Executive Summary:
Staff has finalized the One -Year Action Plan and the Outside Agency Funding Committee has
met and reviewed all Community Development Block Grant (CDBG) applications for FY
2004/2005 with the recommendations listed within this memorandum. The City of Palm Desert
will receive $415,000 in funding for 2004/2005. This is $4,000 less than awarded in 2003/2004
and is due to new cities/counties qualifying to become Direct Entitlement Jurisdictions. Once
City Council has approved this cycle's applications for funding and the Action Plan, staff will
submit to HUD for its 45-day review and approval process.
Background:
The Outside Agency Funding Committee met on Tuesday, February 24, 2004, to review all
submitted Community Development Block Grant Application for the FY 2004/05 funding cycle.
The above applicants have been identified as potential funding recipients. Total CDBG funds
for FY 2004/05 is $415,000.
The table below outlines all CDBG applicants and the original requested funding as well as
applicants being recommended for approval or denial. The Outside Agency Funding
Committee is recommending to City Council approval of the following Community Development
Block Grant (CDBG) applicants and the listed dollars that are noted in the "Recommended For
Approval" column:

The Committee discussed the idea of funding projects with award amounts that will make more
of an impact on a project or program instead of funding more projects and programs for smaller
amounts. As this was the focus of the Committee, it was recommended that FIND be awarded
a higher amount and that the City work with FIND and even RAP to develop a plan that would
provide a permanent multi -use facility. This project as such is being recommended for multiple
year funding starting with FY 2004/05 in the amount of $188,435 and for both FY 2005/06 and
FY 2006/07 funding in the amount of $200,000 in order to make a significant impact and
difference within the community.

Re: Community Development Block Grant Program
As identified within the City's Five -Year Consolidated Plan, there is a specific need within the community
to provide for the homeless and food programs. With the state and federal cutbacks and donations
being down, many non -profits are finding it very difficult to continue providing services to their clients.
FIND has been experiencing difficulties in paying the lease for its existing space and has requested
CDBG funds to pay for its lease. If the City awards funds for the lease, the organization will be in the
same position next year and will need to come back and ask for additional funding assistance. However,
the Committee felt that a better use of CDBG funds would be to assist FIND in either the construction of
a new facility or purchase/renovation of an existing facility to provide its services to the community. This
would free up needed funds to provide other services such as purchase and distribution of food and
transportation instead of paying on a yearly lease. Staff has been working with Regional Access
Program (RAP) to determine if it would be willing to partner with the City and FIND to fund this project.
City staff, RAP staff, and representatives from several non-profit organizations have been working
together to formulate a plan of action to bring this project to fruition. Several subcommittees have been
established to determine the facility and operation costs, funding, programs, etc. (Protocols and Access,
Operations, and Facilities and Funding Operations Subcommittees). The information gathered from
these subcommittees will be brought back to the City and RAP Board to determine whether this project is
feasible. The RAP Board will use this information to determine whether it would be able to participate in
this project. However, the City will need to set aside CDBG funds now in order to continue researching
the possibility of developing this project. Funds can be reprogrammed at a later datell necessary.
The table below outlines all of the organizations that requested CDBG funding for FY 2004/05, applicant
name, the requested dollar amount, type of program, previous funding, requests to other agencies, and
recommendation for approval or denial. The total amount requested from applicants was $746,964. All
categories of funding requests exceeded CDBG dollars.
Council's final approval of CDBG applicants will be included within the One -Year Action Plan and
submitted to HUD upon Final Approval. Staff recommends approval of the Outside Agency's
recommendations as submitted and the One -Year Action Plan.

