AN ORDINANCE OF THE CITY COUNCIL OF
THE CITY OF PALM DESERT, CALIFORNIA,
AMENDING SECTION 10.36.101 OF THE
MUNICIPAL CODE, TO PROVIDE A 40
MILES PER HOUR SPEED LEMT FOR FRED
WARING DRIVE
WHEREAS, the California Vehicle Code allows municipalities to establish speed zones
on local streets; and
WHEREAS, Section 627(b) of the California Vehicle Code sets forth requirements to be
evaluated to establish speed limits; and
WHEREAS, in addition to identification of prevailing streets, roadside conditions not
readily apparent to driver, must be criteria utilized in establishing the speed limits; and
WHEREAS, conditions not readily apparent to the driver may justify and require lower
speed limits than those identified as permitted solely by a prevailing speed study; and
WHEREAS, after review 'of the existing situations on Fred Waring Drive there are
conditions not readily apparent to the driver:
These conditions include, but are not limited to:
(1) The presence of rolled curbs on the northside rather than normal curbs. Rolled
curbs are less able to hold traffic on the street.
(2) The tunnel effect created by the walls on the southside of Fred Waring Drive.
They continuous and closer to the street than normal, creating a tunnel effect
making the traffic lanes appear narrower than normal.
(3) Fred Waring Drive is also a major truck route which further differentiates the
street from others.
(4) There is a high number of youth pedestrian traffic using Fred Waring Drive to
walk to the high school, Sacred Heart School, as well as, Lincoln School and Palm
Desert Middle School.
(5) Related to the above is the lack of sidewalk on the southside of Fred Waring
Drive and the narrow sidewalks adjacent to the rolled curbs on the northside.
WHEREAS, the Palm Desert City Council does hereby ordain as follows:

SECTION 1: Municipal Code 10.36.101 be amended as follows:
40 Miles Per Hour on Fred Waring Drive between Highway I I I to Cook Street.
PASSED, APPROVED AND ADOPTED, by the Palm Desert City Council this 12th
day of September, 1996,by the following vote to wit:
AYES: Benson, Crites, Kelly, Spiegel, Snyder
NOES: None
