1) Approve Contract No. C22580 with Coachella Valley
Construction Services, LLC, in an amount not to exceed
$50,000.00 to perform constructability reviews of various
Capital Improvement Projects on an as needed basis.
2) Authorize the Mayor to execute the subject agreement.
Discussion:
On March 17, 2004, staff requested proposals from several consultants to
provide constructability reviews of upcoming Capital Improvements Projects
scheduled for construction in the summer of 2004. Projects planned for
construction that we would anticipate the availability of such reviews are as
follows:
• Dinah Shore and Portola Avenue Extension
• Fred Waring Widening from Deep Canyon to Washington Street
• Portola Avenue, Cook Street, and Country Club Storm Drain and
Traffic Signal Improvements

These reviews are essential in ensuring cost-effective projects, by eliminating
costly construction mistakes, errors, omissions or confusing detail on the design
plans. Having these reviews we will minimize change orders, claims, and assure
clarity to specification and plan ambiguities.
In response to our request for proposals, the following consultants responded:
RBF Consulting (Palm Desert, California)
The Keith Companies (Palm Desert, California)
Coachella Valley Construction Services, LLC (Indio, California)
After careful evaluation of each firm's qualifications in relation to the tasks
required, staff recommends Coachella Valley Construction Service, LLC, as the
most qualified.
Funds are available for this work in the various capital improvement project
accounts.
Therefore, staff recommends that City Council, by minute motion, approve the
subject contract with Coachella Valley Construction Service, LLC, in an amount
not to exceed $50,000.00, and authorize the Mayor to execute the agreement.

AGREEMENT
THIS AGREEMENT, made and entered into this 8th day of April, 2004, by and
between THE CITY OF PALM DESERT, a municipal corporation, hereinafter referred to
as "CITY" and Coachella Valley Construction Services, LLC, hereinafter referred to as
"CONSULTANT".
WITNESSETH:
WHEREAS, CONSULTANT is a corporation, the principal members of which are
Professional CONSULTANTS duly registered under the laws of the State of California;
and
WHEREAS, CITY desires to engage CONSULTANT to render certain technical
and professional CONSULTANTING services as set forth in Exhibit "A"
(CONSULTANT'S Proposal of Services) in connection with the Constructability Review
of Various Capital Improvement Projects.
NOW, THEREFORE, the parties hereto agree as follows:
(1) CITY hereby agrees to engage CONSULTANT to perform the
technical and/or professional services as hereinafter set forth.
(2) CONSULTANT shall perform all work necessary within the
schedules provided herein to complete the services set forth in Exhibit "A" attached
hereto and by reference incorporated herein and made a part hereof.

(3) All information, data, reports and records and maps as are existing
and available from the CITY and necessary for the carryings out of the work outlined in
Exhibit "A" hereof shall be furnished to CONSULTANT without charge by CITY and
CITY shall cooperate in every way reasonable in the carrying out of the work without
delay.
(4) CONSULTANT represents that, it employs or will employ at its own
expense, all personnel required in performing the services under this Agreement.
(5)
All of the services required hereunder will be performed by
CONSULTANT or under its direct supervision, and all personnel engaged in the work
shall be qualified and shall be authorized or permitted under state and local law to
perform such services.
(6) The execution of this Agreement by the parties hereto does not
constitute an authorization to proceed. CITY's Director of Public Works has not
authorized CONSULTANT to proceed.
(7) The CONSULTANT shall work closely with the CITY's Director of
Public Works, or his designated representative, who shall be the principal officer of the
CITY. The CONSULTANT shall review and receive the Director of Public Works
approval of the details of work as it progresses. The CONSULTANT hereby designated
by the CONSULTANT as its representative for supervision of the work required by this
Agreement is David A. Cordero.
(8) The CONSULTANT warrants that he has not employed or retained
any company or person, other than a bona fide employee working solely for the
consultant, to solicit or secure this Agreement, and that he has not paid or agreed to

pay any company or person, other than a bona fide employee working solely for the
consultant, any fee, commission, percentage, brokerage fee, gifts, or any other
consideration, contingent upon or resulting from the award or making of this Agreement.
For breach or violation of this warranty, CITY shall have the right to annul this
Agreement without liability, or in its discretion to deduct from the contract price or
consideration, or otherwise recover, the full amount of such fee, commission,
percentage, brokerage fee, gift or contingent fee.
(9)
The right is reserved by the CITY to terminate the Agreement at
any time upon seven (7) days written notice, in the event the project is to be abandoned
or indefinitely postponed, or in the event the CONSULTANT'S services, in the sole
judgment of CITY, are unsatisfactory or because of the CONSULTANT'S failure to
prosecute the work with diligence or within the time limits specified or because of his
disability or death. In any such case, the CONSULTANT shall be paid the reasonable
value of the services rendered, based upon CONSULTANT'S standard hourly rates, up
to the time of the termination. The CONSULTANT shall keep adequate records to
substantiate costs and provide copies of original timecards in the event of termination or
suspension.
(10) All documents including tracings, drawings, estimates, reports,
investigations and computations shall be delivered to and become the property of the
CITY. CITY acknowledges and agrees that all plans, specifications, reports and other
documents prepared by CONSULTANT pursuant to this agreement shall be used
exclusively on this project and shall not be used for any other work without the written
consent of CONSULTANT. In the event CITY and CONSULTANT permit the re -use or

