PP04-14 Page 2 August 26, 2004 Executive Summary: The applicant is requesting approval of a precise plan and height exception to construct a 19,565 square foot showroom/warehouse with vehicle storage yard on a 1.14 acre parcel. The height exception request is forthe entry tower element which is proposed at 35 feet and exceeds the 30 foot height limit. The subject parcel is within the recently approved master plan forthe Valley Center Business Park which is located at the northeast corner of Cook Street and Gerald Ford Drive. The Planning Commission considered this request at their public hearing held on July 20, 2004 and unanimously recommended approval. Discussion: I. BACKGROUND: A. Adjacent Zoning and Land Use: North: Southern Pacific Railroad, Interstate 10 South: PR-5/vacant (Cal State campus) East: PCD/vacant West: PCD/ vacant B. General Plan Designation: Industrial - Business park C. Site Description: This 1.14 acre parcel is within the recently approved 21.86 acre site is generally located at the northeast corner of Cook Street and Gerald Ford Drive. The site is vacant with minimal vegetation and slopes from south to north. Staff Report PP04-14 Page 3 August 26, 2004 II. DISCUSSION: A. Project Description: The applicant is requesting approval to construct a two story, 19,565 square foot showroom/warehouse with associated vehicle storage yard. The building uses include 6,313 square feet of retail space, 3,487 square feet of office use and 9,405 square feet of warehouse. The vehicle storage yard will be open during business hours and will be used after hours for securing business vehicles only. Storage of materials (tile, etc.) will not be permitted. B. Access and Circulation Access to the center is via three ingress/egress points along Gerald Ford Drive. Access to this site will be via future right driveway which will run along the east side of the parcel and via the future interior drive aisles which run along the north and west side of the building. C. Architecture and Landscaping The architecture is contemporary in style and utilizes a tile roof at the entry tower, colored precast concrete, overgrouted limestone, natural cantera stone and tile accents. Building colors include off-white, tan, brown, and terra cotta. The building includes a wood trellis and water feature at the entrance. Roll -up doors are shown on the north side of the building facing away from Gerald Ford Drive. The building height is 30' except for the entry tower which is proposed at 35'. The landscape plan is being refined and coordinated with the landscape plan for the rest of the center. and will be submitted for approval in the near future. The proposed plan provides 8095 square feet of landscaping or 17% of the parcel. This meets the 15% requirement of zone. The Architectural Review Commission granted the project preliminary architectural approval at its May 25,2004 meeting. Staff Report PP04-14 Page 4 August 26, 2004 D. ANALYSIS: Project 61 feet 35 feet* 17% 31.8% 58 spaces The proposed 19,565 square foot showroom/warehouse meets all of the code requirements with the exception of the 35'-0" height for the entry tower. The majority of the building ranges in height from 28'-0" to 30'-0" which provides for adequate clearance and storage area forthe industrial use. The exception forthe entry tower is warranted as it encompasses less than 10% of the structure and serves as an effective architectural element by enhancing the building frontage along Gerald Ford Drive. IV. CEQA REVIEW: The Director of Community Development has determined that the proposed project has been previously assessed for purposes of CEQA and no further study is necessary. The project is within the fee area established by the Coachella Valley Fringe -Toed Lizard Habitat Conservation Plan. It is also in the historical habitat of a number of other plant and animal species being considered for listing as threatened or endangered. To avoid their future listing, a Multi Species Habitat Conservation Plan (MSHCP) is being prepared through CVAG which will provide Tong -term protection through the creation of preserves. A $600/acre fee will be imposed to mitigate the Toss of Fringe -Toed Lizard Habitat. The project will also be subject to any additional mitigation requirements of the MSHCP which may be in effect at the time of development. Staff Report PP04-14 Page 5 August 26, 2004 V. Conclusion: The project is consistent with the previously approved master plan and the Industrial/Business Park designation as identified in the City's updated general plan. The architecture is compatible with existing and approved architecture for the Valley Center Business Park. The proposed precise plan will comply with each of the applicable provisions of this title, except for approved exceptions permitted through the development agreement process. 2. The proposed location of the proposed use and the conditions under which it will be operated and maintained will not be detrimental to the public health, safety or general welfare, or be materially injurious to properties or improvements in the vicinity. 