Construction Management Services for the Aztec Road at Cook
Street Intersection Improvements (Project No. 602-02), in the
amount of $35,000.00.
Discussion:
Staff requested proposals for the Construction Management Services for City
Capital Improvement Projects, with proposals submitted by the following firms:
CVCS
RBF Consulting
The Keith Companies
(Indio, CA)
(Palm Desert, CA)
(Palm Desert, CA)
Staff evaluated these proposals based upon the qualifications of the applicants,
and recommends the contract be awarded to CVCS of Indio, Califomia. The
Construction Manager tasks and daily duties are outlined in the attached
Staff Report

proposal. Coachella Valley Construction Services will be performing this duty at
the hourly rate of $125.00 per hour for 25 hours per week for the anticipated 11
weeks duration of this project.
Funds are available for this service in the Project Account No. 213-4623-433-
4001.
Therefore, staff recommends that City Council, by minute motion, award Contract
No. C 22100A to CVCS for Construction Management services for the Aztec
Road at Cook Street Intersection Improvements (Project No. 602-02).

AGREEMENT
THIS AGREEMENT, made and entered into this 27th DAY OF MAY, 2004, by
and between the CITY OF PALM DESERT, a public body, corporate and politic,
hereinafter referred to as "CITY", and COACHELLA VALLEY CONSTRUCTION
SERVICES, LLC, hereinafter referred to as "CONSULTANT".
WITNESSETH:
WHEREAS, CONSULTANT is a corporation, the principal members of which are
Professional Consultants duly registered under the laws of the State of California; and
WHEREAS, the CITY desires to engage CONSULTANT to render certain
technical and professional consulting services as set forth in Exhibit "A" (Consultant's
Proposal of Services) in connection with the design of Project: Aztec Road at Cook
Street Intersection Improvements (602-02).
NOW, THEREFORE, the parties hereto agree as follows:
(1) The CITY hereby agrees to engage CONSULTANT to perform the
technical and/or professional services as hereinafter set forth.
(2) CONSULTANT shall perform all work necessary within the
schedules provided herein to complete the services set forth in Exhibit "A" attached
hereto and by reference incorporated herein and made a part hereof.

(3) All information, data, reports, records and maps as are existing and
available from the CITY and necessary for the carryings out of the work outlined in
Exhibit "A" hereof shall be fumished to CONSULTANT without charge by the CITY and
the CITY shall cooperate in every way reasonable in the carrying out of the work without
delay.
(4) CONSULTANT represents that it employs or will employ, at its own
expense, all personnel required in performing the services under this Agreement.
(5)
All of the services required hereunder will be performed by
CONSULTANT or under its direct supervision, and all personnel engaged in the work
shall be qualified and shall be authorized or permitted under state and local law to
perform such services.
(6) The execution of this Agreement by the parties hereto does not
constitute an authorization to proceed. The CITY's Executive Director, or his designee,
has not authorized CONSULTANT to proceed.
(7) CONSULTANT shall work closely with the CITY's Executive
Director, or his designated representative, who shall be the principal officer of the CITY.
CONSULTANT shall review and receive the Executive Director's, or his designated
representative's, approval of the details of work as it progresses. The consultant hereby
designated by CONSULTANT as its representative for supervision of the work required
by this Agreement is David C. Cordero.
(8) CONSULTANT warrants that he has not employed or retained any
company or person, other than a bona fide employee working solely for CONSULTANT,
to solicit or secure this Agreement, and that he has not paid or agreed to pay any

company or person, other than a bona fide employee working solely for CONSULTANT,
any fee, commission, percentage, brokerage fee, gifts, or any other consideration,
contingent upon or resulting from the award or making of this Agreement. For breach or
violation of this warranty, the CITY shall have the right to annul this Agreement without
liability, or in its discretion to deduct from the contract price or consideration, or
otherwise recover, the full amount of such fee, commission, percentage, brokerage fee,
gift or contingent fee.
(9) The right is reserved by the CITY to terminate the Agreement at
any time upon seven (7) days written notice, in the event the project is to be abandoned
or indefinitely postponed, or in the event CONSULTANT's services, in the sole
judgment of the CITY, are unsatisfactory or because of CONSULTANT's failure to
prosecute the work with diligence or within the time limits specified or because of his
disability or death. In any such case, CONSULTANT shall be paid the reasonable
value of the services rendered, based upon CONSULTANT's standard hourly rates, up
to the time of the termination. CONSULTANT shall keep adequate records to
substantiate costs and provide copies of original timecards in the event of termination or
suspension.
(10) All documents including tracings, drawings, estimates, reports,
investigations and computations shall be delivered to and become the property of the
CITY. The CITY acknowledges and agrees that all plans, specifications, reports and
other design documents prepared by CONSULTANT pursuant to this agreement shall
be used exclusively on this project and shall not be used for any other work without the
written consent of CONSULTANT. In the event the CITY and CONSULTANT permit