ONE-YEAR ACTION PLAN - 2004-2005
General Information:
The City of Palm Desert adopted the (2003-2008) Five -Year Consolidated
Plan and now is preparing its second (FY 2004/2005) One -Year Action Plan to
be submitted to the U.S. Department of Housing and Urban Development (HUD)
on May 28, 2004. The Action Plan is the projected one-year use of funds that
the City proposes to utilize to address the identified priority needs and local
objectives for the 2004/2005 year under Community Development Block Grant
(CDBG). The City anticipates CDBG allocation is $415,000 to fund programs
and projects that meet National Objectives and create a viable urban community
by providing benefits to the homeless, and persons of low and moderate income,
decent housing and living conditions as well as other programs and projects that
meet the National Objectives. Outlined below are the various funding sources
available at the local, state, and federal levels to accomplish the housing and
non -housing community development needs as well as other community needs.
Resources:
Federal Resources:
Community Development Block Grant Program: The City anticipates
CDBG allocation for FY 2004/2005 is $415,000 to carry out the identified priority
needs addressing housing, homeless, senior/youth programs, handicap, etc.
These funds will be dispersed to subrecipients that have been identified as
proposing activities and projects that meet specific needs as identified within the
Consolidated Plan and Action Plan and that meet one of the three national
objectives (to benefit at least 51 % low to moderate income persons, slum and
blight, and community development needs having a particular urgency).
Non -Federal Public Resources:
Program Income: Program income generated as a result of the interest
generated from programs will be utilized for CDBG programs.
Redevelopment Housing Set -Aside Funds: Set -Aside funds are used for
housing activities such as acquisition, rehabilitation, new construction, rental
assistance, and First -Time Homebuyers Programs.
Outside Agency Funding: A portion of the City's General Fund monies are
utilized to fund various non-profit organizations needs that address homeless,
youth, handicap, domestic abuse, etc. The Outside Agency Funding Committee
awards these funds annually.
Private Resources:

For -profit: Potential resources could include Savings Associations
Mortgage Company and private lending institutions.
Non-profit: There are currently no non-profit funds identified.
IDIS Program:
The City of Palm Desert implemented and has utilized the HUD IDIS
Program since becoming a Direct Entitlement City in FY 2003/04 and has
continued to use the system for program updates and financial reimbursement.
The City will continue to use the IDIS system for program and activities
identification, allocation funding for each activity, and activity status updates.
The system will be used for program monitoring of each activity and funding
availability.
Geographic Distribution:
The City of Palm Desert will not be undertaking area benefit projects or
programs during FY 2004/2005. Therefore, there will be no geographic
distribution within the City limits of Palm Desert. All programs will activities
benefiting the very low to, low and moderate -income persons, limited clientele
activities, and housing activities. The geographic distribution will be Coachella
Valley wide as most of the organizations are located in other cities (e.g.,
Coachella, Indio, Palm Springs, etc.), but these organizations activities meet the
identified needs for Palm Desert and have a significant impact on our community
as a result the City has recommended funding the listed organizations.

CDBG General Requirements, Planned Activities, and Funding for FY
2004/2005:
General Requirements:
Executive Summary: The proposed goals and activities for the One -
Year Action Plan include providing safe and decent housing facilities for persons
with disabilities and HIV/AIDS, to address child abuse, neglect, and training
programs, to address senior issues more specifically transportation needs, to
address homeless issues such as emergency cold weather program and food
distribution programs. Various programs and projects have been approved that
will improve public facilities and services, housing and medical services.
The City is recommending utilizing CDBG funds to build a new facility or
purchase an existing facility to create a multi -use that will house the FIND
organization and possibly other non -profits. The F.I.N.D. project will be an
important achievement and best use of CDBG funds. City staff is working to
create a joint venture (partnership) with the Regional Access Program (RAP),
Food in Need of Distribution (FIND), and other non-profit organization to create a
multi -use facility. This operation will primarily be for food purchase and
distribution and other similar services that primarily impact the homeless and
very low to low-income individuals and families. Each agency will utilize
available monies to build a facility and offer programs that are vitally needed
within the central area of the Coachella Valley. The City is proposing to fund this
project as a three-year (multiple year) funding project through CDBG monies.
RAP is currently reviewing this project concept for possible funding and forming a
partnership with the City and other non -profits in this venture. RAP and the City
have already started the process of establishing subcommittees to research the
facility and program costs through the access and protocol subcommittee,
operations subcommittee, and facilities and funding operation subcommittee.
This project concept is in the initial steps, and it is anticipated that other
partnerships will be formed.
Displacement:
Proposed programs and projects do not involve the relocation of tenants
or homeowners. However, the City does follow the state and federal regulations
for displacement and relocation of persons.

