Waive Further Reading and Pass to Second Reading Ordinance
No. 1073 Amending Section 3.36.010 of the City of Palm Desert
Municipal Code with Respect to the Area Subject to the Fire
Protection Fund.

Recommendation:
By Minute Motion, authorize:
1) Waive Further Reading and Pass to Second Reading Ordinance No. 1073 .
Executive Summary:
If passed this would allow staff to collect the fire facility fee for new development that
are not in the five minute response area (circle area in map). The fee is used for any
fire facilities needs now and in the future due to the new development. If City Council
chooses not to approve this ordinance the City could not collect this fee.
Discussion:
In 1981 the City adopted Ordinance 266 which allowed the City to collected a fire
protection fee for new development. The map attachment (1981 map) reflected the
areas that fall out of the five minute response time which would require an additional
Fire Station. that were building outside the five minute response areas would be
required to pay the Fire Facility Fee.
In June 1992, after building the Portola Fire Station, the City stopped collecting the Fire
Facility Fee due to meeting the five minute response time within the City limits. Since
then, we have annexed Palm Desert Country Club, Avondale Country Club, North of
Country Club, Crest, Palm Desert Greens and the Costco area. Attached is a revised
map including all areas that we have annexed, with various circles around each of the
three Fire Stations that reflect the areas that are considered to be within the five minute
response time. All areas outside the five minute response areas will now be required to
pay the Fire Facility Fee.
The Ordinance is basically being modified to reflect the revised boundaries of the City
and reflect the area that falls under the five minute response time. The Original
Ordinance 266 was based on the five minute response time of 1981 without the Portola
Fire Station. Staff was instructed that we needed to update the map with a revised five
minute response time map that incorporated the Portola Fire Station. Attached is the
revised attachment of the map exhibit.
Staff recommends that the City Council waive further reading and pass to second
reading Ordinance No. 1073 .

ORDINANCE NO. 1073
AN ORDINANCE OF THE CITY OF PALM DESERT, CALIFORNIA, AMENDING
SECTION 3.36.010 OF THE MUNICIPAL CODE, WITH RESPECT TO THE AREA
SUBJECT TO THE FIRE PROTECTION FUND
WHEREAS, in 1981, the City Council of Palm Desert adopted Ordinance No. 266
establishing a fire protection fund to help fund facilities and equipment required by the demand
for services from new developments in the City. Ordinance No. 266 enacted Section 3.36.010
which levied the fire protection fee on "all developments outside of a 5 minute response time as
identified in Exhibit "A", attached to the Ordinance..."; and
WHEREAS, since the adoption of the fire protection fee, the City of Palm Desert has
annexed additional areas, rendering obsolete Exhibit "A" attached to Ordinance No. 266.
NOW, THEREFORE, the City Council of the City of Palm Desert, California, does
hereby ordain as follows:
Section 1: Section 3.36.010 of the Palm Desert Municipal Code is hereby amended to
replace the Exhibit :A: adopted by Ordinance No. 266 with the Exhibit "A" attached hereto and
reads as follows:
"Section 3.36.010 Established Developments Subject to Fee. A Fire Protection Fund is
established for providing fire protection sites, facilities, and equipment required by the demand
for services from new developments in the City of Palm Desert. All developments outside of a
five minute response time as identified in attached Exhibit "A", shall be subject to said fee.
Said fee shall be computed and levied as follows:
a) $100 per residential unit;
b) $100 per 1,000 square foot of non-residential construction."
Section 2: The City Clerk shall certify to the passage and adoption of this ordinance
and shall cause the same to be published once in the Palm Desert Post, a newspaper of general
circulation, printed, published and circulated within the City of Palm Desert, and the same shall
be in force and effect thirty (30) days after its adoption."
PASSED, APPROVED, AND ADOPTED by the City Council of the City of Palm
Desert, California, at its regular meeting held this day of , 2003, by the
following vote, to wit:

A fire protection fund is established for providing fire
protection sites, facilities and equipment required by the
demand for services from new developments in the city.
All developments outside of a five minute response time
as identified in Exhibit "A" attached to the ordinance
codified in this chapter and adopted by reference, shall
be subject to said fee.
Said fee shall be computed and levied as follows:
A. One hundred dollars per residential unit;
B. One hundred dollars per one thousand square feet
of nonresidential construction. (Ord. 266 § 1, 1981)
3.36.020 Certain developments exempted —
When.
Development within the five minute response time area
of a fire protection facility shall be exempted from fees
set forth in Section 3.36.010, five years after completion
of said facility. (Ord. 266 § 2, 1981)
