Establish a public road from the northern boundary of Homme Adams Park to the quarter Section boundary for Section 30 and 31, located south of Upper Way West. 2. Establish a variable roadway width up to a maximum 36' right-of-way width with a 20' paved section and 8' shoulders on each side of the roadway, minimizing relocation of utilities and native vegetation. 3. Create a vehicle turn -around area at the northern boundary of Homme Adams Park. 4. Seek dedication of the roadway from the Coachella Valley Water District. 5. Establish a street name for the roadway. 6. Require developers to construct a fair share portion of the above -described improvements in conjunction with subdivision of any of the affected properties. G:\PubWorks\Staff Reports12004\May 27\Palm Valley Access Road.doc Staff Report Regarding the Palm Valley Access Road Page 2 of 3 May 27, 2004 Executive Summary: At the November 13, 2003 City Council meeting, staff was directed to conduct a survey of property owners requiring access on the Palm Valley Channel access road to determine their desires regarding surfacing and maintenance of the road. The survey has been completed and 20 out of 23 respondents strongly desire that the road be paved with asphalt and maintained by the City. Discussion: With the assistance of Councilman Crites, staff developed and distributed a survey of affected property owners regarding the access road. The survey allowed owners to rank their preference for various types of surfacing (sealing, gravel, asphalt), who should maintain the road (City and/or CVWD), and their willingness to pay a share of the cost for improvements. 23 of 34 surveys were returned, resulting in a response rate of 68%. This indicates a strong interest in this issue. As the survey summary indicates, there is a very strong preference for the access road to be an asphalt surfaced -public street maintained by the City. Eight of the respondents indicated some willingness to pay a fair share of the cost for improvements. As you may recall, the need for public access results from previous actions by the City and Coachella Valley Water District (CVWD) in constructing the Palm Valley Channel, severing historical access paths to the properties west of the Channel. Lack of clearly defined access may restrict or delay development of properties west of the channel. Recent approval of two parcel maps west of the channel brings this issue to the forefront. Conditions of Approval for those parcel maps require that legal access be established to those parcels. CVWD does not recognize any right of the property owners to use the Channel Access Road. Creation of the Homme Adams Public Park along the channel has resulted in residents expressing concern about the condition of the access road. The City is currently responsible for access road maintenance along the park, a length of about one-half mile. An experimental surface treatment was applied to a portion of the access road. This treatment is reasonably effective at reducing dust but does break down under the wear and tear of traffic. This treatment is not recommended as a Tong -term solution in this case. Staff has evaluated this situation and recommends acquiring a minimum 36-foot dedication from CVWD for public roadway from the north end of Homme Adams Park to the quarter section line south of Upper Way West, a distance of approximately three-quarters of a mile. CVWD has tentatively agreed to offer the needed roadway dedication, as long as the City maintains the road and CVWD retains access. A finished surface should be provided with a rural look. This could include chipped seal surface, painted surface, or other treatment. Long-term maintenance must be considered in the evaluation of this proposed roadway. The proposed bike path along the channel would also utilize this paved section. The pavement and shoulders should be narrowed where necessary to avoid obstructions such as trees and utility risers. The goal is to provide legal, safe, all weather access to the park and private properties that does not increase speeds unnecessarily while blending with the surroundings to the best extent possible. Preliminary costs estimates range from $250,000, for a basic chip seal surface, to $750,000.00 for a special colored aggregate surface. Conclusion: Having evaluated access in this area and receiving input from the City Council and affected property owners, staff continues to recommend establishing a public roadway on the Palm Valley Channel Access Road. CVWD is the current owner of this property and can deny access to your property at any time. YOU DO NOT HAVE LEGAL ACCESS TO YOUR PROPERTY!! The Water District will not issue individual easements to property owners. CVWD has offered a public easement to the City of Palm Desert so the City can make this a public road, which would give us access to our neighborhood. In order to accept this offer the City would have to build a road to a city standard. The City would adopt a new rural road standard, which would be 24' wide without curb and gutter to retain the rural feel of the area. According to the City Engineer & City Manager, the City is already liable for the road and its maintenance. They have stated that the proposal would actually save the City money by building a permanent road instead of maintaining a temporary road. The City Manager brought this matter before the City council and the City council requested that staff find out what the residents of this area would like. In other words they wanted to find out if the property owners in this area would like to have a nice road with no potholes or dust which would give the residences legal access to their property. After all, the only cars to use the road were the home owners in this area and from time to time, a sightseer would be noticed. The road was a washboard, but around Christmas time, the Coachella Valley Water District would take pity upon us and grade the road. The enclosed letter indicates in April of 1984 the CVWD was agreeable in offering the storm channel bridge and dirt access road to the City of Palm Desert for public use. However, the City wanted us to remain in our present state to discourage hillside population. In recent years, much has changed. Construction of two more homes have been added t© the population of the hillside area. People that have resided in the hills, and use the road, have grown in numbers along with their friends adding to the amount of vehicles using the road. The new Holmes Adams Park is becoming more popular each day, all resulting in much traffic, creating dust problems for all who live near Calle de Campesino. Suffice it to say, a paved road to travel on is no more than what a normal, taxpaying, homeowner in the city of Palm Desert would expect. Because, under normal conditions, the road they travel on a regular basis would not be `DIRT". There would not be a PM10 dust problem endangering the health.of the city's residents. It has been our desire for years to have this easement paved for safety and protection of our property. CVWD has been unresponsive and private means have paved the roads leading to our homes. This primary access road has remained dirt/gravel for years which creates air pollution of dust for area residents plus the schools and churches adjoining the channel plus the wear, tear and damage to our vehicles caused by the unimproved roadway. As part-time residents, we pay full- time taxation for few services in return. This seems like a small request in the overall budget of a thriving city that we enjoy very much and hope to continue to enjoy in the future. It is not only for selfish reasons we make this request but for the public protection of less polluted air and safety of transportation. We heartily encourage the City Council to approve the offer from CVWD and put this questionable legal matter to rest for the sake of individual property owners and the city at large. We all have a stake in this area with the recent addition of the Cap Homme Park to the city park system which seems to be increasingly popular with residents and visitors. Added traffic to this area makes the paving of this dusty dirt road all the more important. Please consider our request for this approval for the sake of all involved.