3. The development of the property shall conform substantially with exhibits on file with the department of community development/planning, as modified by the following conditions: 2. Construction of a portion of said project shall commence within one yearfrom the date of final approval unless an extension of time is granted; otherwise, said approval shall become null, void and of no effect whatsoever. 3. The development of the property described herein shall be subject to the restrictions and limitations set forth herein which are in addition to all municipal ordinances and state and federal statues now in force, or which hereafter may be in force. 4. Prior to issuance of a building permit for construction of any use contemplated by this approval, the applicant shall first obtain permit and/or clearance from the following agencies: Coachella Valley Water District City Fire Marshal Public Works Department Evidence of said permit or clearance from the above agencies shall be presented to the department of building and safety at the time of issuance of a building permit for the use contemplated herewith. 5. Access to trash/service areas shall be placed so as not to conflict with parking areas. Said placement shall be approved by applicable trash company and department of community development and shall include provisions for recycling. 6. All future occupants of the buildings shall comply with parking requirements in section 25.58 of the zoning ordinance. 3 RESOLUTION NO. 7 Applicant agrees to maintain the landscaping required to be installed pursuant to these conditions. Applicant will enter into an agreement to maintain said landscaping forthe life of the project, which agreement shall be notarized and which agreement shall be recorded. It is the specific intent of the parties that this condition and agreement run with the land and bind successors and assigns. The final landscape plan shall include a Tong -term maintenance program specifying among other matters appropriate watering times, fertilization and pruning for various times of the year for the specific materials to be planted, as well as periodic replacement of materials. All to be consistent with the Property Maintenance Ordinance (Ordinance No. 801) and the approved landscape plan. 8. The vehicle storage yard shall remain open for public use during business hours. No outdoor storage of materials is permitted. 9. A detailed parking lot and field lighting plan shall be submitted to staff for approval, subject to applicable lighting standards. Plan to be prepared by a qualified lighting engineer. 10. All sidewalk plans shall be reviewed and approved by the department of public works prior to architectural review commission submittal. 11. The project shall be subject to all applicable fees at time of issuance of building permits including, but not limited to, Art in Public Places, Fringed -Toed Lizard, TUMF, School Mitigation and Housing Mitigation fees. 12. All rooftop equipment shall be fully screened from view. Department of Public Works 1. Drainage fees, in accordance with Section 26.49 of the Palm Desert Municipal Code and Ordinance 653, shall be paid prior to the issuance of a grading permit. The project shall be designed to retain storm waters associated with the increase in developed vs. undeveloped condition for a 100 year storm. Any drainage facility construction required for this project shall be contingent upon a drainage study prepared by a registered civil engineer that is reviewed and approved by the Department of Public Works prior to start of construction. 4 RESOLUTION NO. 2. Signalization fees, in accordance with City of Palm Desert Resolution Nos. 79-17 and 79-55, shall be paid prior to issuance of any permits associated with this project. 3. The project shall be subject to Transportation Uniform Mitigation Fees (TUMF). Payment of said fees shall be at the time of building permit issuance. 4. A complete preliminary soils investigation, conducted by a registered soils engineer, shall be submitted to, and approved by, the Department of Public Works prior to the issuance of a grading permit. 5. All public and private improvements shall be inspected by the Department of Public Works and a standard inspection fee shall be paid prior to issuance of grading permits. 6. Any and all offsite improvements shall be preceded by the approval of plans and the issuance of valid encroachment permits by the Department of Public Works, and shall be completed prior to the issuance of any certificate of occupancy for the project. 7 As required under Palm Desert Municipal Code Section 26.28, and in accordance with Sections 26.40 and 26.44, complete improvement plans and specifications shall be submitted to the Director of Public Works for checking and approval before construction of any improvements is commenced. Offsite improvement plans are to be approved by the Public Works Department and a surety posted to guarantee the installation of required offsite improvements prior to permit issuance. 8. Landscape installation on the property frontages as well as on -site shall be drought tolerant in nature and maintenance shall be performed by the property owner(s). 9. Applicant shall comply with the provisions of Municipal Code Section 24.12, Fugitive Dust Control and Section 24.20, Stormwater Management and Discharge Control. Developer shall contact the Riverside County Flood Control District for informational materials. 