HomeMy WebLinkAboutRes 04-23 Providing Workers Compensationfor Certain City VolunteersCITY OF PALM DESERT COMMUNITY SERVICES DEPARTMENT STAFF REPORT REQUEST: REQUEST FOR ADOPTION OF RESOLUTION PROVIDING WORKERS' COMPENSATION COVERGE FOR CERTAIN CITY VOLUNTEERS DATE: April 8, 2004 CONTENTS: RESOLUTION NO. 04-23 Recommendation: Waive further reading and adopt Resolution No. 04-23 relative to providing workers' compensation insurance coverage for volunteer members of the Sister Cities Program Official Delegation. Executive Summary: After reviewing the parameters of the insurance coverage, staff has determined that it would be in the City's best interest to provide workers' compensation coverage to certain individuals, who are part of any Sister Cities Official Delegation, and who are not employed by the City, or one of the City's Public Safety contractors. Background: The City of Palm Desert's Risk Manager is recommending that the Council adopt a resolution, which will provide coverage for the individuals participating in the Sister Cities Program, which will insure them as they travel to and from the location where the specific activities will take place. The individuals are those who are designated by the City Council to be part of the Official Delegation, and who are traveling using funds provided by the City, and who are not employees of the City or the City's Public Safety contractors. This activity can be accomplished through authorization of the Southern California Joint Powers Insurance Authority, which is the entity responsible for addressing insurance issues of this nature on behalf of the City of Palm Desert. Therefore, staff recommends that the RESOLUTION NO. 04-23 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PALM DESERT, CALIFORNIA, PROVIDING WORKERS' COMPENSATION COVERAGE FOR CERTAIN CITY VOLUNTEERS PURSUANT TO THE PROVISIONS OF SECTION 3363.5 OF THE LABOR CODE WHEREAS, the City of Palm Desert finds its best interest will be served by utilizing volunteers in the provision of certain government services; specifically the Sister Cities Program. WHEREAS, said Sister Cities Program volunteers should be eligible for workers' compensation insurance while on duty and traveling to and from duty; and NOW THEREFORE, BE IT RESOLVED that the City Council of the City of Palm Desert does hereby: 1. Find and determine that the public interest is best served by providing workers' compensation coverage for Sister Cities Program volunteer workers as specified by the City Manager; and 2. Provide eligibility for said volunteers for workers' compensation benefits which will be applicable during the time the person actually performs volunteer services and travels to and from those services, provided, however, that the rights of volunteers shall be limited as set forth in the Labor Code.