Final Notice is hereby given that the public hearing on the proposed FY
2004/2005 One -Year Action Plan of the City of Palm Desert will be held at 4:00
p.m. or anytime thereafter on May 27, 2004, in the Palm Desert Council
Chambers located at 73-510 Fred Waring Drive, Palm Desert, California.
Final Public Comment Period regarding the proposed FY 2004/2005 One -
Year Action Plan of the City of Palm Desert will be received until May 26, 2004 at
5:00 p.m. at the City of Palm Desert Community Services Department located at
73-510 Fred Waring Drive, Palm Desert, California. The City Council will be
open and close the final public hearing at its meeting of May 27, 2004, at which

Council approval the Plan will be mailed to the U.S. Department of Housing and

Program Monitoring and Performance Measurement System:
The monitoring systems that the City has in place and will continue to
follow is as outlined within the Consolidated Plan; however, reference will be
reiterated here:
Program Monitoring: The City of Palm Desert through the Community
Services Division will continue to appropriate monitoring actions of all
Community, Planning, and Development (CPD), funded activities and recipients
in accordance with applicable U.S. Department of Housing and Urban
Development regulations and requirements as well as the Consolidated Plan.
The guiding principles and objectives of the monitoring is to ensure that the
primary benefits of all activities are intended, directed, and received by targeted
groups including but not limited to: low and moderate income households,
homeless, elderly, "at -risk" youth, persons with disabilities, special need
households, and women and minority -owned businesses.
Monitoring activities will be carried out through the following methods:
Project Reporting: Necessary reporting, including audits will be submitted
and reviewed on a monthly, quarterly basis, and/or monthly basis (as required) in
all housing, homeless, public services, public facilities, and other CPD activities
to allow prompt and effective program/project evaluation, corrective actions, and
completion.
Contracts and Agreements: The City will ensure that all contracts and
agreements, including subrecipient agreements and subcontracts, contain the
necessary language that details the type of information required, the appropriate
format, and frequency of reporting.
- Monitoring Visits: City staff will conduct on -site monitoring visits as
required (not less than annually) to all cooperating subrecipients, sponsors, or
other agencies conducting CPD activities for review of record keeping, project
activities accessibility, performance, etc. The City will also continue providing
annual training workshops to cooperating subrecipients and other agencies
covering procurement, reporting, performance, etc.
- Federal Regulatory Compliance: City staff will ensure that all CPD funded
activities comply with applicable Federal regulations including environmental
clearance, labor compliance, procurement, affirmative action, equal opportunity,
fair housing, etc.

- CPD Funded Project Review: City staff will review and analyze all
proposed uses of CPD funds, both County and cooperative cities, to ensure
adherence and continuity with the Five -Year Consolidated Plan, focusing upon
the adopted comprehensive community needs assessments and other
recognized community planning documents.
- Other: City staff will ensure that subrecipients, sponsors, and other
agencies compliance with City and HUD or other required regulations and
guidelines.
Performance Measurement System: The City of Palm Desert will
develop and implement a Performance Measurement System by the program
year 2005. The Performance System will be put into place to account for how
effective CDBG program funds are addressing the needs of our community. The
system will address two major area: (1) Productivity and Program Impact. The
system will address the six identified components: (1) preparatory work, (2)
selecting outcome/output measures, (3) specifying outcome/output indicators, (4)
data collection preparation, (5) validating the measurement system, and (6)
analyzing and reporting outcomes/outputs. To achieve compliance the City will
develop accomplishment matrices, pre and post surveys, on -site visits and
interviews and other tools that will assist in monitoring and undertaking the
performance measurement of each activity.
Analysis of Impediments (Al) Report:
The City of Palm Desert will prepare or have prepared an Analysis of
Impediments (to fair housing) Report that will address housing issues. This
report will be undertaken during the FY 2004/2005 cycle.