10. In accordance with Palm Desert Municipal Code Section 26.44, complete grading plans/site improvement plans and specifications shall be submitted to the Director of Public Works for checking and approval prior to issuance of any permits. Preliminary landscape plans shall be submitted concurrently with grading plans. 5 RESOLUTION NO. 11. Proposed building pad elevations are subject to review and modification in accordance with Chapter 27 of the Palm Desert Municipal Code. 12. Full public improvements, as required by Sections 26.40 and 26.44 of the Palm Desert Municipal Code, shall be installed in accordance with applicable City standards and the city's Circulation Network. Those improvements shall include, but not be limited to the following: ► Installation of an 8' wide concrete sidewalk on Gerald Ford Drive. Installation of one-half width of a raised median island along the project frontage. The project may provide a cash payment in -lieu of construction for the required median island. Rights -of -way and/or easements necessary for the installation of the above referenced improvements shall be conveyed to the city prior to the issuance of any permits associated with this project. 13. The project driveway located at the east property line shall be limited to right turn ingress and egress, and left turn ingress only. A reciprocal access agreement shall be executed with adjacent properties. Said agreement shall include provisions for payment of a proportionate share of maintenance costs on the approved access route to the traffic signal approved with PP/CUP 01-21. 14. Traffic safety striping on Gerald Ford Drive shall be provided to the specifications of the Director of Public Works. A traffic control plan must be submitted to, and approved by, the Director of Public Works prior to the placement of any pavement markings. 15. Complete parcel map shall be submitted as required by ordinance to the Director of Public Works for checking and approval prior to the issuance of any permits. 16. Driveway at eastern end of parking lot shall have a 100 foot minimum distance from curbline to first break in the landscaped median. Fire Department Conditions 1. With respect to the conditions of approval regarding the above referenced project, the fire department recommends the following fire protection measures be provided in 6 RESOLUTION NO. accordance with City Municipal Code, NFPA, CFC and CBC or any recognized Fire Protection Standards: The Fire Department is required to set a minimum fire flow for the remodel or construction of all buildings per UFC article 87. 2. A fire flow of 1500 gpm for a 1-hour duration at 20 psi residual pressure must be available before any combustible material is placed on the job site. 3. Provide or show there exists a water system capable of providing a gpm flow of 3000 gpm for commercial buildings. 4. The required fire flow shall be available from a wet barrel Super Hydrant(s) 4" x 2'/2" x 2'/2" located not less than 25' nor more than 150' from any portion of a commercial building measured via vehicular travelway. 5. Water Plans must be approved by the Fire Marshal and include verification that the water system will produce the required fire flow. 6. Install and complete NFPA 13 fire sprinkler system. This applies to all buildings with a 3000 square foot total cumulative floor area. The fire Marshal shall approve the locations of all post indicator valves and fire department connections. All valves and connections shall not be less than 25' from the building within 50' of an approved hydrant. Exempted are one and two family dwellings. 7 All valves controlling the water supply for automatic sprinkler systems and Water -flow switches shall be monitored and alarmed per UBC chapter 9. 8. Install a fire alarm system as required by the UBC Chapter 3. 9. Install portable fire extinguishers per NFPA 10, but not less than one 2A10BC extinguisher per 3000 square feet and not over 75' from walking distance. A'K'type fire extinguisher is required in all commercial kitchens. 10. Install a Hood/Duct automatic fire extinguisher system per NFPA 96 in all public and private cooking operations except single-family residential usage. 11. All building shall be accessible by an all-weather roadway extending to within 150' of all portions of the exterior walls of the first story. The roadway shall not be less than 24' of unobstructed width and 13'6" of vertical clearance. Where parallel parking is 7 RESOLUTION NO. required on both sides of the street the roadway must be 36' wide and 32' wide with parking on one side. Dead-end roads in excess of 150' shall be provided with a minimum 45' radius turn -around 55' in industrial developments. 12. This project may require licensing by a state or county agency, to facilitate the plan review the applicant shall prepare and submit to the Fire Marshal a letter of intent detailing the proposed usage and occupancy type. 13. All buildings shall have illuminated addresses of a size approved by the city. 14. All fire sprinkler systems, fixed fire suppression systems and alarm plans must be submitted separately tot he Fire Marshal for approval prior to construction. 