Discussion: Tract 30438 is located on the west side of Highway 74 near the White Water Channel. The project developer will be constructing a comprehensive drainage facility. This facility was approved by CVWD and Bechtel for the existing and proposed conditions. The Stone Eagle development will not dump or direct any flow that may occur on any of the City of Palm Desert's property, nor on any other property adjacent to the development site. Additionally, they will not be increasing or contributing to the flow to the CVWD White Water Channel. The project developer has requested that drainage fees be waived for this development. The basis for this request lies in their assertion that not only will the proposed drainage facilities benefit the project, but it will also provide benefit to the general public. Granting the waiver of drainage fees will result in collection of no fees for drainage, however the required facilities will be constructed by the developer. Engineering Manager City of Palm Desert FROM: Nizar Farhat DATE: May 7� 4 RE: Stone Eagle Drainage Fee CC: Ted Lennon, Bill Munson, John Fitzpatrick, Bob Williams Dear Mark, 1 am writing to you in reference to the City Planning Commission's Resolution No. 2155, Condition of Approval, Item #1, Department of Public Works, which states the following: Drainage fees, in accordance with section 2649 of the Palm Desert Municipal Code, and Paim Desert Ordinance 653, shall be paid prior to recordation of the final map or issuance of the grading permit. Stone Eagle Development is requesting a waiver of the above referenced drainage fees for both the golf course and the residential development. The justification of this request is based on the following: Stone Eagle Development will be constructing a comprehensive drainage facility to contain the flow through a series of flood control weirs, drop structures, lakes, and collection basins. This facility was approved by CVWD and Bechtel for the existing and proposed conditions. The Stone Eagle development will not dump or direct any flow which may occur on any of the city's property, nor on any other property adjacent to the Stone Eagle site. Also, we will not be increasing or contributing to the flow to the CVWD White Water Channel. Please see the attached construction costs for the new flood control facility we will be constructing throughout the project to contain and control the flow of any water. Stone Eagle Development therefore requests a waiver of the above noted fees. We appreciate your consideration of this request and look forward to working with the city of Paim Desert throughout the construction and development of this project. Page 1 of 1 Title 25 ZONING Chapter 25.56 GENERAL PROVISIONS 25.56.080 Required drainage fees. Except for existing buildings, no building and no land shall be used for any new commercial, industrial, professional, group dwelling or community facility use, nor shall any certificate of use and occupancy therefor be issued where the site of such building or such land to be used for said uses is located within the boundaries of the city duly adopted master plan of drainage, until and unless the drainage fees pertaining to the gross area of the site have been paid in the amount set forth in the legislative action adopting and establishing such a master plan of drainage. The funds derived from the drainage fees imposed shall be utilized only for the construction of local drainage facilities for the disposal of surface and storm waters from the local drainage area in which such building or land is located pursuant to the adopted master plan of drainage. At the discretion of the city council, dedication of rights -of -way, or actual construction installation, or design by a duly registered civil engineer or improvements described in the master plan of drainage, or any combination thereof, may be accepted in lieu of the payment of the aforementioned fees. "Commercial, industrial, professional, group dwelling, or community facility use" as used in this title includes any retail, wholesale or industrial business, the carrying on of any profession, the operation of a group dwelling consisting of five or more families, mobile home parks, motels, hotels, and community facilities; but does not include agricultural or horticultural products grown or produced on the premises as an accessory use to the land, or the operation of any home occupation, or temporary individual mobile home.