costs but that of the clients as well. This facility will allow a larger portion
of each agencies budget to be utilized for client needs and services
instead of on the rental of facilities.
Palm Desert is planning for the future and believes that funding a
permanent facility for non-profit groups that address food distribution as
well as other issues that face the homeless, and very low to low-income
individuals and families is providing a needed service to its community.
As the City and the valley grow so does the need for such a facility, and
now is the time to plan and provide such a facility. With the continuing
lack of donations and state and federal cutbacks as well as other
problems that non -profits face today, there is a continuing struggle just to
keep the doors open on non-profit organizations, at a time when they are
most needed. This facility will assist organizations to stay in operation,
maximize non-profit resources, and even provide extra dollars to the
budget for food purchases and distribution, and transportation, and other
services that are vitally needed by the homeless, very low to low-income
persons and families.
This will be a multi -year funding project for three years (FY 2004/05,
2005/06, and 2006/07) in the amount of $188,435 in FY 2004/05 and
$225,000 in FY 2005/06 and 2006/07.

The Regional Access Program (RAP) is also considering partnering with
the City of Palm Desert to fund and collaborate in the formation of this
project. RAP is a regional organizations designed to address various
community (Coachella Valley -wide) issues and provide grant opportunities

Since this program is in the initial steps, the City is still working to
establish partnerships; however, from the various community meetings
with the non -profits and RAP there is definitely an interest and need for

REQUIRED CERTIFICATIONS:
In accordance with the applicable statutes and the regulations governing
the Consolidated Plan regulations, the jurisdiction certifies that:
Affirmatively Further Fair Housing: The jurisdiction will affirmatively
further fair housing, which means it will conduct an analysis of impediments to
fair housing choice within the jurisdiction, take appropriate actions to overcome
the effects of any impediments identified through that analysis, and maintain
records reflecting that analysis and actions in this regard.
Anti -displacement and Relocation Plan: It will comply with the
acquisition and relocations requirements of the Uniform Relocation Assistance
and Real Property Acquisition Policies Act of 1970, as amended, and
implementing regulations at 49 CFR 24; and it has in effect and is following a
residential anti -displacement and relocation assistance plan required under
Section 104(d) of the Housing and Community Development Act of 1974, as
amended, in connection with any activity assisted with funding under the CDBG
program.
Drug Free Workplace: It will or will continue to provide a drug -free
workplace by:
1. Publishing a statement notifying employees that the unlawful
manufacture, distribution, dispensing, possession, or use of a
controlled substance is prohibited in the grantee's workplace and
specifying the actions that will be taken against employees for violation
of such prohibition;
2. Establishing an ongoing drug -free awareness program to inform
employees about:
a. The dangers of drug abuse in the workplace;
b. The grantee's policy of maintaining a drug -free workplace;
c. Any available drug counseling, rehabilitation, and employee
assistance programs; and
d. The penalties that may be imposed upon employees for drug abuse
violations occurring in the workplace;
3. Making it a requirement that each employee to be engaged in the
performance of the grant be given a copy of the statement required by
paragraph 1;
4. Notifying the employee in the statement required by paragraph 1 that,
as a condition of employment under the grant, the employee will:

a. Abide by the terms of the statement; and
b. Notify the employer in writing of his or her conviction for a violation
of a criminal drug statute occurring in the workplace no later than
five calendar days after such conviction;
5. Notifying the agency in writing, within ten (10) calendar days after

otherwise receiving actual notice of such conviction. Employers of
convicted employees must provide notice, including position title, to
every grant officer or other designee on whose grant activity the
convicted employee was working, unless the Federal Agency has
designated a central point for the receipt of such notices. Notice shall
include the identification number(s) of each affected grant;
6. Taking one of the following actions, within 30 calendar days of
receiving notice under subparagraph 4(b), with respect to any
employee who is so convicted:
a. Taking appropriate personnel action against such an employee, up
to an including termination, consistent with the requirements of he
Rehabilitation Act of 1973, as amended; or
b. Requiring such employee to participate satisfactorily in a drug
abuse assistance or rehabilitation program approved for such
purposes by a Federal, State, or local health, law enforcement, or
other appropriate agency;
7. Making a good faith effort to continue to maintain a drug -free
workplace through implementation of paragraphs 1, 2, 3, 4, 5, and 6.
Anti -Lobbying: To the best of the jurisdiction's knowledge and belief:
1. No Federal appropriated funds have been paid or will be paid, by or on
behalf of it, to any person for influencing or attempting to influence an
officer or employee of any agency, a Member of Congress, an officer
or employee of Congress, or an employee of a Member of Congress in
connection with the awarding of any Federal contract, the making of
any Federal grant, the making of any Federal loan, the entering into of
any cooperative agreement, and the extension, continuations, renewal,
amendment, or modification of any Federal contract, grant, loan, or
cooperative agreement.
2. If any funds other than Federal appropriated funds have been paid or
will be paid to any person for influencing or attempting to influence an
officer or employee of any agency, a Member of Congress, an officer
or employee of Congress, or an employee of a Member of Congress in
connection with this Federal contract, grant, loan, or cooperative

