HomeMy WebLinkAboutORD 842ORDINANCE NO. 842 AN ORDINANCE OF THE CITY OF PALM DESERT, CALIFORNIA, PROVIDING FOR REGULATION AND NOISE CONTROL OF PORTABLE POWERED BLOWERS AND ADDING SECTIONS 9.24.020 AND 9.24.075 TO CHAPTER 9 OF CODE OF THE CITY OF PALM DESERT, CALIFORNIA. The City Council of the City of Palm Desert, California, DOES HEREBY ORDAIN as follows: SECTION 1: That there is hereby added to Section 9.24.020, Definitions, the definition as follows: 9.24.020 Definitions "Portable Powered Blower" means any mechanically powered device, regardless of the source of power, which is not stationary, and used for the purpose of blowing leaves, dirt or other debris off sidewalks, lawns or other surfaces. SECTION 2: That Subparagraph H of Section 9.24.060 be, and the same hereby is, amended to read as follows: 9.24.060 Special Provisions Established H. Noise sources associated with property maintenance: 1. Noise sources associated with property maintenance; however, the operating of a lawnmower, edger or a similar device shall be prohibited except during the following hours: Monday through Friday 8:00 am to 5:30 pm Saturday 9:00 am to 5:30 pm Sunday 9:00 am to 12:00 pm Government Code Holiday Not allowed 2. Notwithstanding the hours of permitted operations, such equipment that constitutes a public nuisance may be abated as otherwise provided in this code. Ordinance No. 842 Page two SECTION 3: That Section 9.024.075 by, and the same hereby, is added to Chapter 9 of the Code of the City of Palm Desert, California, to read as follows: 9.24.075 Portable Powered Blowers A. No person shall operate, or permit to be operated, a portable powered blower except during the following hours: Monday through Friday 8:00 am - 3:00 pm Saturday 9:00 am - 12:00 pm Sunday 9:00 am - 12:00 pm Government Code Holiday Not allowed B. No person shall willfully make or continue, or willfully cause to be made or continued any noise from any portable powered blower at a level which exceeds 70 decibels dBA measured at the midpoint of a wall area twenty feet (201) long and ten feet (101) high and at the horizontal distance fifty feet (501) away from the midpoint of the wall, or not more than seventy-six (76) decibels dBA at a horizontal distance of twenty-four feet (241) using a sound level meter. C. All gasoline powered blowers shall be equipped with a permanently installed limiter that restricts the individual equipment motor performance to half trottle speed or less. D. No portable powered blower shall be operated in a manner which will permit dirt, dust, debris, leaves, grass clippings, cuttings, or trimmings from trees or shrubs to be blown or deposited onto neighboring property or public right-of-way. All waste shall be removed and disposed of in a sanitary manner by the user or property occupant. E. Leaf blowers shall not be operated within a horizontal distance of ten feet (10') of any operable window, door, or mechanical air intake opening or duct. Ordinance No. 842 Page three F. All portable power blowers operated by commercial landscape businesses in the City of Palm Desert must be registered and licensed with the City of Palm Desert pursuant to the most current adopted resolution. SECTION 4: The City Clerk shall certify to the passage and adoption of this ordinance and shall cause the same to be published once in the Palm Desert Post, a newspaper of general circulation, printed, published and circulated within the City of Palm Desert.