the re -use or other use of the plans, specifications, reports or other design documents,
the CITY shall require the party using them to indemnify and hold harmless the CITY
and CONSULTANT regarding such re -use or other use, and the CITY shall require the
party using them to eliminate any and all references to CONSULTANT from the plans,
specifications, reports and other design documents.
(11) CONSULTANT shall comply with all federal, state and local laws,
ordinances and regulations applicable to work.
(12) No change in the character or extent of the work to be performed
by CONSULTANT shall be made, except by supplemental authority in writing between
the CITY and CONSULTANT. The supplemental authority shall set forth the changes
of work, extension of time and adjustment of the fee to be paid by the CITY to
CONSULTANT, if any.
(13) In connection with the execution of this Agreement, CONSULTANT
shall not discriminate against any employee or applicant for employment because of
race, religion, color, sex or national origin. CONSULTANT shall take affirmative actions
to insure equal employment opportunity and that employees are treated during their
employment without regard to their race, religion, color, sex or national origin. Such
actions shall include, but not be limited to, the following: employment, upgrading,
demotion or transfer; recruitment or recruitment advertising; layoff or termination; rates
of pay, or other forms of compensation and selection for training, including
apprenticeship. This clause shall be included in each related subcontract, if any,
awarded by CONSULTANT.

(14) The CITY agrees to pay CONSULTANT for the work required by
this Agreement on the following basis:
CONSULTANT shall submit invoices monthly for services performed in
the previous month not to exceed the total contract amount of: FORTY FIVE
THOUSAND DOLLARS and 00/100 ONLY ($45,000.00). The CITY agrees to pay all
undisputed invoices within thirty (30) days of receipt of invoice. The CITY agrees to
notify CONSULTANT of disputed invoices within fifteen (15) days of receipt of said
invoice.
(15) CONSULTANT agrees to complete the work and submit the Final
Design Consulting Phase, as displayed in Exhibit "A".
(16) In the event that any judgment is entered in any action upon this
Agreement, the party hereto, against whom such judgment is rendered, agrees to pay
the other party an amount equal to the reasonable value of the legal services performed
in his or its behalf in such action and that such amount may be added to and made a
part of such judgment.
(17) This Agreement shall be binding on the successors and assigns of
the parties, but it shall not be assigned by CONSULTANT without written consent of the
CITY.
(18) CONSULTANT shall be an independent contractor, not an
employee of the CITY.
(19) Prohibited interests are as follows:
No officer, member or employee of the CITY during his tenure or one year
thereafter shall have any interest, direct or indirect, in this Agreement or the proceeds

thereof. The parties hereto covenant and agree that to their knowledge no member of
the CITY Board, officer or employee of the CITY has any interest, whether contractual,
non -contractual, financial or otherwise, in this transaction, or in business of the
contracting party other than the CITY, and that if any such interest comes to the
knowledge of either party at any time, a full and complete disclosure of all such
information will be made in writing to the other party or parties, even if such interest
would not be considered a conflict of interest under applicable laws.
CONSULTANT hereby covenants that he has, at the time of this
Agreement, no interest and that he shall not acquire any interest in the future, direct or
indirect, which would conflict in any manner or degree with the performance of services
required pursuant to this Agreement. CONSULTANT further covenants that in the
performance of this work no person having any such interest shall be employed by
CONSULTANT.
(20) CONSULTANT shall indemnify and save harmless the CITY, its
officers and employees, from and against any liability, loss, cost or expense resulting
from any injury or damage to persons or property caused by the negligent act(s) or
omission(s) of CONSULTANT, its agents or employees, while engaged in the
performance of this Agreement. CONSULTANT shall submit to the CITY, before the
Notice to Proceed is issued, certification of adequate coverage for "errors and omission"
insurance in amounts approved by the CITY's Attorney. Any such insurance shall not
be canceled prior to written notice to and approval from the CITY.