other use of the plans, specifications, reports or other documents, CITY shall require the
party using them to indemnify and hold harmless CITY and CONSULTANT regarding
such re -use or other use, and CITY shall require the party using them to eliminate any
and all references to CONSULTANT from the plans, specifications, reports and other
documents.
(11) The CONSULTANT shall comply with all federal, state and local
laws, ordinances and regulations applicable to work.
(12) No change in the character or extent of the work to be performed
by the CONSULTANT shall be made except by supplemental authority in writing
between CITY and the CONSULTANT. The supplemental authority shall set forth the
changes of work, extension of time and adjustment of the fee to be paid by CITY to the
CONSULTANT, if any.
(13) In connection with the execution of this Agreement, the
CONSULTANT shall not discriminate against any employee or applicant for
employment because of race, religion, color, sex or national origin. The CONSULTANT
shall take affirmative actions to insure equal employment opportunity and that
employees are treated during their employment without regard to their race, religion,
color, sex or national origin. Such actions shall include, but not limited to, the following:
employment, upgrading, demotion or transfer; recruitment or recruitment advertising;
layoff or termination; rates of pay, or other forms of compensation and selection for
training, including apprenticeship. This clause shall be included in each related
subcontract, if any, awarded by the CONSULTANT.

(14) The CITY agrees to pay the CONSULTANT for the work required
by this Agreement on the following basis:
CONSULTANT shall submit invoices monthly for services performed in
the previous month not to exceed the total contract amount NOT TO EXCEED : FIFTY
THOUSAND DOLLARS AND NO/00 ($50,000.00). CITY agrees to pay all undisputed
invoices within thirty (30) days of receipt of invoice. CITY agrees to notify
CONSULTANT of disputed invoices within fifteen (15) days of receipt of said invoice.
(15) The CONSULTANT agrees to complete the work and submit the
CONSTRUCTABILITY REVIEW as displayed in Exhibit "A".
(16) In the event that any judgment is entered in any action upon this
Agreement, the party hereto against whom such judgment is rendered agrees to pay the
other party an amount equal to the reasonable value of the legal services performed in
his or its behalf in such action and that such amount may be added to and made a part
of such judgment.
(17) This Agreement shall be binding on the successors and assigns of
the parties, but it shall not be assigned by the CONSULTANT without written consent of
the CITY.
(18) The CONSULTANT shall be an independent contractor, not an
employee of the CITY.
(19) Prohibited interests are as follows:
No officer, member or employee of the CITY during his tenure or one year
thereafter shall have any interest, direct or indirect, in this Agreement or the proceeds
thereof. The parties hereto covenant and agree that to their knowledge no member of

the City Council, officer or employee of the CITY has any interest, whether contractual,
non -contractual, financial or otherwise, in this transaction, or in business of the
contracting party other than the CITY, and that if any such interest comes to the
knowledge of either party at any time a full and complete disclosure of all such
information will be made in writing to the other party or parties, even if such interest
would not be considered a conflict of interest under applicable laws.
The CONSULTANT hereby covenants that he has, at the time of this
Agreement, no interest, and that he shall not acquire any interest in the future, direct or
indirect, which would conflict in any manner or degree with the performance of services
required to be performed pursuant to this Agreement. The CONSULTANT further
covenants that in the performance of this work no person having any such interest shall
be employed by the CONSULTANT.
(20) The CONSULTANT shall indemnify and save harmless the CITY,
its officers and employees from and against any liability, Toss, cost or expense resulting
from any injury or damage to persons or property caused by the negligent acts or
omission of the CONSULTANT, its agents or employees, while engaged in the
performance of this Agreement. The CONSULTANT shall submit to CITY, prior to the
Notice to Proceed is issued, certification of adequate coverage for "errors and omission"
insurance in amounts approved by the City Attorney. Any such insurance shall not be
canceled prior to written notice to and approval from the CITY.
(21) In case of conflicts within the contract documents, the document
precedence shall be as follows:

