Executive Summary: Approximately two years ago, Caltrans installed No Parking Signs on the west side of Highway 74 at the Art Smith Trailhead at the request of the United States Fish and Wildlife Service. At that time, the City responded by requesting Caltrans to remove the No Parking Signs because they served no traffic safety purpose. Caltrans denied our request at that time, and the No Parking Signs remain in place to this date. We have now received a letter from Caltrans indicating that they need City approval for this no parking zone, and are requesting that we establish an ordinance or resolution to that effect. They indicate that if the City does not concur with the parking restriction they will remove the No Parking Signs. Since the City did not agree with the initial installation of the No Parking Signs, it is recommended that we do not establish an ordinance or resolution and that Staff be directed to forward a letter to Caltrans requesting removal of the No Parking Signs. This letter is regarding the parking restriction that the Department of Transportation (Department) has installed on State Route 74 at the Art Smith Trailhead in the City of Palm Desert. According to the California Vehicle Code Section 22506, restricting parking on a State Highway within a City's jurisdiction, requires a local ordinance or resolution. The Department supports the request from United States Department of Fish and Wildlife Service to restrict parking at the above location so as not to interfere with the lambing season of the Big Horn Sheep. We recommend that the City consider adopting a resolution to restrict parking for this location. If the City does not concur with this proposal, please let us know and we will remove the 'No Parking' signs. If you have any questions or need clarification, please call me at (909) 383-5976.