15. Conditions subject to change with adoption of new codes, ordinances, laws, or when building permits are not obtained within twelve months. 16. If there is an elevator, it must be gurney size. 17. Applicant shall comply with the provisions of Municipal Code Section 24.12, Fugitive Dust Control and Section 24.20, Stormwater Management and Discharge Control. Developer shall contact the Riverside County Flood Control District for informational materials. 10. In accordance with Palm Desert Municipal Code Section 26.44, complete grading plans/site improvement plans and specifications shall be submitted to the Director of Public Works for checking and approval prior to issuance of any permits. Preliminary landscape plans shall be submitted concurrently with grading plans. 11. Proposed building pad elevations are subject to review and modification in accordance with Chapter 27 of the Palm Desert Municipal Code. 12. Full public improvements, as required by Sections 26.40 and 26.44 of the Palm Desert Municipal Code, shall be installed in accordance with applicable City standards and the city's Circulation Network. Those improvements shall include, but not be limited to the following: ► Installation of an 8' wide concrete sidewalk on Gerald Ford Drive. 5 PLANNING COMMISSION RESOLUTION NO. 2277 ► Installation of one-half width of a raised median island along the project frontage. The project may provide a cash payment in -lieu of construction for the required median island. Rights -of -way and/or easements necessary for the installation of the above referenced improvements shall be conveyed to the city prior to the issuance of any permits associated with this project. 13. The project driveway located at the east property line shall be limited to right tum ingress and egress, and left turn ingress only. A reciprocal access agreement shall be executed with adjacent properties. Said agreement shall include provisions for payment of a proportionate share of maintenance costs on the approved access route to the traffic signal approved with PP/CUP 01-21. 14. Traffic safety striping on Gerald Ford Drive shall be provided to the specifications of the Director of Public Works. A traffic control plan must be submitted to, and approved by, the Director of Public Works prior to the placement of any pavement markings. 15. Complete parcel map shall be submitted as required by ordinance to the Director of Public Works for checking and approval prior to the issuance of any permits. 16. Driveway at eastern end of parking lot shall have a 100 foot minimum distance from curbline to first break in the landscaped median. Fire Department Conditions 1. With respect to the conditions of approval regarding the above referenced project, the fire department recommends the following fire protection measures be provided in accordance with City Municipal Code, NFPA, CFC and CBC or any recognized Fire Protection Standards: The Fire Department is required to set a minimum fire flow for the remodel or construction of all buildings per UFC article 87. 2. A fire flow of 1500 gpm for a 1-hour duration at 20 psi residual pressure must be available before any combustible material is placed on the job site. 3. Provide or show there exists a water system capable of providing a gpm flow of 3000 gpm for commercial buildings. 6 PLANNING COMMISSION RESOLUTION NO. 2277 4. The required fire flow shall be available from a wet barrel Super Hydrant(s) 4" x 2 '/2" x 2 1/2" located not less than 25' nor more than 150' from any portion of a commercial building measured via vehicular travelway. 5. Water Plans must be approved by the Fire Marshal and include verification that the water system will produce the required fire flow. 6. Install and complete NFPA 13 fire sprinkler system. This applies to all buildings with a 3000 square foot total cumulative floor area. The fire Marshal shall approve the locations of all post indicator valves and fire department connections. All valves and connections shall not be less than 25' from the building within 50' of an approved hydrant. Exempted are one and two family dwellings. 7. All valves controlling the water supply for automatic sprinkler systems and Water -flow switches shall be monitored and alarmed per UBC chapter 9. 8. Install a fire alarm system as required by the UBC Chapter 3. 9. Install portable fire extinguishers per NFPA 10, but not less than one 2A10BC extinguisher per 3000 square feet and not over 75' from walking distance. A 'K' type fire extinguisher is required in all commercial kitchens. 10. Install a Hood/Duct automatic fire extinguisher system per NFPA 96 in all public and private cooking operations except single-family residential usage. 11. All building shall be accessible by an all-weather roadway extending to within 150' of all portions of the exterior walls of the first story. The roadway shall not be less than 24' of unobstructed width and 13'6" of vertical clearance. Where parallel parking is required on both sides of the street the roadway must be 36' wide and 32' wide with parking on one side. Dead-end roads in excess of 150' shall be provided with a minimum 45' radius turn- around 55' in industrial developments. 