Box 4772 Palm Desert, CA 92260 DATE: December 9, 2004 CONTENTS: Vicinity Map Recommendation: By Minute Motion: Authorize the expenditure of $5,000 to the Waring Place Home Owners Association as a landscape replacement settlement — (Project 653-01) Discussion: As part of the Fred Waring widening project (653-01), a sound wall was required for the homeowners in Waring Place on the northeast corner of Cook Street and Fred Waring Drive as a mitigation measure to reduce the noise from the additional traffic. As part of the contract for the construction of the wall, the contractor is required to return the landscape around the wall to the same condition it was in prior to construction. The Waring Place Homeowners Association (HOA) would like to move from a lush landscape to an arid landscape. Instead of replacing in kind the former landscape, the HOA would like to receive a cash payment equal to the cost of replacing the landscape in lieu of the actual plant material. Staff Report Authorize Expenditure for Landscape Mitigation (Project 653-01) Page2of2 December 9, 2004 The City has negotiated a price of $32,750 for the value of the landscape that would be installed under normal circumstances. The contractor is willing to contribute $27,750. The Public Works department would like to cover the additional $5,000 because it is a fair settlement, and it will provide a water efficient landscape along the Fred Waring corridor. Prior to releasing the funds, the City will secure a Final Settlement letter from the Board of Directors of the Waring Place HOA. After the Waring Place HOA receives the funds, they will contract out to have the work done themselves. Funds are available for this expenditure in the Fred Waring widening project account. Therefore, staff recommends that City Council, by minute motion, authorize the expenditure of $5,000 to the Waring Place Home Owners Association as a landscape replacement settlement — (Project 653-01).