Re: Proposal to Provide Constructability Review Services for the City of Palm
Desert's Capital Improvement Projects
Dear Mr. Rodriguez,
Coachella Valley Construction Services, LLC (CVCS) is pleased to respond to your request for a proposal to
perform constructability review services for the City of Palm Desert's Capital Improvement Projects.
Coachella Valley Construction Services, LLC is a company developed to provide project support to the public
works and private sector participating in the vast and rapid growth of infrastructure in the Coachella Valley.
CVCS provides services intended to assist the construction sector with project planning and development.
CVCS specializes and offers the following Pre -bid Construction Support Services as part of the
Constructability Review element:
• Detailed Review and Analysis of Design Drawings.
• Detailed Review and Analysis of Referenced Specifications and the Contract Documents.
• Quantity Take -off Verification.
• Construction Budget Review.
• Construction Estimating.
• Construction Scheduling.
• Value Engineering.
CVCS provides questions, comments and recommendations related to the clarity, consistency, and thoroughness
of design as it relates to the plans, referenced specifications, contract documents, budget estimates, scheduling
and construction. Additionally, CVCS provides an independent document review and plan check making
corrections to confusing, conflicting and/or ambiguous language, construction details, quantities and
construction notes.
Our objective is to review plans and specifications for these potential errors or omissions that may be costly to
the project after the award of a contract, and to bring these to the agencies attention prior to the bidding
process. These "risk reducing services" are intended to assist the agency with project budgeting and project
cost control during the planning stage.
Another service provided by CVCS is "value engineering". During plan review, value -engineering alternatives
are recommended, related to material utilization and/or methods of construction, relative to their effectiveness,
efficiency, economy and life cycle in today's market prices. This service can prove to be a "cost savings
service" should value engineering alternative options become available to a given project.
Coachella Valley Construction Services, LLC
CVCS also offers Construction Management Services with the following specific project tasks as part of its
construction support services during the construction phase of a project:
Construction Management (Daily Activities)
• Project site -visit for contractor and owner interaction to verify contractor activities and construction
progress as it relates to the project plans, specifications, contract documents, project schedule,
project safety and cleansiness.
• Verification and review of contractor material, labor and equipment utilization.
• Review of daily inspection reports as provided by the project inspector.
• Review of project correspondence including: material submittal requirements, project schedules,
weekly schedule up -dates, RFI's, change orders, etc.
• Coordination of participating utility agencies, agency inspectors and/or representatives to facilitate
construction progress.
Construction Management (Weekly Activities)
• Weekly Construction Progress Meeting with the contractor and agency/owner personnel. At these
weekly meetings participants will review an agenda which discusses the projects progress relative
to the following items:
• Project schedule.
• Construction activity updates.
• Statement of working days or remaining time for completion.
• Review and response to new and outstanding action items and/or project concerns.
• Project safety, traffic control, cleansiness and appearance.
• Weekly Project Photos are produced to verify contractor activities, construction progress, and the
projects commitment to project safety, traffic control, cleansiness and appearance.
Construction Management (Monthly Activities1
• Schedule of Values review and verification.
• Change Order review and verification.
• Extra Work review and verification.
• Field Quantity review and verification.
• As -built Drawing review and verification.
• Progress Payment/Payment Requisition review and verification.
These services are intended to assist the agency with contract administrative requirements specific to the
contract, relative to the start, progress, and successful completion of a project.

Statement of Experience and Qualifications
David A. Cordero - President
David A. Cordero is the founder and president of Coachella Valley Construction Services, LLC. Mr. Cordero has
over 13 years of experience in public works, state, federal and private construction contracting. He has served
as an active estimator and construction manager for various projects throughout Southern California currently
participating in the vast growth of infrastructure projects and site work developments of the Coachella Valley,
since 1995.
Mr. Cordero's educational background consists of a Bachelor of Science Degree in Construction Engineering
Management from California State University, Long Beach and an Associate of Science Degree in Materials
Engineering Technology from Don Bosco Technical Institute, Rosemead, CA. Additionally, Mr. Cordero is
currently finalizing the acquisition of a State of California Class A Contractors License and initializing the
formation of a general engineering construction company.
Mr. Cordero has served in various management positions obtaining and applying his experience with a diverse
group of contractors that specialize in the various trades of civil construction. These contractors include
Southern California Underground Contractors, Brea, CA., Granite Construction Company, Indio, CA., and
Dateland Construction Company, Coachella, CA.
Mr. Cordero specializes in street improvements; including excavation, grading, asphalt paving and concrete.
Underground utility construction including; sewer, water, storm drain, fire -line and dry utilities for public works,

roadway widening, bridge widening, storm drain improvements, retaining and masonry block wall
improvements, landscape and irrigation improvements, street removal items including asphalt, concrete,
drainage and other existing facilities, street improvements including grading, excavation, aggregate base, and
asphalt paving, median re -construction, concrete improvements such as curb and gutter, sidewalk, ribbon
gutter, and stamped concrete, traffic striping and marking items, traffic control items, inter -connect items and
traffic signal modifications.

Construction Management Services are based on forty (40) hours per week for the duration of
a project in order to fulfill the specific tasks described in the construction management section of this
proposal. Specific tasks associated with construction management may be modified and outlined upon
request to better serve any given project and/or requirement.
Schedule of Hourly Billing Rates Effective April 01, 2004
• Construction Manager $125.00/Hour
• Assistant Construction Manager $ 95.00/Hour
• Inspector/Observer $ 75.00/Hour
• Project Assistant $ 65.00/Hour
• Administrative Assistant $ 25.00/Hour
Payment for Services
The Payment for services lasting less than one month is due and paid in two installments. The first installment
shall be 30% of the quoted agreed amount, and due at the beginning of the service. The second and final
balance is due upon completion of the work prior to the release of information to the client. For services lasting
more than one month, the first installment shall be 30% of the quoted agreed amount, and due at the
beginning of the service. The balance will be invoiced on a bi-weekly basis. Payment will be required upon
receipt of the invoice. Please note that alternate payment terms may acceptable by mutual agreement.
