisfactory to the City Attorney. (b) In the event the above -referenced investigation can be accomplished in a more timely fashion than set forth above, the City Manager may waive the fifteen (15) day filing requirement. GPS208531 - 2 - 10.64.050 Permit -- Issuance. The City Manager shall issue a permit as provided for in this Chapter when, from a consideration of the application and from such other information as may otherwise be obtained, he finds that: (1) The conduct of such parade will not substantially interrupt the safe and orderly movements of other traffic contiguous to its route; (2) The conduct of such parade will not require -the diversion of so great a number of police officers of the City to properly police the line of movement and the areas contiguous thereto as to prevent normal police protection to the City; (3) The concentration of persons, animals and vehicles at assembly points of the parade will not unduly interfere with proper fire and police protection of, or ambulance service to, areas contiguous to such assembly areas; (4) The conduct of such parade will not unduly interfere with the movement of firefighting equipment en route to a fire or other emergency equipment; (5) The conduct of such parade is not reasonably likely to cause injury to persons or property. 10.64.060 Terms. The permit to be issued by the City Manager shall prescribe terms consistent with this Chapter. 10.64.070 Rejection -- Notice. The City Manager shall act upon the application for a parade permit within two (2) days after the filing thereof. If.the City Manager disapproves the application, he shall immediately notify the applicant of his or her action, stating the reasons for his or her denial of the permit. Such notice shall be mailed to the applicant at his or her address of record. 10.64.080 Appeal. Any person who has been denied a permit pursuant to this Chapter may appeal to the City Council by filing a written notice of such appeal within five (5) days after the mailing by the City Manager of the notice of rejection. 10.64.090 Officials to be Notified. Immediately upon the granting of a parade permit, the City Manager shall send a copy thereof to the following: GPS208531 - 3 - a (1) The Chief of Police; (2) The Fire Chief; (3) The Director of Public Works; (4) The Director of Planning; (5) The State Highway Patrol; (6) The County Sheriff's Office; (7) Any other public officials responsible for functions deemed likely to affected by the parade; (8) Any public transportation or other utility, the regular routes of whose vehicles will be affected by the route of the proposed parade. 10.64.100 Interference With Parade -- Prohibited. No person shall without the consent of the permittee join or participate in a parade, nor in any manner interfere with its progress or orderly conduct." Section 2. The City Clerk shall certify as to the passage and adoption of this ordinance and shall cause the same to be published once in the Palm Desert Post, a newspaper of general circulation, printed, published, and circulated within the City of Palm Desert, and the same shall be in force and effect thirty (30) days after its adoption.