agreement, it will complete and submit Standard Form-LLL,
"Disclosure Form to Report Lobbying," in accordance with its
instructions; and
3. It will require that the language of paragraph 1 and 2 of this anti -
lobbying certification be included in the award documents for all sub -

under grants, loans, and cooperative agreements) and that all
subrecipients shall certify and disclose accordingly.
Authority of Jurisdiction: The Consolidated Plan is authorized under
State and local law (as applicable) and the jurisdiction possesses the legal
authority to carry out the programs for which it is seeking funding, in
accordance with applicable HUD regulations.
Consistency with Plan: The housing activities to be undertaken with
CDBG funds are consistent with the Strategic Plan.
Section 3: It will comply with Section 3 of the Housing and Urban
Development Act of 1968, and implementing regulations at 24 CFR Part

SPECIFIC CDBG CERTIFICATIONS
The Entitlement Community certifies that:
Citizen Participation: It is in full compliance and following a detailed
citizen participation plan that satisfies the requirements of 24 CFR 91.105.
Community Development Plan: Its consolidated housing and
community development plan identifies community development and housing
needs and specifies both short-term and long-term community development
objectives that provide decent housing, expand economic opportunities primarily
for persons of low and moderate income. (See CFR 24 570.2 and CFR 24 part
570)
Following a Plan: Following a Consolidated Plan approved by HUD.
Use of Funds: It has complied with the following criteria:
1 Maximum Feasible Priority: With respect to activities expected to be
assisted with CDBG funds, it certifies that it has develop its Action Plan
so as to give maximum feasible priority to activities which benefit low
and moderate income families or aid in the prevention or elimination of
slums or blight. The Action Plan may also include activities which the
grantee certifies are designed to meet other community development
needs having a particular urgency because existing conditions pose a
serious and immediate threat to the health or welfare of the
community, and other financial resources are not available;
2. Overall Benefit: The aggregate use of CDBG funds including Section
108 guaranteed loans during program year 2004-2005 (a period
specified by the grantee consisting of one program year), shall
principally benefit persons of low and moderate income in a manner
that at least 70 percent of the amount is expended for activities that
benefit such persons during the designated period;
3. Special Assessment: It will not attempt to recover any capital costs of
public improvements assisted with CDBG funds including Section 108
loan guaranteed funds by assessing any amount against properties
owned and occupied by persons of low and moderate income,
including any fee charged or assessment made as a condition of
obtaining access to such public improvements.
However, if CDBG funds are used to pay the proportion of a fee or
assessment that relates to the capital costs of public improvements
(assisted in part with CDBG funds) financed from other revenue
sources an assessment or charge may be made against the property
with respect to the public improvements financed by a source other
than CDBG funds.

The jurisdiction will not attempt to recover any capital costs of public
improvements assisted with CDBG funds, including Section 108,
unless CDBG funds are used to pay the proportion of fee or
assessment attributable to the capital costs of public improvements
financed from other revenue sources. In this case, an assessment or
charge may be made against the property with respect to the public
improvements financed by a source other than CDBG funds. Also, in
the case of properties owned and occupied by moderate -income (not
low-income) families, an assessment or charge may be made against
the property for public improvements financed by a source other than
CDBG funds if the jurisdiction certifies that it lacks CDBG funds to
cover the assessment.
Excessive Force: It has adopted and is enforcing:
1. A policy prohibiting the use of excessive force by law enforcement
agencies within its jurisdiction against any individuals engaged in non-
violent civil rights demonstrations; and
2. A policy of enforcing applicable State and local laws against physically
barring entrance to or exit from a facility or location which is the subject
of such non-violent civil rights demonstrations within its jurisdiction.
Compliance with Anti -discrimination Laws: The grant will be
conducted and administered in conformity with Title VI of the Civil Rights Act
of 1964 (42 USC 2000d), the Fair Housing Act (42 USC 3601-3619), and
implementing regulations.
Lead -Based Paint: Its notification, inspection, testing and abatement
procedures concerning lead -based paint will comply with the requirements of
24 CFR Part 35, subparts A, B, J, K, and R.
Compliance with Laws: It will comply with applicable laws.

