HomeMy WebLinkAboutORD 758ORDINANCE NO. 758 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF PALM DESERT, CALIFORNIA, AMENDING SECTIONS 2.48.040, 2.48.060, 2.48.070, 2.48.090 AND 2.48.110, AND ADDING SECTIONS 2.48.075 AND 2.48.095 OF THE MUNICIPAL CODE, REGARDING DISASTER AND EMERGENCY RELIEF. WHEREAS, the City of Palm Desert ("City") has adopted a Disaster Relief Ordinance ("Ordinance") codified at Chapter 2.48 of the Palm Desert Municipal Code; and WHEREAS, the Ordinance is based upon and implements the California Emergency Services Act ("Act") which is found at Government Code Section 8550 et seq.; and WHEREAS, in 1992 the Legislature added to the Act Government Code Section 8607 which instructs the State Office of Emergency Services in coordination with State agencies and interested local agencies to jointly establish by regulation a standardized emergency management system ("SEMS") for use by all emergency response agencies; and WHEREAS, pursuant to Government Code Section 8607(e) each local agency must use the SEMS by December 1, 1996 in order to be eligible for any funding of response -related costs under disaster assistance programs; and WHEREAS, the City has determined that several sections of the Ordinance should be repealed and that several sections of the Ordinance should be added to reflect changes in State law and regulations and to provide for the efficient conduct of City business in the case of an emergency. NOW, THEREFORE, the City Council of the City of Palm Desert, California, DOES HEREBY ORDAIN AS FOLLOWS: Section 1. Section 2.48.040 of the Palm Desert Municipal Code is amended to read as follows: 112.48.040 Disaster Council - Membership. The city disaster council consists of the following persons: A. Mayor, who shall be its chairman; B. Mayor pro-tempore, who shall be its vice chairman; C. Remaining city councilmembers; D. The city manager, who shall be secretary." PAM54321 Section 2. Section 2.48.060 of the Palm Desert Municipal Code is amended to read as follows: 112.48.060 Functions of County Office. The County of Riverside will make up the operational area for the coordination of emergency activities and to serve as a link in the communications system between the state's emergency operation centers and the local operation centers. The city shall participate in the organization and functioning of the operational area under the direction of the county as lead agency." Section 3. Section 2.48.070 of the Palm Desert Municipal Code is amended to read as follows: 1-2.48.070 City Office of Emergency Services. The city office of emergency services shall prepare plans and provide emergency management coordination of the city's emergency plan for all city departments and contract agencies to the city. The office of emergency services shall be under the direction of the city's emergency services coordinator." Section 4. Section 2.28.090 of the Palm Desert Municipal Code is amended to read as follows: 112.48.090 Declaration of Local Emergency. A. A local emergency may be declared for good and sufficient reason by the council, or if the council is not in session, by: 1. City manager; 2. Emergency services coordinator; 3. A s s i s t a n t c i t y manager/redevelopment; 4. Assistant city manager/public works; 5. Assistance city manager/director of community development; 6. Assistant city manager/economic development. B. Whenever a local emergency is proclaimed by other than the council, the council shall take action to ratify the proclamation within seven days thereafter or the proclamation shall have no further force or effect." PAM54321 -2 - Section 5. Section 2.48.110 of the Palm Desert Municipal Code is amended to read as follows: "2.48.110 City Manager Duties. The city manager shall be emergency corps commander. In the absence or inability of the city manager to act, he shall automatically be succeeded as emergency corps commander by any of the following officials in the order named: A. Emergency services coordinator; B. A s s i s t a n t c i t y manager/redevelopment; C. Assistant city manager/public works; D. Assistant city manager/community development; E. Assistant city manager/economic development." Section 6. Section 2.48.075 of the Palm Desert Municipal Code is added to read as follows: "2.48.075 Standardized Emergency Management s em. In accordance with Government Code Section 8607, the city shall utilize the standardized emergency management system, as established by the state office of emergency services, to coordinate multiple agency operations." Section 7.1 Section 2.48.095 of the Palm Desert Municipal Code is added to read as follows: 112.48.095 Standby Officers. To provide for the continuance of the legislative and executive departments of the city during an emergency, the city council shall by resolution appoint the following standby officers: A. Three for each member of the city council; B. Three for the city manager. The city council shall make such appointments in accordance with state law. The city council shall also provide for the succession of department heads having duties in the maintenance of law and order or in the furnishing of public services relating to health and safety.. 11 PAM54321 -3- Section 8. The City Clerk shall certify as to the passage and adoption of this ordinance and shall cause the same to be published once in the Palm Desert Post, a newspaper of general circulation, printed, published, and circulated within the City of Palm Desert, and the same shall be in force and effect thirty (30) days after its adoption.
