HomeMy WebLinkAboutORD 916ORDINANCE NO. 916 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF PALM DESERT, CALIFORNIA, REGULATING LASER POINTERS AND ADDING CHAPTER 9.69 OF THE CODE OF THE CITY OF PALM DESERT. The City Council of the City of Palm Desert, California, does hereby ordain as follows: Section 1. That Chapter 9.69 of the Code of the City of Palm Desert, California, be, and the same hereby is, added to the Code of the City of Palm Desert, California, to read as follows: CHAPTER 9.69 "9.69. LASER POINTERS Section 9.69.010. Definitions. Laser pointer or similar device. For the purposes of this chapter, "laser pointer or other similar device" shall be defined as any device capable of emitting a highly amplified ultraviolet or infrared light, regardless of the color of the light emitted. Section 9.69.020. Prohibited Acts. It shall be unlawful for any person to focus, point, shine, or otherwise direct the beam of a laser pointer or other similar device at any person, or directly or indirectly into the eyes of another person or animal, or into a moving vehicle, in such a manner as to be injurious to, harass, disturb, or place in fear of bodily harm any other person and/or property. No minor shall possess or use a laser pointer except under the direct supervision and control of the minor's parents, legal guardian, or other adult authorized by the parent or legal guardian to exercise such supervision. Section 9.69.040. Enforcement. Any person violating the provisions of Section 9.69.020 or 9.69.030 of this Ordinance shall be guilty of a misdemeanor or an infraction, and upon conviction thereof shall be punished by a fine of not more than $500 (Five Hundred and no/100 Dollars) or imprisonment in the county jail for a period of not more than six (6) months, or by both such fine and imprisonment. Minors shall be dealt with in accordance with juvenile court law and procedure. Upon conviction of any person of a violation of any of these sections, the device shall be deemed a nuisance and disposed of by the law enforcement personnel. Section 9.69.050. Conflict Resolution. If any section, paragraph, clause, phrase or part of this Ordinance is for any reason held invalid, such decision shall not affect the validity of the remaining provisions of this Ordinance. All ordinances or parts of ordinances in conflict with the provisions of this Ordinance are hereby repealed insofar as they conflict." RWua\DJE\azss -2- ORDINANCE NO. 916 • Section 2. The City Clerk shall certify to the passage and adoption of this Ordinance and shall cause the same to be published once in the Desert Sun, a newspaper of general circulation, printed, published and circulated within the City of Palm Desert, and the same shall be in full force and effect immediately upon its adoption.
