Recommendation:
By Minute Motion:
1. Authorize the transfer of title for Lot 17 of Portola Palms
to the Portola Palms Homeowners Association, Inc.
2. Authorize the mayor to execute the same.
Discussion:
On July 19, 2001, City Council approved the contract for the Capital
Improvement Project No. 648-99 with Tetra Tech, Inc. for the engineering
services in the design of the Magnesia Falls Drive street improvements and
bridge over the San Pascual Channel.
In reviewing the proposed street improvements it was determined that a driveway
could be provided for safer ingress and egress for the Portola Palms Mobile
Home Park residents on Magnesia Falls Drive. The proposed driveway will be
located on Lot No.17, which fronts the south side of Magnesia Falls Drive and is

located approximately 750' west of the intersection of Portola Avenue and
Magnesia Falls Drive.
On December 13, 2001 the City Council approved the purchase of Lot 17 of
Portola Palms by the City from the Palm Desert Redevelopment Agency.
On November 26, 2003, staff indicated that the City would set aside Lot 17 of
Portola Palms, to be granted to the Homeowners Association, for the much
needed egress system off Magnesia Falls Drive.
On April 6, 2004, the City officially opened the Magnesia Falls Drive Bridge,
connecting a through way from Portola Avenue to Monterey Avenue. In keeping
with the spirit of negotiation between the Portola Palms Homeowners Association
and the City, staff recommends the transfer of Lot 17 at this time.
Therefore, staff recommends that City Council by minute motion, authorize the
transfer of title to Lot 17 of Portola Palms to Portola Palms Homeowners
Association, and authorize the mayor to execute the same.

mutual benefit corporation,
the property described as "Exhibit A" attached hereto and made a part of, as a common area lot, in the
City of Palm Desert, County of Riverside, State of California. This deed is subject to a deed restriction in
favor of the City of Palm Desert, that the Grantee (as well as its members, guests, and, invitees) are
limited to use the subject property for ingress and egress to and from Portola Palms Subdivision, as well
as all related landscape, walls, gate improvements, gate mechanisms, and other attendant uses related
to an entryway/exit, but may not use the subject property for the purposes of placing/installing a
manufactured home/residence.
NOTE: THIS TAX PARCEL HAS NO SPEARATE VALUE AND SHOULD NOT BE ASSESSED A SPEARATE
AAMOUNT, AS PROVIDED IN SECTION 2188.5 OF THE CALIFORNIA REVENUE AND TAXATION CODE.