12. This project may require licensing by a state or county agency, to facilitate the plan review the applicant shall prepare and submit to the Fire Marshal a letter of intent detailing the proposed usage and occupancy type. 13. All buildings shall have illuminated addresses of a size approved by the city. 14. All fire sprinkler systems, fixed fire suppression systems and alarm plans must be submitted separately tot he Fire Marshal for approval prior to construction. 7 PLANNING COMMISSION RESOLUTION NO. 2277 15. Conditions subject to change with adoption of new codes, ordinances, laws, or when building permits are not obtained within twelve months. 16. If there is an elevator, it must be gurney size. 17. Developer shall provide Fire Marshal with occupancy classification. 8 MINUTES PALM DESERT PLANNING COMMISSION JULY 20, 2004 E. Case No. PP 04-14 - WILLIAM, SHARON, SMITH CONSULTING ARCHITECTS FOR D'MUNDO TILE, Applicant Request for approval of a precise plan and height exception to allow construction of a 19,565 square foot showroom/warehouse and associated vehicle storage yard on a 1.14-acre parcel. Project is generally located approximately 900 feet east of Cook Street on the north side of Gerald Ford Drive, APN 653-410-023 and 025. Mr. Winklepleck outlined the salient points of the staff report, and noted that this is the former location of the ice rink. The project meets all applicable standards with the exception of a small tower element over the entry, which exceeds the 33-foot height limit by two feet. The Architectural Review Committee reviewed and recommended approval of the project. Staff believes that the tower element adds interest to the building, and the majority of the building is proposed at 33 feet in height. Staff recommends that the Commission recommend that the City Council approve the project. There were no questions of staff and Chairperson Jonathan opened the public hearing and asked the applicant to address the Commission. MR. BILL SHARON of Smith Consulting Architects, located at 12-000 El Camino Real in San Diego, explained that the overall height of 33 feet will allow sufficient ceiling height for the interior, and the 35- foot tower element will add interest to the exterior. Mr. Sharon wanted to know who would pay for the street improvements in front, and commented that it 9 MINUTES PALM DESERT PLANNING COMMISSION J U LY 20, 2004 was his understanding that the Valley Center Business Park as a whole would be responsible for the street improvements, with his clients participating in their fair share. He was concerned that the wording of some of the conditions of approval seem to indicate that the applicants individually would be financially responsible for funding street improvements that will benefit the entire business park. Mr. Drell replied that his understanding is that the developer of this tract, Mr. Nobel, is installing the street improvements, so the street improvements must be installed prior to the applicant's commencement of construction activities. There were no other questions and Chairperson Jonathan asked if anyone wished to speak in FAVOR or OPPOSITION to the proposal. There being none, Chairperson Jonathan closed the public hearing and asked the Commission for comments. Commissioner Finerty noted that D'Mundo certainly has insufficient space in their current location, and expressed support for the project. Commissioner Lopez commented that he would normally have reservations about a height exception, but he believes this particular height exception will be compatible in this area. Commissioners Tschopp and Campbell concurred with their fellow Commissioners, as did Chairperson Jonathan. Action: It was moved by Commissioner Finerty, seconded by Commissioner Lopez, approving the findings as presented by staff. Case No. PP 04-13 - EN ENGINEERING FOR LOWE'S HOME IMPROVEMENT, Applicant Request for approval of a precise plan of design and Negative Declaration of Environmental Impact for a 135,152 square foot home improvement center with a 31,048 square foot garden center at the northeast corner of Monterey Avenue and Gerald Ford Drive, 35-850 Monterey Avenue. Mr. Smith outlined the salient points of the staff report. He noted that the Planning Commission is being asked to make a recommendation for approval to the City Council approval, since City Council action is required for the height exceptions that are proposed. He noted that the height exceptions are proposed in order to facilitate the use of the main building at a height which ranges from 27 feet to 32 feet, as well as to allow for architectural projections up to 48 feet in height to improve the building appearance. Mr. Smith noted that one outstanding issue is that Sunline Transit has requested a bus pull out and shelter in the area of the vacant property south of the project's north property line, and Sunline has also requested and obtained a bus stop/shelter on Gerald Ford Drive in front of the Sares Regis apartment project that is immediately adjacent tot the east. City staff believes there are more suitable locations, and that the bus stop/shelter in front of the apartment project should be eliminated in order to minimize impediments to traffic flow.