Re: Proposal to Provide Constructability Review Services for the City of Palm
Desert Capital Improvement Projects
Dear Mr. Rodriguez,
Coachella Valley Construction Services, LLC (CVCS) is pleased to respond to your request for a proposal to
perform constructability review services for the City of Palm Desert's Capital Improvement Projects.
Coadieila Valley Construction Services, LLC is a company developed to provide project support to the public
works and private sector participating in the vast and rapid growth of infrastructure in the Coachella Valley.
CVCS provides services intended to assist the construction sector with project planning and development
CVCS specializes and offers the following Pre -bid Construction Support Services as part
Construct -ability Review element:
• Detailed Review and Analysis of Design Drawings.
• Detailed Review and Analysis of,Referenced Specifications and the Contract Documents.
• Quantity Take -off Verification.
• Construction Budget Review.
• Construction Estimating.
• Construction Scheduling.
• Value Engineering.
CVCS provides questions, comments and recommendations related to the clarity, consistency, and thoroughness
of design as it relates to the plans, referenced specifications, contract documents, budget estimates, scheduling
and construction. Additionally, CVCS provides an independent document review and plan check making
corrections to confusing, conflid3ng and/or ambiguous language, construction details, quantities and
construction notes.
Our objective is to review plans and specifications for these potential errors or omissions that may be costly to
the project after the award of a contract, and to bring these to the agencies attention prior to the bidding
process. These.`risk redudng services" are intended to assist the agency with project budgeting and project
cost control during the planning stage.
Another service provided by CVCS is "value engineering". During plan review, value -engineering alternatives
are recommended, related to material utilization and/or methods of construction, relative to their effectiveness,
efficiency, economy and life cycle in today's market prices. This service can prove to be a `cost savings
service" should alternative options become available to a given project

CVCS also offers Construction Management Services with the following specific project tasks as part of its
construction support services during the construction phase of a project:
Construction Management (Daily Activities)
• Project site -visit for contractor and owner interaction to verify contractor activities and construction
progress as it relates to the project plans, specifications, contract documents, project schedule,
project safety and deansiness.
• Verification and review of contractor material, labor and equipment utilization.
• Review of daily inspection reports as provided by the project inspector.
• Review of project correspondence including: material submittal requirements, project schedules,
weekly schedule up -dates, RFI's, change orders, etc.
• Coordination of participating utility agencies, agency inspectors and/or representatives to facilitate
construction progress.
Construction Management (Weekly Activities)
• Weekly Construction Progress Meeting with the contractor and agency/owner personnel. At these
weekly meetings participants will review an agenda which discusses the projects progress relative
to the following items:
• Project schedule.
• Construction activity updates.
• Statement of working days or remaining time for completion.
• Review and response to new and outstanding action items and/or project concerns.
• Project safety, traffic control, deansiness and appearance.
• Weekly Project Photos are produced to verify contractor activities, construction progress,
projects commitment to project safety, traffic control, deansiness and appearance.
Construction Management (Monthly Activities1
• Schedule of Values review and verification.
• Change Order review and verification.
• Extra Work review and Verification.
• Field Quantity review and verification.
• As -built Drawing review and verification.
• Progress Payment/Payment Requisition review and verification.
These services are intended to assist the agency with contract administrative requirements specific to the
contract, relative to the start, progress, and successful completion of a project.

Statement of Experience and Oualifications
DavidA Corder+ -President
David A. Cordero is the founder and president of Coachella Valley Construction Services, LLC. Mr. Cordero has
over 13 years of experience in public works, state, federal and private construction contracting. He has served
as an active estimator and construction manager for various projects throughout Southem California currently
partidpating in the vast growth of infrastructure projects and site work developments of the Coachella Valley,
since 1995.
Mr. Cordero's educational background consists of a Bachelor of Science Degree in Construction Engineering
Management from California State University, Long Beach and an Assodate of Science Degree in Materials
Engineering Technology from Don Bosco Technical Institute, Rosemead, CA. Additionally, Mr. Cordero is
currently finalizing the acquisition of a State of California Class A Contractors License and initializing the
formation of a general engineering construction company.
Mr. Cordero has served in various management positions obtaining and applying his experience with a diverse
group of contractors that specialize in the various trades of dvil construction. These contractors indude
Southern Califomia Underground Contractors, Brea, CA., Granite Construction Company, Indio, CA., and
Dateland Construction Company, Coachella, CA.
Mr. Cordero specializes in street improvements; including excavation, grading, asphalt paving and concrete.

Payment for Services
The Payment for services lasting less than one month is due and paid in two installments. The first installment
shall be 30% of the quoted agreed amount, and due at the beginning of the service. The second and final
balance is dale upon completion of the work prior to the release of information to the client. For -services lasting
more than one month, the first installment shall be 30% of the quoted agreed amount, and due at the
beginning of the service. The balance will be invoiced on a bi-weekly basis. Payment will be required upon
receipt of the invoice. Please note that alternate payment terms may acceptable by mutual agreement.
