Request to amend Ordinance Nos. 750 and 751 exempting
Homme/Adams Park and Cahuilla Hills Park from the leash
requirement for dogs, adding the definition of "dogs under immediate
voice control" and prohibiting dogs from the Randall Henderson Trail
area.

Recommendation:
By minute motion, that the City Council waive further reading and pass to second
reading Ordinance No.1064amending Ordinance Nos. 750 and 751 Sections
11.01.010 and 11.01.120 exempting Homme/Adams Park and Cahuilla Hills Park
from the leash requirement for dogs, adding the definition of "under immediate voice
control" and prohibiting dogs from the Randall Henderson Trail area.
Executive Summary:
This proposed amendment to the Palm Desert Municipal Code will remove the leash
requirement for dog owners who use Homme/Adams Park and Cahuilla Hills Park and
allow dogs to be under immediate voice control. This amendment also adds a section
prohibiting dogs from the Randall Henderson Trail area. Both items were included as part
of the approval of the Hopalong Cassidy Trail, Gabby Hayes Trail, Homestead Trail and
Randall Henderson Trail. This amendment will codify the changes and allow the City to
enforce the new regulations.
Discussion:
On January 23, 2003, the City Council approved the Hopalong Cassidy Trail, Gabby Hayes

Trail, Homestead Trail and Randall Henderson Trail. One of the mitigation measures
associated with the approved Environmental Assessment is the prohibition of dogs in the
Randall Henderson Trail area south of the Santa Rosa and San Jacinto Mountains
National Monument Visitor Center.
Homme/Adams Park and Cahuilla Hills Park were approved for dogs under immediate
voice control as opposed to requiring leashes. These areas have historically been used by
the local residents as an off -leash area. Immediate voice control is defined as the dog
being within 50' of the owner and the dog immediately obeys voice commands or signals.
This definition has been taken from United States Forest Service regulations and has been
adopted by a number of other jurisdictions in California including the cities of Del Mar and
San Francisco. Dogs are required to be leashed on the trail once they leave City property
and enter Bureau of Land Management property. Appropriate signage will be installed
which indicates where leashes are required.
The proposed amendments to Chapter 11 of the Municipal Code are:
• That the following definition be added to Section 11.01.010:
"Under immediate voice control" means the dog or dogs is within 50 feet of
the owner and the dog or dogs immediately obeys voice commands or
signals.
• That the following be added to Chapter 11.01.120 (A):
5. Homme/Adams Park and Cahuilla Hills Park are designated as 'under
immediate voice control' facilities
6. Dogs are prohibited in the Randall Henderson Trail area
Staff recommends that the City Council waive further reading and pass the above
ordinance amendments to second reading.

ORDINANCE NO.1064
AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF PALM
DESERT, CALIFORNIA, AMENDING SECTIONS 11.01.010 AND
1 1.01 .120 OF THE CODE OF PALM DESERT, CALIFORNIA
The City Council of the City of Palm Desert, California does hereby ordain as
follows:
Section 1. That sections 1 1 .01.010 and 1 1.01 .120 (A) of the Code of the
City of Palm Desert, California, being the same are hereby
amended to read as follows:
"11.01.010 Definitions
L. Under immediate voice control means the dog or dogs is within
50 feet of the owner and the dog or dogs immediately obeys
voice commands or signals.
1 1 .010.120(A) Duty to care for animals
5. Homme/Adams Park and Cahuilla Hills Park are designated as
'under immediate voice control' facilities.
6. Dogs are prohibited in the Randall Henderson Trail area."
Section 2. City Clerk shall certify the passage and adoption of this
Ordinance and shall cause same to be published once in a
newspaper of general circulation within the City of Palm Desert,
California. It shall be in full force and effective thirty (30) days
after its adoption.
PASSED, APPROVED and ADOPTED at a regular meeting of the Palm Desert City
Council, held on this day of , 2003, by the following vote, to