APPENDIX TO CERTIFICATIONS
INSTRUCTIONS CONCERNING LOBBYING AND DRUG -FREE WORKPLACE
REQUIREMENTS:
A. Lobbying Certification:
This certification is a material representation of fact upon which reliance
was placed when this transaction was made or entered into. Submission
of this certification is a prerequisite for making or entering into this
transaction imposed by Section 1352, Title 31, U.S. Code. Any person
who fails to file the required certification shall be subject to a civil penalty
of not less than $10,000 for each such failure and not more than $100,000
for each such failure.
B. Drug -Free Workplace Certification:
1. By signing and/or submitting this application or grant agreement, the
grantee is providing the certification.
2. The certification is a material representation of fact upon which
reliance is placed when the agency awards the grant. If it is later
determined that the grantee knowingly rendered a false certification, or
otherwise violates the requirements of the Drug -Free Workplace Act,
HUD, in addition to any other remedies available to the Federal
Government, may take action authorized under the Drug -Free
Workplace Act.
3. Workplaces under grants, for grantees other than individuals, need not
be identified on the certification. If known, they may be identified in the
grant application. If the grantee does not identify the workplaces at the
time of application or upon award, if there is no application, the grantee
must keep the identity of the workplace(s) on file in its office and make
the information available for Federal inspection. Failure to identify all
known workplaces constitutes a violation of the grantee's drug -free
workplace requirements.
4. Workplace identifications must include the actual address of buildings
(or parts of buildings) or other sites where work under the grant takes
place. Categorical descriptions may be used (e.g., all vehicles of a
mass transit authority or State highway department while in operation,
State employees in each local unemployment office, performers in
concert halls or radio stations).

5. If the workplace identified to the agency changes during the performance
of the grant, the grantee shall inform the agency of the change(s), if it
previously identified the workplaces in question (see paragraph three).

Project Description: Funds will be provided for land acquisition to the purchase or construction cf a multi -use facility to be utilized
by F.I.N.D. and other non-profit organizations that deal with the distribution and serving of food to those in need as well as other
non-profit organizations providing similar services. This facility will provide one central location for some non-profit organizations
that provide needed services to Palm Desert residents as well as residents, in -need. throughout the Coachella Valley. Providing a
central location for non-profit groups will not only lessen each organizations travel. time, transoortation, facility, and other costs but
that of the clients as well. This facility will allow a larger portion of each agencies budget to be utilized for client needs and services
instead of on the rental of facilities.
Palm Desert is planning for the future and believes that funding a permanent facility for non-profit groups that address food
distribution as well as other issues that face the homeless, and very low to low-income individuals and families is providing a needed
service to its community. As the City and the valley grow so does the need for such a facility and now is the time to plan and
provide that facility. With the continuing problem that non -profits face today, primarily the lack of donations due to various reasons,
state and federal cutbacks. these organizations are struggling and some are closing their doors at a time when they are most
needed. This facility will assist organizations to stay in operation and even provide a buffer in so far as their budgets and
transportation are concerned.
This will be a multi -year funding project for three years (FY 2004/05, 2005/06. and 2006/07) in the amount of $188,435 in FY
2004/05 and $225,000 in FY 2005/06 and 2006/07.
The Regional Access Program (RAP) is also considering partnering with the City of Palm Desert to fund and collaborate in the
formation of this project. RAP is a regional organizations designed to address various community (Coachella Valley -wide) issues
and provide grant opportunities to non-profit organizations within the Coachella Valley.
Since this program is in the initial steps. the City is still working to establish partnerships. however, from the various community
meetings with the non -profits and RAP there is definitely an interest and need for such a facility
